WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 18th day of September, 1978, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain tract of land is owned by Arvilla J. Sarchet, which land is more particularly described as follows: The E1/2 and the NE4, except the West 10 acres of the NE3 of the NEB of Section 23, Township 3 North, Range 66 West of the 6th P.M. , together with 2 shares of Farmers Resevoir and Irrigation Co. WHEREAS, the owner of said tract of land desires to obtain a variance from the minimum lot size requirement so that said applicant may make application to the Board of County Commissioners for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Comm- issioners of Weld County, Colorado, that a variance from lot size requirements be, and hereby is , granted to Arvilla J. Sarchet for a lot size variance. The property on which this request has been made is described as Part of the E2 of the NE4 Section 23, T3N, R66W of the 6th P. M. , Weld County, Colorado. This property is located 42 miles east of the Town of Platteville. The property contains approximately 70 acres of Class IV and VI non-irrigated soil. The request is to obtain a variance from tho minimum lot size requirement , Sec- tion 9-4 A. (6) , so that she may make application to apply for a recorded exemption. If this lot size variance is granted, Mrs. Sarchet will proceed with her application for a recorded exemption to divide the property into two parcels. Mrs. Sarchet wishes to sell 10 acres more or less out of the northeast corner of the property which will include an existing mobile home which Mrs. Sarchet ' s son lives in. The balance of the property which also has an existing residence on it will continue to be used as pasture. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be approved for the following reasons : 1. The request is in compliance with the intent clause of the recorded exemption procedure (Section 9-2, Weld County Sub- division Regulations) , the intent clause of the Agricultural Zone District (Section 3. 3 A. of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that each parcel does have an existing set of improvements located on it . The Department of Planning Services staff recommendation for approval is conditional upon Mrs. Sarchet ' s son receiving approval of a zoning permit for a mobile home as a principal dwelling on the 10 acre parcel prior to making application for the recorded exemption . One of these reasons is financial. If my son, Rodney, can buy this ten (10) acres he will make a yearly payment to me which will help me meet a payment I have to the Federal Land Bank. We lost my husband, Wayne, on March 10, 1977 This leads me to my second reason. Because our income was from cattle, I cannot handle the physical work. My son has been living here on this residence and helping me. Of course, he makes his living elsewhere, but he is able to help when it is needed. I am trying to keep our land and make a living for myself and college age daughter, Susan. I have another two hundred (200) acres of pasture and part of our cattle herd. I also work as a teachers aide in the Platteville Elementary School. The area I'm asking to sell includes an established residence of ten (10) years. It has its own sewer system but has always been on our one well. I already have a permit for a deep well, so that can be remedied, but the shallow well we now have supplies both households adequately. This seventy (70) acres is considered dry land, and is all pasture. However, we also have three (3) shares of water with which we fill a pond for cattle and ditch irrigate the pasture as much as possible. Thank you for your consideration.
