The original request was: A Site -Specific Development Plan and Use by Special Review Permit for Processing and a Use Similar to Uses by Special Review in the A (Agricultural) Zone District as long as the Use complies with the general intent of the A (Agricultural) Zone District (Hemp Processing, Storage and Distribution of extracted raw oil) in the Agricultural Zone District. The proposed modification to the request addresses the expanded uses associated with the business. A Site -Specific Development Plan and Use by Special Review Permit for Processing and a Use Similar to Uses by Special Review in the A (Agricultural) Zone District as long as the Use complies with the general intent of the A (Agricultural) Zone District (Hemp Processing, Storage and Distribution of extracted raw oil), up to five :5) conex (cargo) containers and up to four (4) enclosed trailers for storage, in the (A) Agricultural Zone District. If the proposed modification is accepted by the Board of County Commissioners, then Planning staff has a modification to Section 22-2-220.B of the Resolution. B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A (Agricultural) Zone District. The new language should read: Citing the Weld County Code, Chapter 23, Article III, Division 1, Section 23-3-40.W provides for a Site Specific Development Plan and Special Review Permit for uses similar to the uses listed above as Uses by Special Review as long as the subject use: Hemp Processing, Storage and Distribution of extracted raw oil complies with the general intent of the A (Agricultural) Zone District. Section 23-4-40.V allows for more than two (2) semi -trailers (four (4) requested) in the A (Agricultural) Zone District not in an approved or recorded subdivision plat of Lots which are part of a map or plan filed prior to the adoption of any regulations controlling subdivisions. Section 23-4-40.BB allows for more than two (2) cargo containers (five (5) requested) as a Use by Special Review in the A (Agricultural) Zone District. Any changes to the application resulting in additional uses by special review need to be listed separately in the notice, so a new notice needs to be published for those uses. The sending out for referrals again is a separate issue. I presume we're talking about sec. 23-3-40.V (semi -trailers for personal storage) and sec. 23-3-4O.BB (more than the number of UBR cargo containers). If that's correct, a new notice would have to go out, for both PC and BOCC hearings. If I'm incorrect, let me know. I'm happy to discuss if you want. On June 13`h we received the attached email stating the CA's office had determined the additional structures to be accessory to the principal use and therefore additional review would not be necessary. Based on this response, we assumed everything had been resolved and the 7/10 BOCC hearing date would be maintained. If we proceed with the additional request for cargo containers and storage trailers, what parts of the process will we need to repeat? How much will this delay the project? Your email from Sunday contradicts what was relayed to us in June. Why are we finding out about this only two days before the hearing? If, for now, only 2 cargo containers and 2 trailers are proposed, can we maintain the 7/10 hearing date? Please let me know so I can discuss our options with the property owners. Either way, they will need to obtain approval for the additional storage structures as they are necessary to the operation of the site. We need an idea of how much we will be delayed if we proceed with the additional request rather than pursuing an amended USR later. The Clerk to the Board's office consulted with the County Attorney's office regarding this modification that was brought to light with the post PC Hearing memorandum approved by your office concerning the request. It is the opinion of the CA's office and CTB that this is a major modification to the advertised request. The question generated now is how set your client, the applicant, is about adjusting their request and whether they understand that 3 it will result in having to go back and repeat some of the process. CTB wasn't planning to set the case for a hearing due to the modification to the advertised request but don't want that decision to be the cause of unnecessary delay if H2S2 LLC just decide to move forward with the application as noticed. Given this direction from the CTB, Weld County is requesting comment from AgPro about the notice concern and timing consequences? Thank you for your timely response. The additional structures will not change the use requested for the site, they simply provide additional storage space to support the requested use as well as the existing agricultural use of the property. All others, including the structure for which we are requesting an early release, are existing or were part of the original request and have already been reviewed. Attached is a scanned copy of the site plan that I submitted with the application along with the original PDF, which is a little clearer since it is not a scan. This site plan can also be found with the original submittal documents that have been uploaded to accela. While there are now additional structures proposed further east on the site, including a storage building for ag equipment and raw material, the cargo containers and semi -trailers for storage of raw material, and the grain bins for seed storage, the building shown in the photo was part of the original request. It can be seen on the site plan just west of the existing greenhouse. I just want to make sure that is clear. Page one of your attachment shows existing site conditions prior to the application and is not the plan for proposed development of the site. I would also like to point out that the uses of the proposed structures, ag equipment and crop storage, are uses by right. However, I understand that the additional cargo containers and semi -trailers beyond the allowed number per legal lot may need additional consideration. I submitted a building permit application for the processing building, shown as under construction in your photo, yesterday afternoon. I also submitted a footing and foundation permit application for this same structure on 4/12. You are correct that there wouldn't be any record of a final permit for this structure but there should be record of pending permits. That being said, our client is in receipt of the notice to stop construction until the final permit is issued. I will discuss these options with our client and get back to you. Kim provided me with some more info. See attached. The first page is what was submitted as part of the application. The second page is what showed up at Planning Commission. The third page is a picture of what looks like a fairly large structure going up that we don't show record of any permits. There are a couple of options. Option No.1 is to route the application back out for referrals to give folks an opportunity to review and comment on the additional structures. After speaking with Kim this can be an expedited referral process so we can retain the BoCC hearing date. Option No. 2 is to pull the additional features off the map and then do a minor amendment following BoCC approval. In either case, I am hesitant to release any building permits until we get to the BoCC. The grain bins will be used for storage of hemp seed. The 75' by 200' building will be used for storage of ag equipment and dried hemp awaiting processing. The cargo containers and semi -trailers will also be used to store dried hemp awaiting processing. We will be editing our drainage report to account for the additional structures.
