Conway Commissioner Scott K. James Commissioner Steve Moreno - EXCUSED Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Evan Pinkham Health Department representative, Ben Frissell The following business was transacted: IR I hereby certify that pursuant to a notice dated June 25, 2019, and duly published June 28, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Crestone Peak Resource Holdings, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0019, for Oil and Gas Support and Service (storage and staging yard for oil and gas equipment along with an existing office/shop building, existing welding shop, existing equipment storage building, existing field measurement and calibration building and up to twenty-five (25) cargo containers for storage of valves, fittings and electrical items) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. e Chair Kirkmeyer reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner Moreno excused. El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated the original USR-589 will be vacated with this approval, and described the surrounding uses and distance to the nearest residences. He indicated the Department of Planning Services had received no correspondence from surrounding property owners (SPO), cited Weld County Code, Section 26-4-90.B.3, with regard to the landscape buffer for oil and gas operations, cc • PLCCC,(TP), PcW(£P), £HC8F) O9/18-(19 2019-3509 PL2699 HEARING CERTIFICATION - CRESTONE PEAK RESOURCES HOLDINGS, LLC (USR19-0019) PAGE 2 discussed some of the Conditions of Approval (cOA) and Development Standards (DS), and displayed images of the site and surrounding views. (CLERK'S NOTE: The case was recommended favorably by the Planning Commission at their July 16, 2019, hearing.) El Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated the accesses are on County Road (CR) 4 and CR 19, and provided the traffic counts and average speed. He described the traffic associated with the site, indicated Public Works (PW) is requiring an Improvements and Road Maintenance Agreement, and presented the drainage and grading requirements. In response to Commissioner Conway, Mr. Pinkham confirmed there is not an Improvements and Road Maintenance required in USR-589. El Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions, and explained there will be one (1) full-time employee, as well as contractors and drivers visiting the site. He indicated bottled water and portable toilets are acceptable, and noted the site has a septic system and an industrial well. He stated waste and chemical items will be stored onsite, there will be a wash bay, and DS #9-26 address Environmental Health (EH) items. ▪ Meghan Campbell, represented the applicant and provided a PowerPoint presentation. She stated they are currently using the site as a storage yard, indicated there are no wells, showed the access points and haul routes, and discussed mitigation measures, including landscaping and screening. In response to Commissioner James, she indicated access after 6:00 p.m. will not be frequent. e No public testimony was offered concerning this matter. El In response to Chair Kirkmeyer, Mr. Gathman stated the requirement to vacate USR-589 still needs to be added as a COA, and noted the original USR was for gas processing. Ms. Campbell described the on -site waste and how it is stored, explained cargo containers versus dumpsters, described the location of the cargo containers, and indicated the need for two (2) access points is to keep traffic from backing up onto the roads. Mr. Pinkham confirmed an access permit was granted to the adjacent site operator, Discovery Energy, and is used as a shared access with Crestone Peak Resource Holdings. Ms. Campbell described their use of CR 4, and Mr. Gathman stated there is not a formal violation on the site and provided the site's history. e Chair Kirkmeyer described her recollection of the history of the site and stated there needs to be screening and landscaping to be compatible with its rural, residential zoning, and Commissioner Freeman agreed. Commissioner Conway stated the site has been there for 40 plus years and surrounding homeowners knew the site was there when they built their homes. He noted there were no SPOs at the Board hearing or at the Planning Commission hearing. In response to Commissioner Conway, Ms. Campbell indicated there is no irrigation water at the site currently. There was discussion about amending the current USR-589, versus creating a new USR, and how to move forward with the application. Chair Kirkmeyer reiterated the need for a 2019-3509 PL2699 HEARING CERTIFICATION - CRESTONE PEAK RESOURCES HOLDINGS, LLC (USR19-0019) PAGE 3 Landscape and Screening Plan and stated she would like to see that before approving the application. She also suggested going through the COA and DS so the applicant knows what else they may need to address, assuming the Board chooses to continue the case. After each Commissioner provided their thoughts, the Board decided to go through the COA and DS. F In response to Commissioner James about COA #1.D, Ms. Campbell confirmed they had been in contact with the Brighton Fire Protection District and Chair Kirkmeyer suggested adding a new COA #1.A to vacate USR-589. Ms. Campbell confirmed for Commissioner Conway, there is currently tracking control and it will be shown on the site plan. In response to Chair Kirkmeyer, Mr. Frissell confirmed DS #16 and #17 addresses the secondary containment requirement for chemicals and spilled or released material. Chair Kirkmeyer suggested changing "commercial"to "residential" in DS #21, and there was discussion about DS #22 (portable toilets). The applicant requested a recess to confer with her colleges regarding the use of portable toilets, versus the bathrooms onsite. F The Board took a five-minute recess. F The Board reconvened and Ms. Campbell requested to use portable toilets due to the bathrooms being in a locked, secured area with confidential information, as well as the proximity of the bathrooms to the far end of the site. Chair Kirkmeyer suggested moving on and stated the Board would have further discussion about DS #22. In response to Chair Kirkmeyer, Ms. Campbell indicated there are no state -issued permits required, therefore, Chair Kirkmeyer suggested deleting DS #24 (notification of any State -issued permits) and #25 (notice of non-compliance of a State -issued permit). Commissioner James suggested deleting DS #13 (Air Pollution Emission Notice (A.P.E.N.)). The Board agreed to all of the aforementioned changes. F In response to Chair Kirkmeyer, Ms. Campbell stated it would take Crestone Peak Resource Holdings two (2) weeks to develop a Landscape and Screening Plan. Chair Kirkmeyer reiterated the specific items she would like to see in the Plan and suggested continuing the case to August 21, 2019, to allow the applicant adequate time to develop a Plan. F Commissioner James moved to continue the request of Crestone Peak Resource Holdings, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0019, for Oil and Gas Support and Service (storage and staging yard for oil and gas equipment along with an existing office/shop building, existing welding shop, existing equipment storage building, existing field measurement and calibration building and up to twenty-five (25) cargo containers for storage of valves, fittings and electrical items) in the A (Agricultural) Zone District, to allow the applicant adequate time to develop a Landscape and Screening Plan. The motion was seconded by Commissioner Freeman, and it carried unanimously.
