By the Cosrniseion: - This. procesding arises upon the application-of the Board of County Commissioners of held County, 'Colorafo, - in compliance with section. 29 of the Public Utilities Act as amended April 16, 19171 for the opening . of a public highway crossing at grade over the right-of-wsy and track of the Chicago, Burlington & Quincy Railroad Company between Hudson and goons- burg, Colorado, at a point on the section lino between sections 29 and 30; Township 2 North, Rango 64 Went of the sixth Principal Meridian. The application, dated March 14, 1924, and received by the Cacmiesion Parch 17, 1924, was referred to Ur. E. E. :"hittei, General So- licitor for the respondent railroad, for.an expression of its attitude in the matter. Upon March 28, 1924, an answer from the attorneys for the railroad to the matters set forth in the application was received by the Commission and three days later an amended answer was filed stating the - disposition of the railroad- to oppose' the establishment of a grade cross- • lug at the point on the section lino, but assenting to the utilization, as -1 / c/7C,• I/ . a3 -S oZ 0 a cubcsay, of a masonry culvert about one half mile west of the proposed location. The Board of County Coemissioners of Weld County, requested a hearing in the matter, stating that they did not favor the subway on account of the drainage problem involved. • On June 11, 1824, a party composed of C. A. Hewitt and P. L. • Powers, County Commissioners of Veld County; C. t9. Charleston and II. A. Aalborg, FFginoers and P. Herigetad, Roadmastor for the Railroad; L. L. Stimson, an igineor from Greeley employed by tleld County; and W. L. Rey— nolds, Railway and Hydraulic Engineer for this Conanission, made an inspec— tion of the two sites and the adjacent features. lir. Reynolds made a re— port on conditions as they appeared to him stating that the culvert lacked sufficient headroom, that the connecting roadway on the south would be ex- pensive and that facilities for draining the subway wore not favorable, ex- pressing an opinion that the grade crossing as proposed in the application had bettor merit. Copies of this report wore sent to both the County Com- missioners and the railroad and on July 21, 1914, a letter from J. H. Bar- wise, Attorney for the railroad, was received waiving its contention for a subway crossing and consenting to the grade crossing on the section line, under the usual terms of division of cost. An agreement havinv been reached as to location and divi- sion of cost and it appearing that public convenience and necessity require the establishment of the crossing as set forth in the application, the Can- mission will, therefore, Jesus its order granting the request of the appli- cant under the conditions es Ii,rein set forth. Although it deed not appear that a crossing at this location will be used for min htgbvay travel, it will no doubt accommodate a considerable area south of the railroad going to and from Greeley by a. • north and noutli highway opened on this section line. A movement is also under tee to move the rain D. L. D. highway to the north side of the Chicago, Burlington and Quincy Railroad right of gray, from Hudson to Xleggins and thie ' ' crossing would offer a mans of connecting the area south of the railroad with thie.highvaty. • In the amended answer by the eallroad to this application, the utilisation of an existing double barreled stone culvert about one half mile West of- the section litre location Is proposed in substitution for a crossing at grade. The party-eestorday inspected this ouivertand find it to be a --- -- substantial Masonry structure having tee openings each twelve feet wide'anti with ten foot vertical clearance between floor anti roof. The material for the • construction of the fill over the culvert was obtained to a large extent by "borrow" along the right of way and this removal of earth has reunited in the • , formation of depressions Which non retain rater on each side of the culvert. There to little fall to the small creek channel which presses through the culvert and my estimate is that if a substantial and firm road way wore built through this structure there would •be only about eight and one half feet of vertical clearance between road tnj and roof. It So to be regretted that advantage of.such an existing -facility for a crossing oan not be employed, but in view of the low clearance of the structure which would prohibit its use for bay hauling and large trucks and the expense of installing a long lino of sub- drainage and an adequate road way as well as a half mile of connecting right of ray and road on the south side of the railway, it appears that the grade cross. ' ing ac set forth in the petition hap rare merit.• ` • er/ tick/ • .33 '0' 7 0 • The proposed grade crossing falls on a long tangent of the railroad and on a fill about six feet above the adjacent natural ground surface whore the view from all angles is unobstructed. Approaches on the roadway will be rather long in embankment to comply with the Commissions specification of forty feet of level roadway with a maximum of six percent grade approaching, but the Commissioners of Weld County are willing to stand the grading expense as is usual in the division of cost of new crossings. • As a step in promoting an amicable settlement of this matter without a formal hearing, I propose that a cony of this letter to you be forwarded to both the Commissioners of Wend County and to the Chicago; Burlington and Quincy Railroad, through its attorney Mr..Bariaise. _ _ Respectfully submitted, (Signed) .
