HEARING CERTIFICATION DOCKET NO. 2019-30 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0105, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY INCLUDING OPEN PIT MINING (OVERBURDEN, SAND GRAVEL AND STONE) AND MATERIALS PROCESSING IN THE A (AGRICULTURAL) ZONE DISTRICT — HUNT WATER, LLC A public hearing was conducted on March 27, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated January 28, 2019, and duly published February 1, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Hunt Water, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0105, for a Mineral Resource Development Facility including Open Pit Mining (overburden, sand gravel and stone) and Materials Processing in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and noted the site is within the three (3) mile referral areas of the Towns of Gilcrest, Milliken, and Platteville. He explained the surrounding uses, included there are eight (8) surrounding property owners (SPO), and mentioned no correspondence was received from the SPOs. He displayed images of the 139.2 -acre permit boundary, and mentioned the mine will support wet and dry mining operations and stockpiling of material, and all mineral product will be transported by a scraper or front-end loader to processing or stockpile areas. He provided the daily roundtrip counts and stated there will be 12 employees onsite during full mining and processing operations. Mr. Ogle described the primary, post mining use, will be a water resource reservoir. He stated 14 referrals were sent out, six (6) agencies responded, and he entered the favorable recommendation of the Planning Commission into the record as written. Hayley Balzano, Department of Public Works, provided a brief overview of the transportation plans and requirements, stated access to the site is off of County Road (CR) 36, and the Department of Public Works is requesting the access be moved to line up with an oil and gas C.C PLCtcO/TP), Ptu(He),Er-1ci3F) o5iOCof19 2019-1082 PL2646 HEARING CERTIFICATION - HUNT WATER, LLC (USR18-0105) PAGE 2 access on the south side of the road. She provided daily trip counts and average speeds, mentioned an Improvements Agreement (IA) and Road Maintenance Agreement (RMA) for future off -site improvements is required, and stated the site meets a drainage exception for gravel pits. In response to Chair Kirkmeyer, Ms. Balzano explained there is a proposed access onto State Highway 60, at the north-east corner of the property. • Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and noted bottled water and portable toilets are acceptable. He stated there will be no fuel storage or washing of vehicles on the site, noise is restricted to the Industrial limit, and Development Standards (DS) #3 thru #15 address Environmental Health items. He suggested adding language to DS #10 to address the screening of portable toilets. • Andrew Rodriguez, Civil Resources, represented the applicant and shared a PowerPoint presentation showing project location, pictures of surrounding areas, company overview, project description, mining plan, and reclamation plan. In response to Commissioner Moreno, Mr. Rodriguez clarified the depth of bedrock in the broadway alluvium. In response to Commissioner James, Mr. Rodriguez explained the operational plan on the east and west side of the site. • No public testimony was offered concerning this matter. • In response to Chair Kirkmeyer, Mr. Rodriguez displayed an image of the access on the east side of U.S. Highway 85 on CR 36. In response to Commissioner Conway, Mr. Rodriguez explained the customer base and specifics of the reclamation plan, including the timeframe. In response to Chair Kirkmeyer about the acreage on the east side of U.S. Highway 85, he indicated there are 20 acres within the permit boundary, 14-16 acres of disturbed land, and stated mining should be complete in one (1) to two (2) years. Chair Kirkmeyer informed Mr. Rodriguez that CR 36 is, at some point, slated to close according to the Highway 85 Access Control Plan. • Chair Kirkmeyer suggested deleting Condition of Approval (COA) #1.B (IA and RMA) due to limited activity on CR 36, and COA #1.A (vacation of USR-975) because it was complete. The Board was agreeable. She also suggested, and the Board agreed, to add a new DS #3 (eventual closure of CR 36), and delete DS #8 (Industrial noise level). Ms. Balzano suggested deleting the second sentence in COA #2.A (tracking control options), and the Board agreed. Per Mr. Frissell's previous request, Chair Kirkmeyer suggested adding language to DS #10 regarding portable toilet screening. She suggested changing the language in DS #17 from "the public road" to "County Road 36", deleting DS #20 (IA), and deleting DS #21 (IA review schedule), and adding language to DS #26 about operating during a declared State of Emergency, and the Board agreed to all of the changes. David Hunt, applicant, asked if it was acceptable to have domestic water and sewer service for the veterinary clinic, and Mr. Frissell clarified the DS requirements. • In response to Chair Kirkmeyer, Mr. Rodriguez indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. 2019-1082 PL2646 HEARING CERTIFICATION - HUNT WATER, LLC (USR18-0105) PAGE 3 Commissioner Conway moved to approve the request of Hunt Water, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0105, for a Mineral Resource Development Facility including Open Pit Mining (overburden, sand gravel and stone) and Materials Processing in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously.
