Berg (Berg Feed Lots) Route 2, Box 328, Greeley, Colorado, requesting permission for expansion of an existing cattle feed lot operation on the following described property, to-wit: A parcel of land located in the Southeast Quarter (SE 4) of Section 15, Township 6 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, and being more particularly described as follows: Commencing at the Northeast Corner (NECor) of said Section 15 and considering the North line of said Section 15 to bear North 90°00'00" West and with all other bearings described herein relative thereto: Thence North 90°00'00" West along the North line of said Section 15, 1, 892. 09 feet; Thence South 00°00'00" West 3, 836. 26 feet to the True Point of Beginning. Thence North 89°37'20" West 150. 00 feet; Thence South 00°22'40" East 673. 00 feet; Thence South 89°37'20" East 150. 00 feet; Thence North 00°22'40" West 673. 00 feet to the True Point of Beginning. Said parcel of land containing 2. 31 acres,more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the expansion of said feed lot operation, and WHEREAS, the said requested feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (3) (c) of the Zoning Resolution of Weld County, said feed lot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Raymond A. Berg (Berg Feed Lots) Route 2, Box 328, Greeley, Colorado, for expansion of an existing cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said cattle feed lot operation and shall have up to one (1) year from date hereof to begin such construction. 3. THE WELD COUNTY PLANNING COMMISSION STAFF RECOMMENDS THAT THIS REQUEST BE Approved FOR THE FOLLOWING REASONS : (1 ) Complies with the Weld County Comprehensive Plan's resource management policy that "the expansion of agri-business and industry will be encour- aged." (2) Referral agencies have no objections (see attached communications with Soil Conservation Service, Cache la Poudre Irrigation Company, State Highway Department, Weld County Environment Health Services. ) Conditions: (1 ) That the maximum number of cattle be limited to 3700. Letter from SCS, dated August 13, 1975, states that holding ponds would be necessary to divert runoff to the I canal . A follow-up letter dated October18, 1975, states adequate ponds had been constructed. A telephone conversation with the Cache la Poudre Irrigation Co. indicated there would be no problems with irrigation ditch. Colorado Dept. of Highways has no objections as long as drainage is properly designed. The County Engineer stated there are no access problems. Mr. Berg stated that the lagoon has been on the property for a year. It is indicated on the plot plan. Letter from Arthur E. Hawkridge was read into record. Mr. Fortner stated that the Regulations state that such operation may not be located within 660 feet of adjacent residences without written consent of the owners. Two residences are in question in this case. He pointed out that although both residents 1210 1 t had signed petition, they had since telephoned and expressed some concerns over the location of the lagoon. Condition ;:a, as set forth by the Planning staff, should be removed. Mr. Berg stated that he has a discharge permit from the EPA if there is ever an "above ten-year average" rain. Mr. Paul stated that he had no objections. Joe Intermill lives directly south (across the road) of the lagoon. He pointed out that lagoons in this urea have been neglected. It was his opinion that lagoons are a great source of flies and odor, and there are no restrictions in the regulations as to where these can be located. He asked that if this request is granted it be granted with the condition that any future lagoons would not be built any closer than the present facility. He pointed out that there is a possibility that a future owner could want to enlarge the number of cattle. Mr. Tom Connell stated that the Planning Commission could restrict the size of the pens being built but, in his opinion , it cannot restrict the number of cattle. RESOLUTION: Be it therefore resolved to recommend approval of SUP #292, a cattle feedlot expansion, to the Board of County Commissioners subject to staff recommendations , with the exception of condition #4. Sekich Equipment Co. also sells and services Farmhand Equipment, White Industrial Equipment, Myer Equipment, etc. Was first advised of violation to the original C-UD by a letter from Tom Honn, on August 18, 1975, which they responded to on August 21 , 1975. , Sekich 's do have a license from State of Colorado to operate a food establishment. Restaurant is intact within the original boundary of the outer walls of the building. A building permit was obtained for the structure.
