Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and Final Plan for Five (5) Lot Minor Subdivision - S 588 (Ivy Crest). Applicant is proposing to modify the conditionally approved final plan to reduce the number of lots from five (5) to three (3) along with modifying the access into the Minor Subdivision. This project is north of Highway 66 and is west of and adjacent to CR 19. Parcel number 120921000052. Access is from CR 19. ACCESS Weld County Public Works has reviewed the application materials related to access and finds that the applicant is proposing two access locations to the subdivision. The northern access location does not meet spacing requirements but has an existing easement that is being used by parcels to the west. The proposed southern access does not meet spacing for a Collector road. Public Works is requesting that this southern proposed access be moved south to meet the spacing requirements as close as may be possible. Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure the approved accesses are compatible with your layout. Per Chapter 12, Article V, Section 12-5-30. F, when feasible, there shall be no net increase in the number of accesses to a public road. Minimum access spacing widths are shown in Weld County Code Appendix Table 12A-2. Please refer to Chapter 12 of the Weld County Code for more information regarding access. ROADS AND RIGHTS -OF -WAY County Road 19 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a(n) collector road, which requires 80 feet of right-of-way. The applicant shall delineate on the site map or plat the future and existing right-of-way and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC Latest ADT on CR 19 counted 572 vpd with 25% trucks. The 85th percentile speed is 63. IMPROVEMENTS AGREEMENT FOR ON -SITE IMPROVEMENTS Public Works is requiring an Improvements Agreement for on -site PUD improvements, per Chapter 24, Article 9, Section 24-9-20. This agreement will include on -site improvements associated with the development. Collateral is required to ensure the improvements are completed and maintained. Prior to recording the Final Plan, the applicant shall provide construction drawings to be reviewed by Public Works. Once the construction drawings are accepted, a Construction Schedule and a draft Exhibit A-2 AND B-2 are required, outlining the costs of onsite improvements. DRAINAGE REQUIREMENTS This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON - URBANIZING areas. Detention pond waived and a simple drainage narrative: The site meets drainage exception 23-12-30.F.1.a.7 for Residential Developments. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. ROADS Per Weld County Code Section 24 -7 -20. -Streets A.1 states "All building sites shall have access to a public internal street system." The applicant is requesting that the sites be served by two separate accesses onto County Road 19. If the Board of County Commissioners accepts this design, Condition of Approval one (1) below will need to be removed from the resolution. If the Board of County Commissioners does not accept the design as submitted, the applicant will need to provide design information for an internal roadway system including: plan and profile, a pavement design, signage information and cross sections to comply with Appendix 24-E of the Weld County code. This information will be required prior to recording the Minor Subdivision plat. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plat recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL A. An Improvements and Road Maintenance Agreement is required for on -site improvements associated with this project. (Department of Public Works) B. The plan shall be amended to delineate the following: 1. County Road 19 is a paved road and is designated on the Weld County Functional Classification Map as a collector road which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Department of Public Works) 2. Show and label the approved access locations, and the appropriate turning radii (25') on the site plan. The applicant must obtain an access permit in the approved location(s) prior to construction. (Department of Public Works) 3. Show and label the entrance gate if applicable. An access approach that is gated shall be designed so that the longest vehicle (including trailers) using the access can completely clear the traveled way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface be less than 35 feet. (Department of Public Works) 4. The applicant shall show the drainage flow arrows. (Department of Public Works) Prior to Operation: A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or off -site tracking. (Department of Public Works) 3. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. (Department of Public Works) 4. This application previously satisfied water and sewer requirements with the approval of S-588. Water will be provided by Central Weld County Water District and sewer will be provided by On - site Waste Water Treatment Systems. The Department recommends the following conditions, which should appear as notes on the final plat: 1. Water service shall be obtained from Central Weld County Water District. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 4. Director/State Engineer We have reviewed the materials received October 11, 2018 concerning the above referenced proposal to modify the conditionally approved final plan for the Ivy Crest Subdivision (S-586) to reduce the number of lots from five to three and modify the access into subdivision. The Ivy Crest Subdivision proposed to subdivide 15.62 acres known as Lot A of the Recorded Exemption 1209 -21 -4 -RE -2151 into five residential lots. We have previously provided comments to Ivy Crest Subdivision by our letter dated March 15, 2001 .The new owners of the property proposes to subdivide the 15.62 acres into three residential lots. The proposed water source for the three lots is still listed as the Central Weld County Water District ("District") and a letter of commitment for service has been previously submitted as part of the Ivy Crest Subdivision. The District provided information about their water supplies in June of 2012. According to that information the District primarily rely on Colorado -Big Thompson (C -BT) water to supply retail water to customers. As of June 2012 the District owned 5,370 C -BT units. The yield of C -BT units varies from year to year based on conditions and storage. The dry year quota applied for District firm yield planning is 0.6, resulting in a water yield of 3,222 acre-feet per year. In most years, the District's water yield greatly exceeds the firm yield. In addition, the District continues to develop additional water supplies, including participating in the Northern Integrated Supply Project (N ISP). Our records indicate that one well operating under permit no. 45972-A is located on the property. Well permit no. 45972-A was issued on September 7, 1979 as a replacement to the original well no. 45972 on the condition that the original well is plugged and abandoned. A Well Abandonment Report for the original well was not received in this office to affirm that the old well was plugged. Therefore the applicant must submit a well abandonment report (form GWS-09 available for download at: http://water.state.co.us/DWRIPub/Documents/gws-O9.pdf) on the old well to assure that the well was plugged and abandoned. The well is permitted for domestic purposes and was constructed to a depth of 45 feet. Section 37-92-602(3)(b)(III), C.R.S., requires that the cumulative effect of all wells in a subdivision be considered when evaluating material injury to decreed water rights. Therefore, the applicant must clarify if the well will be used within the subdivision or if the well will be plugged and abandoned. If the well will be used within the subdivision the proposed uses must be specified and the applicant must demonstrate that a court approved augmentation plan has been obtained for the well. Based upon the above and pursuant to Section 30-28-136(1)(h)(I) and Section 30-28-136(1)(h)(II), C.R.S., it is our opinion that the proposed water supply is adequate and can be provided without causing injury to decreed water rights as long as the Central Weld County Water District commits to provide water taps to the three lots. We recommend approval noting that the existing well cannot continue to be used after the subdivision approval unless is re -permitted pursuant to an augmentation plan approved by the water court or else must be plugged and abandoned.
