RE: APPROVAL OF RECORDED EXEMPTION NO. 320 - GRANT BROTHERS, A
PARTNERSHIP.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Comrissioners of Weld County, Colorado, at a public hearing held
on the 15th day of May, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 320 , being the property of
Grant Brothers, a partnership, described as the SEa of Section 29 ,
Township 2 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
A parcel of land being the Southeast Quarter of Section
29, Township 2 North, Range 67 West of the 6th P.M. ,
County of Weld, State of Colorado
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
Section 2-lA(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Grant Brothers , be and hereby is , exempt
from the definition of the terms "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended.

Dear Commissioners :
The attached application, plat and related items are in refer-
ence to a request by Grant Brothers, a partnership, for a
recorded exemption. The parcel of land is described as SEa
Section 29, T2N, R67W of the 6th P.M. , Weld County, Colorado.
This property contains 160 acres of Class II and III irrigated
soils. The request is to split the property into parcels of
157.28 acres and 2. 72 acres. This property is located adjacent
to the northeast corner of Frederick.
As indicated in a letter dated March 31, 1978 , submitted by
Allan Musser, this property contains two full sets of improve-
ments, one of which is not required in the farming operations.
The intent is to sell the 2. 72 acre parcel with the existing
improvements to the present tenant.
Based upon the information submitted and the adopted policies
in the County, the Department of Planning Services Staff recom-
mends the request be approved for the following reasons :
1. The proposed split conforms with the intent clause of the
Recorded Exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricul-
tural Zone District (Section 3. 3 A. of the Weld County
Zoning Resolution) , and the Weld County Comprhenesive Plan
in that each parcel does have an existing set of improve-
ments . The use will be compatible with the surrounding
agricultural uses . The request will allow agricultural
and related uses to be the predominant land use.
2. The Tri-Area Planning Commission has no objections to this
request. They indicated that since the property already
has an existing set of improvements on it and that no
future development was planned that there should be no
objections .

3. The request complies with the provisions of Section 9-4 (A)
of the Weld County Subdivision Regulations.
It should be noted that the towns of Firestone, Dacono, and
Frederick are opposed to the approval of this request. The
town of Firestone has indicated that they are objecting because
they felt when a section of land is divided it should be annexed
and subdivided properly. The town of Dacono is objecting because
they feel that this type of subdividing is against the Weld
County Comprehensive Plan and that this type of subdividing will
create undue hardship on the services of the town and the area
because they will not be able to afford or receive funds for it.
The Town of Frederick gave no reasons for their objections .

Dear Mr. Cunliffe
On April 11, 1978 at 7:30 PM, the Dacono Planning Commission met and reviewed
the request from the Grant Brothers for a recorded exemption.
On a unanimous vote by the four members of the Planning Commission who
were present, the recommendation is to deny this request for the same
reasons that they have denied all other simular requests.
First, this type of subdividing is against the Weld County Comprehensive
Plan. Second, the plannig commission feels that this subdividing will
create undue hardship on the services of the towns in this area that
they can not afford and receive no funds for.

Dear Mr. Musser :
Your application and related materials for the above described request
are complete and in order. I have scheduled a meeting with the Board
of County Commissioners for May 8 , 1978 , at approximately 9 : 30 a.m.
This meeting will take place in the County Commissioners ' Hearing Room,
First Floor , Weld County Centennial Center , 915 - 10th Street , Greeley,
Colorado. It is recommended that you and/or a representative be there
to answer any questions the Board might have with respect to your ap-
plication .
It is the policy of Weld County to refer an application of this nature
to any town lying within 3 miles of the property on which the request
is made. Therefore , I have forwarded a copy of the materials submitted
to the following towns for their review and comment . According to our
records , the Town of Firestone Planning Commission is scheduled to
review and comment on your application on May 1 , 1978. Please contact
Minnette Paul with the Town of Firestone at 833-3291 for further de- -
tails on the Town of Firestone Planning Commission meeting. According
to our records , the Town of Frederick is scheduled to review and com-
ment on your application on April 13, 1978 . Please contact Mr. E. J.
Tagliente , Mayor with the Town of Frederick, at 423-9670 for further
details on the Town of Frederick Planning Commission meeting. According
to our records , the Town of Dacono is scheduled to review and comment
on your application on April 11 and April 24 , 1978. Please contact
Donnie Pasco with the Town of Dacono at 833-2317 for further details
on the Town of Dacono meeting. I have also forwarded a copy of the
materials to the Tri-Area Planning Commission for their review and
comment . According to our records , the Tri-Area Planning Commission
is scheduled to review and comment on your application on April 12 ,
