HomeMy WebLinkAbout20193001.tiffHEARING CERTIFICATION DOCKET NO. 2019-80 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0018, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT, OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - LAURA GRANADOS A public hearing was conducted on July 24, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated May 14, 2019, and duly published May 17, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Laura Granados, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0018, for one (1) Single -Family Dwelling Unit per lot, other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal and indicated the parcel is zoned A (Agricultural) and is not located in a subdivision. He explained there is an active zoning violation on the property, due to the presence of a second dwelling unit. without necessary permits. He stated there had been no correspondence received from surrounding property owners (SPO) and of 12 referrals sent out, eight (8) agencies responded. He indicated the site is located within the three (3) mile referral area of the City of Fort Lupton, and displayed and described a map of the site and surrounding views. Mr. Nader described surrounding USRs, indicated the site layout will remain the same, entered the favorable recommendation of the Planning Commission into the record as written, and presented images of the site and surrounding views. Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements, and stated the access is on County Road (CR) 18. He indicated the site meets an exception for drainage for the second dwelling unit. CC;. PUmu Iiel, PWLf.PIE.lt(La.> 2019-3001 PL2683 HEARING CERTIFICATION - LAURA GRANADOS (USR19-0018) PAGE 2 rtm I Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and stated water will be provided through a shared domestic well, which has been repermitted for two (2) residences, therefore, Condition of Approval (COA) #1.A (well permit) had been completed. She explained the existing septic system had been permitted for three (3) bedrooms and the septic system permitted for a kennel had been deemed acceptable for two (2) bedrooms. She indicated Development Standards (DS) #7 and 8 (water and sewer) address Environmental Health items. Diana Granados, represented the applicant and explained the use of the second single-family dwelling unit for visiting family members. In response to Chair Kirkmeyer, Ms. Diana Granados stated the second dwelling is not used year round. No public testimony was offered concerning this matter. fra In response to Chair Kirkmeyer, Ms. Granados indicated there were no concerns or proposed changes to the Conditions of Approval and Development Standards, as presented. Chair Kirkmeyer reiterated to delete COA #1.A, due to it already being met. The Board and staff agreed to delete DS #4 (off -site tracking). In response to Chair Kirkmeyer, Ms. Granados indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. There was no public testimony offered concerning the changes to the Conditions of Approval and Development Standards. Commissioner Conway moved to approve the request of Laura Granados for a Site Specific Development Plan and Use by Special Review Permit, USR19-0018, for one (1) Single -Family Dwelling Unit per lot, other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously.
