RE: CONSIDER CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING
VIOLATION PENALTIES AS SPECIAL ASSESSMENT - GRACIELA QUINONEZ AND
VERONICA GUTIERREZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services,
filed a complaint in the Weld County Court against Defendants Graciela Quinonez and
Veronica Gutierrez, claiming that Defendants' property is in violation of the Weld County Code,
and
WHEREAS, the County Court found the Defendants property to be in violation of the Weld
County Code, and
WHEREAS, Defendants failed to bring the property into compliance with the Weld County
Code, and upon Weld County's motion, the County Court ordered Defendants to pay $10.00 per
day that the property remained in violation of the Weld County Code, beginning on May 8, 2018,
and
WHEREAS, C.R.S. §30-28-124.5(1) and Weld County Code Section 23-10-40.A allow
these costs to be assessed against the property and collected as a special assessment by the
Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, hereby approves the Certification of $3,340.00 to the Weld County Treasurer
to be collected as a special assessment for the daily violation penalties from July 2, 2018, through
May 31, 2019.

To Whom It May Concern:
This letter is being sent as a courtesy to remind you that the Division C Magistrate ordered a daily penalty of
$10 on April 9, 2018 but to stay them until May 7, 2018 daily penalties are currently accruing. On May 7,
2018 the Magistrate ordered a financial penalty of $25.00 and the $230.00 that had already begun to accrue.
In addition to any previously assessed penalties, as of the date of this letter, the penalty accrued has
reached an additional $2870 (May 8, 2018 — February 19, 2019 = 287 days x $10 daily).
To bring the property into compliance, the following actions shall occur:
1.) Permit applications for all Ag-Exempt structures shall be submitted, and then issued. Structures
must meet setback requirements prior to finalization of the permits (this permit application do not have a
fee associated with it). OR
2.) The Ag-Exempt structures can be demolished and all debris removed from the site (this would
require a demolition permit).
3.) You shall contact my office as soon as you feel you have brought the property into compliance with
items 1 & 2 above. Until such time the daily penalty shall continue to accrue in accordance with the
court order (17C-037227).
Compliance records are now visible to the public through the Citizen Access portal through our web page.
