HEARING CERTIFICATION DOCKET NO. 2019-108.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0035, FOR AGRICULTURAL SERVICE ESTABLISHMENTS PRIMARILY ENGAGED IN PERFORMING AGRICULTURAL, ANIMAL HUSBANDRY OR HORTICULTURAL SERVICES ON A FEE OR CONTRACT BASIS, INCLUDING: VETERINARY CLINICS OR HOSPITALS AND AN ADDITIONAL BUILDING MOUNTED SIGN IN THE A (AGRICULTURAL) ZONE DISTRICT - DVM BURROS, LLC A public hearing was conducted on October 16, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 2, 2019, and duly published August 7, 2019, in the Greeley Tribune, a public hearing was conducted on September 4, 2019, to consider the request of DVM Burros, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0035, for agricultural service establishments primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including: Veterinary Clinics or hospitals and an additional building mounted sign in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. ;El Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and stated 16 referrals were sent out and ten (10) agencies responded. She provided the number of employees and the hours of operation, and described the parking, the rescue component of the operation, and proposed fencing, screening, and signage. She outlined the uses of each lot in the Bohrer Planned Unit Development (PUD) and mentioned the applicant would like to use the existing oil and gas access. Chair Kirkmeyer explained there cannot be a Use by Special Review (USR) in a PUD. Mr. Choate agreed and suggested, per the recommendation of Bruce Barker, County Attorney, the Board take no action on the matter. c -c-,. PLC pc.. TP), Pw(EP).£H(LL) 2019-3903 PL2698 HEARING CERTIFICATION - DVM BURROS, LLC (USR19-0033) PAGE 2 Commissioner Conway recused himself after realizing he was not present at the previous hearing on September 4, 2019. • Commissioner James agreed with Mr. Choate and there was further discussion about how to move forward. • Sheri Lockman, Lockman Land Consulting, provided the history of the application and discussed options for the site and future use of the oil and gas access road. IE Chair Kirkmeyer suggested the applicant apply to amend the PUD zone and indicated they will need the support of everyone who resides in the PUD. She explained the neighboring oil and gas operation is a Use by Right in the A (Agricultural) Zone District and affirmed the oil and gas access road was not the current matter before the Board. She suggested the applicant send an email to the Board with a request for them to review the permissions of the use of the access road. She also suggested the applicant send an email requesting the Board consider refunding the fees assessed during the application process and stated she would be in support of such request. El Commissioner James expressed he would also be in support of such request, and Commissioner Freeman agreed with his fellow Commissioners. • Ms. Aungst stated Planning Staff had met with the applicant and provided options for the site, including amending the Final Plan. There was discussion about amending the uses of the PUD, and in response to Commissioner James, Chair Kirkmeyer reiterated the Board can approve an amendment to the uses of the PUD, but all members of the PUD have to be in agreement. Natalie Malherbe, applicant, asked for clarification about using the oil and gas access, versus the internal road system in the PUD, and Chair Kirkmeyer explained the applicant would have to apply for a Change of Zone, in the process of amending the PUD, in order to use the oil and gas access road. • Commissioner Moreno moved to take no action on the request of DVM Burros, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0035, for agricultural service establishments primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including: Veterinary Clinics or hospitals and an additional building mounted sign in the A (Agricultural) Zone District. The motion was seconded by Commissioner James, and it carried unanimously.
