CONTAINING 1 ,498 . 31 ACRES MORE OR LESS , Adolph Coors Company SUP-386 :79 :8 PLANNING COMMISSION RECOMMENDATION May 1, 1979 Section C. 1 of the Weld County Mineral Resources Extraction Plan states : "Access to future mineral resource development shall be considered in all land use decisions. In accordance with Colorado Statute, no Weld County governmental authority which has control over zoning shall, by zoning, rezoning, granting a variance, or other official action or inaction, permit the use of any area known to contain a commercial mineral deposit in a manner which would interfere with the present or future extraction of such deposit by an extractor. " It is the opinion of the Planning Commission that in those instances where a parcel of land is underlain by commercial mineral deposits and is zoned in such a manner as to permit the extraction of those resources, the extraction of such resources must be accommodated so long as adequate protection of the health, safety and welfare of the citizens of the area in question is provided. In the current application, it is the opinion of the Planning Commission that the applicant has demonstrated through submitted plans and oral statements that adequate protection of the health, safety and welfare of the area residents will be provided as extraction of the resource and reclamation of the site occurs . In addition, it is the opinion of the Planning Commission that the plans submitted by the applicant serve to substantially mitigate adverse impacts of the proposed operation on surrounding uses . 2. The proposal is in compliance with Section C.4. of the Weld County Mineral Resources Extraction Plan which states : "In all requests for open-cut mining operations, the broad effect of these operations on surface and underground water supplies, and on water distribution and drainage systems shall be taken into account. " It is the opinion of the Planning Commission that the applicant, through submitted plans and oral statements, has : a) Taken into account the effects of the proposed operation on surface water supplies and on water distribution and drainage systems, and b) Has shown that any negative impacts on such supplies and/or systems will be mitigated to the extent feasible. Adolph Coors Company SUP-386 :79 :8 PLANNING COMMISSION RECOMMENDATION May 1, 1979 With reference to underground water supplies, Colorado Statute places jurisdiction over the matter in the Division of Water Resources, State Engineer' s Office. It is thus felt that consideration of factors relating to underground water supplies would be appropriate in the current application. 3 . The proposal is in compliance with Section C. 5 of the Weld County Mineral Resources Extraction Plan which states : "Open-cut mining of coal resources shall be permitted only in non-irrigated agricultural areas . Requests for such operations shall receive favorable consideration only when justified by a detailed extraction and reclamation plans accompanied by economic and environmental impacts statements prepared by recognized experts . " The proposed operation will take place on a non-irrigated agricultural area. It is the opinion of the Planning Commission that the applicant has, in oral statements and in the current application, justified the proposed operation through the information contained in the submitted extraction plans and environmental impact statements . 4. It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Sections 3 .3 (E) (2) and 6.1(3) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses , compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following : A. It is the opinion of the Planning Commission that open-cut mining operations as outlined and controlled in the Operations Standards will minimize impacts on surrounding uses and the area to the greatest extent possible and provide adequate protection of the health, safety and welfare of the inhabitants of the area and the county. Adolph Coors Company SUP-386 :79 :8 PLANNING COMMISSION RECOMMENDATION May 1, 1979 B. The Colorado Division of Mines indicated no conflicts with the request. C. At this meeting there were three members present who heard the request at the April 17 meeting. Mr. Kiefer asked for a clarifi- cation from Russ Anson as to whether this will suffice in regard to voting on the request . Mr. Anson stated that there are only two qualified members who could vote at this meeting because Mr. Suckla cast an abstention vote at the last meeting. After discussion as to why Mr. Suckla had cast an abstention vote, it was decided that he could vote at this meeting. Chuck Watson of Continental Pipeline Company stated that since this has been such an emotional and important issue and also since the opponent is not present at this meeting (the Berger' s) he would prefer to have it continued to the May 15 meeting. At this time additional information will be presented. MOTION (SUP) : Be it therefore resolved to continue the hearing to the May 15 , 1979 Planning Commission meeting. APPLICANT: Adolph Coors Company CASE NUMBER: SUP-386 :79: 8 SUBJECT: Open Cut Mining Permit-Surface Coal Mining LEGAL DESCRIPTION: Pt . Sections 25, 26, 35 abd 36, T3N, R64W LOCATION: Approximately 5 miles north of Keenesburg APPEARANCE: Lyle Busch, Manager of Land Resources DISCUSSION: This application is for surface coal mining which is located in a reasonably shallow deposit and one that lends itself to mine more readily by surface methods because it is more economical and the reclamation is more satisfactory than underground mining. The coal is situated on overburder 40-50 feet on the north side and 150-160 feet on the south side of the site. The coal is in a seam 5-8 feet thick. It is anticipated 11-122 million tons of coal is in the area and the project , is anticipated to last 20-25 years to mine it . Mr. Busch then explained the many steps that were necessary regarding testing, drillings, etc. in preparation for the project . The plan for developing the mining operation could begin as early as July. They would like to obtain permission from the State to begin construction of an access road and have stated to the County that if they would be willing to upgrade the road, Adolph Coors Company would apply an asphalt surface to it . Trucks would being hauling approximately one year from now 24 hours a day at intervals of every 20 minutes . He then showed the Planning Commission the mining and reclamation plans by use of a map presentation . They feel the impacts on the operation will be fairly minimal . There are very few houses in the area. The site would not be readily visible . There being no comments at the time, Tom Honn read the staff ' s recommendation for approval and the Development Standards . Mr. Busch then commented on the Development Standards regarding operating only during daylight hours . He feels there would be too much concentration of traffic in a shorter period of time if they operate only during daylight hours and it would be too costly . Discussion followed regarding the use of irrigation water for ground cover from the Foxhills aquifer and how suitable it would be for grass . There was also discussion regarding the severance tax. Russ Anson suggested that several modifications be made regarding the conditions of the road maintenance program, this being that instead of offering and agreeing to acceptable program of road maintenance with the County Commissioners it' should be proposed. Also that if additional roadways are requested to be dedicated for public use, they should be made a part of the condition . Keavan Starks expressed concern in regard to the traffic generated along County Road 59 . He feels that property owners along County Road 59 should be notified of the traffic volume . MOTION: Be it therefore resolved to recommend approval with the ` modifications as stated by Russ Anson, to eliminate Operation Standard #3 as recommended by the Planning Staff , and to notify property owners ',on County Road 59 between Keenesburg and the mine site of the County 'Commissioners hearing by the Planning Staff . Approval was also recommended based on the staff ' s recommendation. The motion was made by Jim Gilbert and seconded by Fred Otis . A vote of "aye" was cast by Jim Gilbert , Fred Qtis, Frank Suckla, Irma White , Bette Kountz , and Jerry Kiefer. Planning Commission ] utes Page 3 May 1, 1979 APPLICANT: Gary E. He has been operating from a Special Use Permit site 2 miles southwest of the new proposed site and to his knowledge he has not had any concerns from surrounding neighbors expressed to him. There being no questions at this time, Tom Honn read the staff ' s recommendation for approval and the Development Standards . Mrs. White stated that she feels Mr. Simpson had a good business at the other site and does a good job at it . MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the staff' s recommendation. Motion by Irma White, seconded by Frank Suckla. A vote of "aye" was cast by Jim Gilbert , Fred Otis, Frank Suckla, Irma White, Bette Kountz, and Jerry Kiefer. Motion carried. APPLICANT: Phillip W. Kennedy DISCUSSION: Mr. Kennedy desires to create an auto dealiership on 3 acres of property at this particular site. Ther were no questions or comments at this time. Tom Honn then read the staff ' s recommendation for approval of the request . A great deal of discussion followed regarding the highway improvements as requested by the State Highway Department as regards the deceleration and acceleration lanes and the curb and gutter and who is responsible for the development of them. Mr. Kennedy stated he does not feel he should be responsible for the development of the curb and gutter. MOTION: Be it therefore resolved to continue the request to the May 15 , 1979 Planning Commission meeting and prior to that a meeting with the Planning Staff, Mr. Kennedy and the State Highway Department to discuss it further. Input from that meeting will be brought before the Planning Commission on May 15, 1979 . Motion by Jim Gilbert , seconded by Irma White . Malara CASE NUMBER: Z-319 : 79 : 3 SUBJECT: Change of Zone from "A" Agricultural Zone District to "I" Industrial Zone District APPEARANCE: Sam Telep DISCUSSION : This request for a change of zone is on four acres of property which presently has a 50 ' x 300 ' metal building on the property . Potential purchasers of the property would like to use the building to construct recreational vehicles, i .e . , camper-trailers . Tom Honn first read the Planning Commission nutes Page 4 May 1, 1979 staff ' s recommendation for denial of the request . Discussion followed regarding the two meetings of the Fort Lupton Planning Commission . There is some discrepancy as to whether or not they approved or denied this request . Mr. Telep stated that the first meeting which was held was not a public meeting and that the comprehensive plan of Fort Lupton has not been adopted which would be in the jurisdiction of Weld County. Mr. Malara then stated that he does not know what he can with the property now. Mr. Suckla commented that he sees nothing wrong with the proposal and that this is an ideal location for industrial zoning. A great deal of discussion followed regarding Fort Lupton ' s position on the request . Russ Anson then gave the conditions for rezoning as stipulated in the Zoning Resolution. Discussion again followed. MOTION: Be it therefore resolved to continue the hearing to the May 15, 1979 Planning Commission meeting. Prior to this meeting a field trip should be taken individually by members of the Planning Commission to see the site from Brighton to Fort Lupton. It was also requested that someone from Fort Lupton reply to the letter from the Town of Fort Lupton or be present at the May 15, 1979 meeting. The motion was made by Jim Gilbert and seconded by Fred Otis. A vote of "aye" was cast by Jim Gilbert , Fred Otis, Irma White, Bette Kountz and Jerry Kiefer. A vote of "no" was cast by Frank Suckla. This request is on 152 acres of proerty with 16 lots of approximately 1 acre each. The site will be served by Hill-N-Park Sanitation District and Central Weld Water District . They are also proposing to develop the water and drainage system as shown on the plat and also a subsurface drainage system will be developed along with the other improvements . Tom Honn then read the staff ' s recommendation for approval . John Hall of the Weld County Health Department then addressed the Department ' s concern regarding the lagoon and sewage disposal system. At it is presently being operated it is unacceptable. If the problem is corrected as far as the Health Department is concerned, they would have no objection to it . Discussion followed regarding whether or not the correction must be made at this time before the preliminary plat is approved or at the final plat stage. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation. Motion by Fred Otis, seconded by Jim Gilbert . A vote of "aye" was cast by Jim Gilbert , Fred Otis, Frank Suckla, Irma White, Bette Kountz and Jerry Kiefer. Motion carried. There being no further business, the meeting was adjourned. Since the property in question is zoned Agricultural, present and future access to the mineral deposits underlying the property for the purpose of extraction is guaranteed under the provisions of Colorado Statutes and the Weld County Mineral Resources Extraction Plan. The Colorado Revised Statutes state in part : "After July 1 , 1973 , no board of county commissioners , governing body of any city and county, city or town, or other governmental authority which has control over zoning shall, by zoning, rezoning, granting a variance, or other official action or inaction, permit the use of any area known to contain a commercial mineral deposit in a manner which would interfere with the present or future extraction of such deposit by an extractor. " Section C.1 of the Weld County Mineral Resources Extraction Plan states : "Access to future mineral resource development shall be considered in all land use decisions . In accordance with Colorado Statute, no Weld County governmental authority which has control over zoning shall , by zoning, rezoning, granting a variance, or other official action or inaction, permit the use of any area known to contain a coumnercial mineral deposit in a manner which would interfere with the present or future extraction of such deposit by an extractor. " It is the opinion of the Department of Planning Services staff Lhat in those instances where a parcel of land is underlain Adolph Coors Company SUP-386 :79 :8 PLANNING STAFF RECOMMENDATION May 1, 1979 by commercial mineral deposits and is zoned in such a manner as to permit the extraction of those resources, the extraction of such resources must be accommodated so long as adequate protection of the health, safety and welfare of the citizens of the area in question is provided. In the current application, it is the opinion of the staff that the applicant has demonstrated through submitted plans and oral statements that adequate protection of the health, safety and welfare of area residents will be provided as extraction of the resource and reclamation of the site occurs. In addition, it is the opinion of the staff that the plans submitted by the applicant serve to sub- stantially mitigate adverse impacts of the proposed operation on surrounding uses. 2. The proposal is in compliance with Section C.4. of the Weld County Mineral Resources Extraction Plan which states : "In all requests for open-cut mining operations, the broad effect of these operations on surface and underground water supplies, and on water distribution and drainage systems shall be taken into account. " It is the opinion of the staff that the applicant, through submitted plans and oral statements , has : a) Taken into account the effects of the proposed operation on surface water supplies and on water distribution and drainage systems, and b) Has shown that any negative impacts on such supplies and/or systems will be mitigated to the extent feasible. With reference to underground water supplies , Colorado Statute places jurisdiction over the matter in the Division of Water Resources, State Engineer' s Office. It is thus felt that consideration of factors relating to underground water supplies would be inappropriate in the current application. 3 . The proposal is in compliance with Section C. 5 of the Weld County Mineral Resources Extraction Plan which states : "Open-cut mining of coal resources shall be permitted only in non-irrigated agricultural areas. Requests for such operations shall receive favorable consideration only when justified by a detailed extraction and reclamation plans accompanied by economic and environmental impacts statements pre- pared by recognized experts . " Adolph Coors Company SUP-386 :79 :8 PLANNING STAFF RECOMMENDATION May 1, 1979 The proposed operation will take place on a non-irrigated agricultural area. It is the opinion of the Department of Planning Services staff that the applicant has , in oral statements and in the current application, justified the proposed operation through the information contained in the submitted extraction plans and environmental impact statements . 4. It is the opinion of the Department of Planning Services staff that this proposed operation is in compliance with the provisions of Sections 3 .3 (E) (2) and 6. 1(3) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following : A. It is the opinion of the Department of Planning Services staff that open-cut mining operations as outlined and controlled in the Operations Standards will minimize impacts on surrounding uses and the area to the greatest extent possible and provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the county. B. The Colorado Division of Mines indicated no conflicts with the request. C. The Division of Water Resources has no objection so long as the applicant obtains well permits and approval to utilize pit water. D. The Colorado Department of Health indicates no apparent problems with the request. The Department of Planning Services Staff recommendation is conditional upon the following : 1. The applicant shall, prior to approval of the Special Use Permit, offer and agree to an acceptable program of road maintenance with the Weld County Board of County Coiiuuiissioners which will be required to mitigate impacts generated by the coal mining activity. The primary concern appears to be County Road 59 from the north end of Sections 13 and 14, T2N, R64W south to the intersection with County Road 18 and County Road 18 paralleling I-76 west to the interchange. Adolph Coors Company SUP-386 :79 :8 PLANNING STAFF RECOMMENDATION May 1, 1979 Additional roadways to the mine site have been indicated to be private. If additional roadways are requested to be dedicated for public use, they should be incorporated into the requested agreement. A portion of County Road 18 which parallels 1-76 appears to be located within 1-76 ROW for approximately 4 mile. The State Highway Department should be a party to the agreement. 2. The attached Operation Standards being recommended and approved. 3 . On December 13, 1979, Mrs. Sonza Grevillius, of Coors, and I reviewed plans for the upgrading of Roads 18 and 59. The plans are approximately 80% complete. The following points need to be clarified before final approval. 1. Weld County's typical section for this type of roadway is a 12 foot paved lane and 4 foot gravel shoulder. This should be reflected on all cross sections, unless Coors desires to pave a portion of the shoulders. Borrow pits should be shown 18 inches deep. 2. Drainage should be considered at stations 103+00 and 217+50. Station 179+50 indicates an 18 inch culvert. That location drains nearly 2 square miles.Culverts should be sized accordingly. 3. Topography, section line, and proposed alignment should be completed on all sheets. 4. Technical Data for materials as indicated on sheet KM-4-12 is basically correct. However, once the material source is determined the information should be reviewed and specifications adjusted accordingly. It should be indicated all construction will be in accordance with the Colorado State Highway Department Specifications. 5. Right-of-Way questions and alignment need to be resolved for the section north of the dump. 6. Material testing information and pavement design computations should be supplies for review. 7. The profile indicates some areas of cut and fill at which earth work may extend beyond existing right-of-way. Cross Sections should be supplied to determine if construction easements will be required. Drew Scheltinga Engineering Manager mm mtmoRRnDurn WC=17-11k To Tom Honn Date June 29, 1979 COLORADO From Drew Scheltinga Subject: Coors Open Pit Mining S.U.P. This is in regard to your questions about access on Weld County Road 49 verses Weld County Road 59. Weld County Road 49 was designed and built in 1978 based on traffic counts taken that year and projected traffic for a twenty year life. At that time the anticipated number of combination units (tractor-trailer type vehicles) was computed to be 90 per day, per lane. From comments made by Coors the average number of trips they would make per lane, per day, over the twenty year life would be approximately 53. I have reviewed the structural design computations adding Coors increase and found the difference would be approximately one inch of asphalt. Drew Scheltinga Weld County Engineering DLS:sar f JUL 1979 n (' RECEIVED geld County ti Fanning Cornissian ' MEMORAnDUM - WC-11111k To : Chuck Cunliffe Date April 16, 1979 COLORADO From Drew L. Scheltinga, Civil Engineer II Subject: Coors Open Cut Coal Mining S.U.P. The Engineering Department has reviewed the application and would like some clarifications regarding roads. In the fifth (5th) paragraph on page 117 of the Enviromental Document Keensburg Mine Site, Volume I , the following statement is made. "The Ton Mile Tax paid on transporting the coal from the mine to Golden will provide funds to build and maintain the required roads. " Also, on page 105 of the same document the third (3rd) paragraph mentions 4.2 miles of new road to be constructed and 2.5 miles of existing road that will require upgrading. These road improvements are a major undertaking. The following questions should be answered: 1. Who is to construct the 4.2 miles of new road? 2. Who is to acquire new right-of-way over private lands? 3. Who is to maintain the new mileage? 4. Is it to be public or private? 5. Who is to upgrade the existing 2.5 miles of road? If the applicant is to design and construct the required improvements, plans and design should be approved by this office. I would suggest the applicant not to be burdened in design at this time. Approval of the S.U.P. could be even contingent on road design approval by the Engineering Department. Drew L. Dear Mr. Cunliffe, There has been a lot of work put into this proposed plan and the re- habilitation plan for the land that will be disturbed, looks good. There is several things that concern us: In that sandy area, even a car track can lead to some disasterous wind erosion. We believe that there should be some stipulation that there will be an annual inspection of the land to de- termine if an adequate erosion control plan is being carried out. We are also concerned about the adverse impact an operation of this kind will have on the city of Keenesburg, such as pressure on schools, water, roads, etc. This area has some bad feelings towards developments that origin- ally seemed to be o.k. S. DEPARTMENT OF COMMERCE, SINCLAIR WEEKS, SECRETARY EUREA'1 OF PUBLIC ROADS, C. D. CUM-IBS, CO'/MISSIONER I _ 7 - In forecasting traffic for 1975'the following assumptions should be made: - that the Interstate System and impo Cant connecting roads and streets have been constructed; that the rate o'• increase as established by existing records probably will be increased in the future because of the superior highways to be in use and because of changes in use and the development of lands adjacent to the Interstate highways; and that other arterial roads and streets in the traffic corridor of the Interstate highway will have been further developed. Additional statements regarding 1975 traffic forecast are given in Section II in explanation of the entries to be made on Table B, Design Classification. Standards A fundamental standard for design is that there shall be control of access for all sections of the Interstate -System. This and other standards are set forth in the Geometric Standards adopted by the A.A.S.H.0. July 12, 1956, and approved by the Commissioner of Public Roads, July 17, 1956; in Public Roads PPM 20-4 (Revised August 10, 1956); and in the Circular Memorandum to Division Engineers dated August 15, 1956. Additional guides for establishing the designs for work to be estimated are given in Section III. Extent of Plans for Work to be Est1mnted. The detailed estimate of cost for completing the Interstate System is to be made from preliminary plans or final P.S.& E. to the extent these are or can be made available. As a minimum for all other work there should be preliminary layouts of line (and profiles where grading costs are sub- stantial), and of all major structures and interchanges in order that reasonably accurate quantity estimates can be made. The reliability of these preliminary layouts should be verified by an on site review. These data are to be prepared by the State highway departments and shall be retained by them for future reference. See additional explanation in Section VI. Quantities and Unit Costs. Entries on the estimate forms to be •submitted are for overall costs only, without detail of estimated quantities or unit prices . Reasonably accurate quantity estimates are to be developed by the State highway depezimen+-. ` r •4 A POLICY ON FRONTAGE ROADS FOR THE r1AliONAL SYSTEM OF INTERSTATE STATE AI'D. DEF NSE HIGHWAYS ' Dacca-1er 1956 Introduction Section 108(i) of the Federal-Aid Highway Act of 1956 reads as follows: "(1) Standards. - The geometric and construction standards to be adopted for the Interstate System shall be those approved by the Secretary of Commerce in cooperation with the State highway departments. Such standards shall be adequate to accottcoodate the types and volumes of traffic forecast for the year 1975. The right-of-way width of the Interstate System shall be adeauete to permit construction of projects on the Inter- state System up to such standards. The Secretary of Commerce shall apply such standards uniformly throughout the States. Such standards shall be adopted by the Sec.eter- of Commerce in cooperation with the State highway departments as soon as practicable after the enactment of this Act." The Geometric Design Stendsrd.s adopted by the AASHO on July 12, 1956, and approved by the Bureau of Public Roads on July 17, 1956, state that "On rill sections of the Interstate System, access shall be controlled by acquiring access rights outright prior to construction or by the construc- tion of frontage roads. or both." In order to carry out the intent of the Act end apply standards unifozrsly, it is necessary to adopt a uniform policy as to when and where frontage roads are to be provided within the Interstate right-of-way. Some States have in the past followed the general policy of providing a frontage road on each side of a controlled access highway and other States have followed the directly opposite general policy of utilizing their right to control access end constructing controlled access highways without any frontage roads. Obviously the continuation of such oppocing methods of acquiring access control, resulting in large differences in cost of construc- tion end cost of maintenance, cannot be- construed to be a uniform policy. Heretofore early States have been forced into one general policy or another regarding frontage roads because of State legislation which does or does not empower the State highway department to ecouire access rights directly. State legislation varies widely. Sone States have legislation which empowers the Stute highway depertnt to control access on any highway the State declares to be a cor_ ,rolled access highway and needs no other support other than the declaration that the highway is to be access controlled. Some States empower the highway departments to acquire direct access rights from owners of property by purchase. Some St,=.tee authorize State highway departments to develop controlled access highweys but only by means of frontage roads. In a few States the right to control access has been ac- quired through judicial decision which ruled that where a highway is con- structed on new location the adjoining property owners have no inherent right to direct access. f "ESFABLISHEQ X873 D idP3 oriA 742-i November 13, 1979 Mr. Tom Honn Weld County Zoning Administrator Post Office Box 758 Greeley, Colorado 80631 Dear Tom: Enclosed are copies of correspondence to Al Chotvacs, Colorado Highway Department, regarding the upgrading of the I-76 frontage road and Mr. and Mrs. Arnusch concerning the construction of a new driveway at their home on County Road 18. We will design the roadway to a total width of thirty feet, fifteen feet on either side of the existing centerline maintaining the drainage ditches. Base course depth design will be based on recommendations of our soil engineers who are presently conducting soil tests along the entire roadway. Plans will be submitted to your office for approval . Paving of the entire thirty foot surface will be done as soon as weather permits after the hauling of coal begins. If lights from night truck traffic create a problem to south bound traffic on I-76, Coors will erect a glare screen under your supervision at the point where County Road 18 joins your service road. As soon as the roadway design plans are available we will submit them to you for approval and request a "Change Point of Access" since both the east and west access points involve curves. We would therefore like to clarify our plans regarding access to reduce the possibility of misunderstandings arising at a future date. Traffic to the site during the initial stages of development will utilize a private access road crossing under I-76 in Section 8, Township 2 North, Range 63 West, about 2.5 miles northeast of Keenesburg. That route crosses Sections 8, 5, 31 and 30 and provides access to the east side of the proposed project. One of the initial phases of actual construction will be the main access road running south from the mining area until it connects to exist- ing County Road 59 at the northeast corner of Section 14, Township 2 North, Range 64 West. That roadway will be located on private rights-of-way and will be constructed and maintained by the applicant. It is to remain a private access road during the life of the operation and we have agreed with grantors of the right-of-way to remove the road and restore the area to its original condition upon completion of the project. The access route south of the north lines of Sections 13 and 14 follows existing roads 59 and 18,2.5 miles along County rights-of-way to the I-76 interchange. It is probable that this segment of the route will have to be upgraded somewhat to handle the additional traffic generated when coal hauling begins. 1- Mr. Chuck Cunliffe April 27, 1979 Page Two We feel that the State's recent implementation of a mineral severance tax was intended to enable affected Counties to upgrade public roadways such as this so they could handle the increased traffic demands attributable to extraction operations. Revenues generated by the severance tax are substantial , as indicated on the attached table, and for this reason we feel it is more appropriate for the County than for the applicant to assume the responsibility of upgrading and maintaining the ex- isting public roadway. One of the problems that reportedly exists on the present road is that of dust control and we feel it offers an opportunity for cooperation between both the County and the applicant. If the County is agreeable to performing any upgrading of the roadway which may be necessary, we are willing to share the costs of applying dust suppressants which may be needed to provide control until our project is in operation. In addition, as soon as weather permits after we begin hauling coal , we are willing to install an asphalt surface on the public portions of County Roads 59 and 18 being used for hauling from our project. We feel that the division of responsibilities outlined above pro- vides an equitable means of developing access to the proposed site, and we request that the permit be approved based on such an understanding. Sincerely yours, AWTschannen hs Enclosure s1, 404# REVENUE COMPUTATION 1 Tv?„ The proposed mine to be located in Weld County will provide tax' e',r ' revenues from which Weld County will benefit. Some of these ta ,.'' are summarized as follows: Real Estate and Personal Property Tax Real estate taxes generated at this mine site would return about $10,269/yr to the County. The tax revenue from buildings and equipment would provide another $163,654 for the County. Of this total amount, the County Commissioners would receive 40.0870%. Other taxes generated by the mine would go into the State General Fund and a portion would be returned to the county. During the producing years of 1980 and 1981 , 45% of the State Severence Tax will be returned to the local government. Eighty five percent of the local government funds go to the political subdivisions that are impacted and will be used on public facilities. Fifteen percent of the local government funds shall be distributed to the counties and munici- palities on the basis of the number of mining employees residing there. After June 30, 1981 , all funds will go into the State Severance Tax fund. During 1980 Weld County would be elegible to receive $74,860 and in 1981 it would be $66,350. The County would also benefit from other taxes generated by the mine. One of these is in the form of Royalties going to the state. The State Royalty will be not less than 40¢/ton or 12 1/2% of the gross sales price at the first point of sale. Using a gross sales price of $10.46/ton and assuming a reserve of 3,524,000 tons in place in state section 36 the royalty would be about $4.6 million. This will go into the permanent school fund and will be distributed to all school districts within the state. The County will also benefit from its portion of the State Income Tax and State Sales Tax from equipment purchased for the mine. These monies go into the state general fund and are disbursed back to the counties according to the School Finance Act. The percentage returned is a function of the number of students and the amount of tax base in the particular district. Weld County would also benefit from additional personal property and real estate taxes on increased employee property. The annual payroll of $765,000 (about $21 ,800 per employee) would increase the amount of sales tax going into the general fund. Increased sales would also benefit the County and the surrounding municipalities. The County will also receive money back from the highway user tax. The highway user tax fund is separate from the general fund and distribution is determined by the highway department, 35% of this fund is returned to the counties and the amount given to each county is a function of the miles of highway and total registrations within the county. f it 1 Jly® 1iMl,j ' y yN AN f .,.., -..-z= —•v l„' i'=,,a BG "' t._Wit!
