Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman The following business was transacted: . I hereby certify that pursuant to a notice dated December 27, 2018, and duly published January 2, 2019, in the Greeley Tribune, a public hearing was conducted on January 23, 2019 to consider the request of Public Service Company of Colorado, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility for one (1) 230KV transmission line extending approximately 21 miles, one (1) new substation (Graham Creek) and upgrades to an existing substation (Wapa Ault Substation) in the A (Agricultural) Zone District, at which time the Board deemed it advisable to continue the matter to May 22, 2019, to allow the applicant adequate time to meet statutory requirements, work to address concerns and have a Planning Commission hearing. Bob Choate, Assistant County Attorney, made this a matter of record. Commissioner Freeman indicated he has a financial conflict of interest and recused himself from the hearing. a Chris Gathman, Department of Planning Services, noted the applicant had amended the application since the original publishing and stated there will be an updated notice. He explained the applicant is going from a 21 -mile segment to a 10 -mile segment under the USR; however, it has not yet been published. He stated the original proposed date was July 17, 2019, which had conflicts, therefore, he requested a new continuance date to be July 24, 2019. Mr. Choate clarified the Board was previously presented a Second Amended Waiver Agreement, which allowed the applicant to have the continuance to July 17, 2019. Due to scheduling conflicts, Mr. Choate explained he contacted the applicant to change the date to allow for the full Board to be present. Commissioner James moved to continue the request of Public Service Company of Colorado for a Site Specific Development Plan and Use by Special Review Permit, USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility for one (1) 230KV transmission line extending approximately 21 miles, one (1) new substation (Graham Creek) and upgrades to an existing substation (Wapa Ault Substation) in the A (Agricultural) Zone District, to July 24, 2019, at 10:00 a.m., to comply with the terms of the Second Amended Waiver Agreement, approved by Resolution #2019-1827, dated May 13, 2019. The motion was seconded by Commissioner Moreno. Commissioner Conway stated his support of the motion; however, expressed disappointment the applicant was not present. The motion carried unanimously. There being no further discussion, the hearing was completed at 10:58 a.m. This Certification was approved on the 29th day of May, 2019.
