Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated November 16, 2018, and duly published November 21, 2018, in the Greeley Tribune, a public hearing was conducted February 6, 2019, to consider the request of Paul and Michelle King, for a Change of Zone, COZ18-0005, from the E (Estate) Zone District to the A (Agricultural) Zone District, at which time the Board deemed it necessary to continue the matter to February 13, 2019 to allow adequate notice of the request. Persuant to a notice dated December 18, 2018, and duly published December 21, 2018, in the Greeley Tribune, a hearing was conducted on February 13, 2019, and Bob Choate, Assistant County Attorney, made this a matter of record. 12 Angela Snyder, Department of Planning Services, presented a brief summary of the proposal, including the location south of County Road (CR) 84 and east of CR 19. She stated 15 referrals were sent out, and eight (8) referral agencies responded without concerns, or with concerns that were addressed in the staff recommendation. She explained the property is within the three (3) mile referral area of the Towns of Severance and Timnath, and there was no response from either town. She described surrounding land uses and zoning, and gave a brief history of the property indicating a final plat had never been recorded. She showed images of property and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. In response to Chair Kirkmeyer, Ms. Snyder confirmed the size of the lot. El Hayley Balzano, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, and explained the access location which meets spacing requirements. She stated there is an existing irrigation ditch access on the site, and described CR 84 as a local, gravel road. In response to Commissioner Freeman, Ms. Balzano provided the average daily vehicle roundtrips and speeds for CR 84, and presented the drainage and grading requirements. ccIPL (US/TP).Pu-)(H8), £FI(LL) O/a7/l9 2019-0552 PL1784 HEARING CERTIFICATION - PAUL AND MICHELLE KING (COZ18-0005) PAGE 2 El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the property will be served by an individual well and septic system, and indicated Environmental Health (EH) does not have any outstanding issues with the request. Michelle and Paul King, applicants, stated they would like to build a single-family residence on the property, and in response to Chair Kirkmeyer, they confirmed they are aware they are eliminating the existing development rights. No public testimony was offered concerning this matter. The applicants indicated they had no proposed changes to the Conditions of Approval (COA). In response to Chair Kirkmeyer, Ms. Balzano clarified the accesses on the property in regard to COA #1.A.6, Ms. Snyder clarified COA #1.6.3 in regard to zoning and building permits and the rest of the Board confirmed there is no condition regarding surrounding schools. In response to Chair Kirkmeyer, the applicants indicated they have reviewed, and agree to abide by, the Conditions of Approval, as amended. Commissioner Conway moved to approve the request of Paul and Michelle King for a Change of Zone, COZ18-0005, from the E (Estate) Zone District to the A (Agricultural) Zone District, with the Conditions of Approval entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:11 a.m. This Certification was approved on the 20th day of February, 2019.
