RE: GRANT REQUEST OF PUBLIC SERVICE COMPANY TO DEVIATE FROM THE
SETBACK REQUIREMENTS FOR COUNTY ROAD CROSSINGS.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 27th day of December, 1972 , the Board of
County Commissioners of Weld County, Colorado adopted a Resolution
regulating the installation of overhead utility lines across
county roads. Said Resolution states, in part :
"NOW, THEREFORE, BE IT RESOLVED by the Board
of County Commissioners , Weld County, Colorado,
and it hereby directs and orders that all over-
head utility lines crossing county roads, where
the origin or a main route of said utility lines
are not parallel to said county roads , shall main-
tain a pole or support structure setback of at
least 100 feet in each direction from the center-
line of said county road.
BE IT FURTHER RESOLVED, that where the afore-
mentioned provision for said pole or support
structure setback from a county road cannot
be met due to terrain features or other adverse
conditions, then in such event, special written
permission shall be obtained from the Board of
County Commissioners of each such deviation. "
WHEREAS, Public Service Company of Colorado has requested
approval by the Board for deviations on Weld County Roads 31 ,
37, 39, and 41, as more fully set forth on "Exhibit A" which is
attached herto and incorporated herein by reference, and
WHEREAS, an on-site inspection has been conducted by the
Utility Administrator of Weld County, Colorado and it has been
recommended that the Board grant each deviation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of Public
Service Company of Colorado for deviations from the setback
requirements be, and hereby is, granted.

County Road No. 31
Currently the Company has two existing transmission lines parallel with , and
adjacent to, the west right-of-way boundary of County Road No. 31. The proposed
Ft. Lupton-Hudson 115 kV transmission line must tap the eastern most line which is
directly adjacent to the road. It will be necessary to install two load break
switches and one air break switch to accomplish the tap. Please refer to the plats.
The presence of the 230 kV line west of the tap point prohibits the moving of the
two switching structures west of the road further west because of clearances. The
switching structure east of the road has been moved as far east as structural design
will allow.
County Road No. 37
The properties located on the west and east side of County Road No. 37
are currently under cultivation. The fixture on the east side of the road will
be located approximately 36 feet east of the centerline of the road. This is
being done to avoid the adverse effect the fixture would have on agricultural
production. The fixture on the west side of the road will meet the setback
requirements.
County Road No. 39
The property located on the east side of County Road No. 39 has recently
installed a circular sprinkler irrigation system and it was necessary to reroute
the line around the sprinkler. The line will be parallel with the County road
for approximately 800 feet and will be located 67. 5 feet east of the west
boundary line of Section 20, T.2N. , R. 65 W. The fixture on the west side will
meet the seback requirements.
County Road No. 41
The properties located on the west and east side of County Road No. 41 are
currently under cultivation. The fixture on the west side of the road will be
located approximately 37 feet west of the centerline of the road. This is
being done to avoid the adverse effect the fixture would have on agricultural
production. The fixture on the east side of the road will meet the setback
requirements.
NOTE: It should be pointed out that a benefit of locating transmission line
fixtures near the County road is to provide greater clearance and safety to the
public. Also, it is to the benefit of the farmers of property under cultivation
to have as many fixtures as possible located near their property lines to avoid
the necessity and difficulty of farming around the fixtures.

No permanent fixtures will be located within County road rights-of-way.
All work will be in accordance with good practices and conform to the recom-
mendations of the National Electric Safety Code and to such statutes as are
applicable.

Subject: Public Service Company Request for Overhead Utility Permit
This request is to deviate from the setback requirements of
100 ' for County Road crossings outlined in the Weld County
Resolution dated December 27 , 1972 .
The findings of an on site inspection is as follows :
County Road #31
The existing north-south line that will be tagged is now
adjacent to County Road 31 and new fixture can not meet the
100 ' setback requirement .
County Road #37
By placing the fixture 36 ' east of the centerline of County
Road 37 will greatly benefit the agricultural production and ,
in my opinion , would cause no problem to the County right-of-
way .
County Road #39
It is necessary to place the line and fixtures 67 . 5 ' east of
the centerline of County Road 39 to accomodate an existing
circular sprinkler and I see no problems with this design .
County Road #41
The proposed fixture on the west side of County Road 41 would
be 37 ' west of the centerline of said road , and by so doing
the agriculatural production would be greatly benefitted . In
my opinion , there should not be any County problems created
by this request .
From the above mentioned I recommend the granting of each
deviation .

Gentlemen:
During the construction of Public Service Company of Colorado's proposed
Ft. Lupton to Hudson 115 kV line, it will be necessary to deviate from
the setback requirements for road crossings , outlined in your resolution
dated December 27, 1972, at four locations because of terrain features
and other adverse conditions. Please refer to the enclosed plats and
Exhibit A.
It is requested that Public Service Company be given special written
permission to deviate from the 100 foot setback requirements.

greatly appreciated.

RESOLUTION
RE: REGULATING INSTALLATION OF OVERHEAD UTILITY LINES
ACROSS COUNTY ROADS.
WHEREAS, the Board of County Commissioners, Weld County,
'Colorado, has determined that overhead utility lines in Weld County are
so structured presently that said utility poles and/or structures are
located too close to existing county road rights-of-way; and
WHEREAS, the Board has determined that it would be in the best
interest of the County to have an adequate and uniform setback governing
the installation of all poles or support structures carrying overhead
utility lines across county roads.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, and it hereby directs and
orders that all overhead utility lines crossing county roads, where the
origin or a main route of said utility lines are not parallel to said county
roads, shall maintain a pole or support structure setback of at least
100 feet in each direction from the centerline of said county road.
BE IT FURTHER RESOLVED, that where the aforementioned pro-
. vision for said pole or support structure setback from a county road '
• cannot be met due to terrain features or other adverse conditions, then in
such event, special written permission shall be obtained from the Board
of County Commissioners for each such deviation.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 27th day of December,
