RESOLUTION
RE: VACATION, ABANDONMENT AND CLOSING OF A PORTION OF
OLD U. S, HIGHWAY NO, 85 IN A PART OF THE SOUTHWEST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 26,
TOWNSHIP 8-NORTH, RANGE 66 WEST OF THE 6th P. M. , WELD
COUNTY,, COLORADO.
WHEREAS, Sam Matsuda, has presented a petition to the Board of
County Commissioners, Weld County, Colorado, requesting that a portion
of old U. S. Highway No. 85 located in the Southwest Quarter of the South-
west Quarter of Section 26, Township 8 North, Range 66 West of the 6th
P. M. , Weld County, Colorado, be abandoned, vacated and closed, said
portion of said old U. S. Highway No. 85 being contiguous to property owned
by the aforementioned petitioner, and said portion of road being more par-
ticularly described as follows, to-wit:
Part of the Southwest Quarter (SW.1) of the Southwest Quarter
(SW1) of Section 26, Township 8 North, Range 66 West of the
6th P. M. , Weld County, Colorado, being more particularly
described as follows:
Beginning at the Southwest Corner (SW Cor) of said Section
26, and considering the South Line of the Southwest Quarter
(SW,'—) of said Section 26, as bearing North 88°19' East, with
all other bearings contained herein relative thereto;
Thence North 88°19' East; along said South Line, 1262. 81
feet to the West ROW Line of U. S. Highway No. 85.
Thence North 16°49' West, along said ROW Line, 1246. 65 feet;
Thence South 88°19' West, 908. 99 feet to a point on the West
Line of the Southwest Quarter (SW j) of said Section 26;
Thence South 00°20' East, along said West Line, 1203. 75 feet
to the Southwest Corner (SW Cor) of said Section 26, also the
Point of Beginning;
Said described parcel of land contains 30. 00 acres, more or
less including a strip of ground 30 feet in width along the
West and South Lines of said Southwest Quarter (SWg) of
said Section 26, reserved for County Road ROW purposes
and is subject to any rights-of-way or other easements as
recorded by instruments of record or as now existing on said
parcel of land, and
WHEREAS, no objections to said petition for the abandonment and
closing of this portion of old U. S. Highway No. 85 have been received in the
office of the Board of County Commissioners, Weld County, Colorado, and
WHEREAS, a portion of said U. S. old Highway No. 85 as hereinabove
described lying within the Southwest Quarter of the Southwest Quarter of
Section 26, Township 8 North, Range 66 West of the 6th P. M. , Weld County,
Colorado, has heretofore been vacated, abandoned and closed by State
Resolution in 1972, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado, believes it to be in the best interest of the public and Weld County
to approve said petition.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the aforementioned portion of

and closed in accordance with the submitted petition; HOWEVER, subject to
any existing rights-of-way and/or easements.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 6th day of August, A.D. ,
1975.

THIS DEED, made this 6th day of August, A. D. , 1975, between
co WELD COUNTY, a municipal corporation and a political subdivision of the
en State of Colorado, by the BOARD OF COUNTY COMMISSIONERS, for the

WITNESSETH, that the said party of the first part, and in consider-
cr. ation of the sum of other valuable considerations and Ten Dollars, to said

o the receipt whereof is hereby confessed and acknowledged, has remised,
released, sold, conveyed and QUIT CLAIMED, and by these presents does
remise, release, sell, convey and QUIT CLAIM unto the said parties of the

Dear Sirs:
I am writing concerning the abandonment of the old U.S.
Highway 85 right-of-way south of Pierce, Colorado back to the
landowner. The property of concern is between U.S. Highway 85
and First Avenue (County Road 33) and north of County Road 88.
It is part of the SW of the SW* of Section 26 Weld County,
Colorado. This old highway curve has been abandoned back to
the county by state resolution in 1972.
I hereby request that Weld County, Colorado officially
abandon by resolution the old U.S. Highway 85 right-of-way
back to the landowner on the property described in the attached
Survey.
