A public hearing was conducted on July 24, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
F I hereby certify that pursuant to a notice dated December 27, 2018, and duly published
January 2, 2019, in the Greeley Tribune, a public hearing was conducted on January 23, 2019,
to consider the request of Public Service Company of Colorado, for a Site Specific Development
Plan and Use by Special Review Permit, USR18-0100, for a 1041 Permit for a Major Facility of a
Public Utility for one (1) 230KV transmission line extending approximately 21 miles, one (1) new
substation (Graham Creek) and upgrades to an existing substation (Wapa Ault Substation) in the
A (Agricultural) Zone District, at which time the Board deemed it advisable to continue the matter
to May 22, 2019, to allow the applicant adequate time to meet statutory requirements, work to
address concerns and have a Planning Commission hearing. On May 22, 2019, the matter was
continued to July 24, 2019, to comply with the terms of the Second Amendment Waiver
Agreement. Bob Choate, Assistant County Attorney, made this a matter of record.
F Commissioner Freeman recused himself due to a conflict of interest.
F Chris Gathman, Department of Planning Services, explained the applicant was requesting a
withdrawal of the application to allow for additional public and stakeholder outreach on the overall
project, review additional transmission line route options, and consider substation site
alternatives.
F Larry Claxton, Xcel Energy, represented the applicant and reiterated the request to withdraw
the application to provide additional time to preform further outreach with landowners and
stakeholders to consider other alternatives for the project. He explained, once ready, the applicant
will resubmit their application.

El Commissioner Conway moved to accept the request of Public Service Company of Colorado
to withdraw the application for a Site Specific Development Plan and Use by Special Review
Permit, USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility for one (1) 230KV
transmission line extending approximately 10.4 miles, one (1) new substation (Graham Creek)
and upgrades to an existing substation (Wapa Ault Substation) in the A (Agricultural) Zone District.
The motion was seconded by Commissioner James, and it carried unanimously. There being no
further discussion, the hearing was completed at 10:09 a.m.
This Certification was approved on the 29th day of July, 2019.
