OUTLOT AND AN OPEN SPACE EASEMENT - LAWRENCE AND JACQUELYN BEBO
A public hearing was conducted on January 30, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated January 8, 2019, and duly published
January 11, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request
of Lawrence and Jacquelyn Bebo, for A Planned Unit Development Final Plan, PUDF18-0007, for
nine (9) Residential lots with E (Estate) Zone Uses, one (1) Agricultural Outlot and an open space
easement. Frank Haug, Assistant County Attorney, made this a matter of record.
El Chair Kirkmeyer reviewed for the applicant and the public, the procedures to follow should
this case result in a tie vote due to four (4) Commissioners being present and
Commissioner Conway excused.
Chris Gathman, Department of Planning Services, provided background of the case and
stated it was originally approved as a PUD Change of Zone, and at that time the Board approved
it as a Specific Development Guide, allowing the Final Plan to be reviewed by staff. Mr. Gathman
explained the Department of Planning Services was not able to approve it because the applicant
requested revisions to the internal roads. He stated after the Board of County Commissioners
hearing was scheduled, staff conversed with the applicant, agreed on a road cross section, and
discussed common open space. He explained the Department of Planning Services is prepared
to move forward with the hearing, or the Board can refer it back to staff to approve administratively.
el In response to Chair Kirkmeyer, Kent Bruxvoort, applicant's representative, confirmed the
presentation made by staff is accurate and he is comfortable with the case being referred back to
staff. Frank Haug, Assistant County Attorney, clarified the reason the case was presented today
is because it had been noticed.

No public testimony was offered concerning this matter.
O Commissioner Moreno moved to refer back to the Department of Planning Staff the request
of Lawrence and Jacquelyn Bebo for a Planned Unit Development Final Plan, PUDF18-0007, for
nine (9) Residential lots with E (Estate) Zone Uses, one (1) Agricultural Outlot and an open space
easement, based on the recommendations of Planning staff. The motion was seconded by
Commissioner James , and it carried unanimously. There being no further discussion, the hearing
was completed at 10:14 a.m.
This Certification was approved on the 4th day of February, 2019.
