RE: LOT SIZE VARIANCE - ROGER VERQUER
WHEREAS, at a Public Hearing held in the Chambers of the
Board of County Commissioners , Weld County, Colorado, by the •
Board of County Commissioners, on the 27th day of September,
1976, the Board of County Commissioners did hear the ap-
plication of Roger Verquer for a lot size variance from the
minimum lot size requirement of the Weld County Zoning Reso-
lution, and
WHEREAS, Section 9-4A(6) of the Weld County Subdivision
Regulations requires that a lot size variance be obtained
before a recorded exemption is granted to an applicant, if
the original lot is less than the applicable minimum lot size
requirements of the Weld County Zoning Resolution, and
WHEREAS, the Board of County Commissioners, Weld County
Colorado, having heard the testimony of those present, and
having considered the recommendations of the Planning Com-
mission staff, finds that the applicant has not shown good
cause for granting a lot size variance under Section 9-4A(6)
of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the application of Roger Verquer for a lot
size variance on a parcel of land described as part of the
Northeast Quarter of Section 12 , Township 4 North, Range 65
West of the 6th P.M. , Weld County, Colorado, being more particu-
larly described as follows :
Beginning at the Fast Quarter corner of said Section 12, thence along the East line of the
Northeast Quarter of said Section 12 North 1°11 '30" West 303.75 feet; thence North 88°25'47"
West 1186.82 feet to the true point of beginning; thence North 1032. 14 feet; thence East
878. 26 feet more or less to the Westerly line of that certain parcel of land described in
Deed recorded in Book 599, Reception No. 1520549, records of said County; thence along
said Westerly line South 8°02'48" East 133. 18 feet; thence South 8°35' 15" West 931 .48
feet to a line that hears North 82°25' 47" West
; thence North 83°25' 47" West 758. 10 feet more or less to the true point of beginning .
EXCEPTING therefrom that certain parcel of land described in Deed recorded in Book 429,
Page 75, records of said County.
Above-described parcel including exception contains 20.00 acres more or less.
Excepting and reserving an easement of 30. 00 feet in width along the South 30.00 feet of
the above-described property for the use of the Grantors their heirs, personal repre-
sentatives and assigns for use for roadway purposes, and underground utilities.

Dear Commissioners:
The attached letter and related items are in reference to a request by
Roger Verquer for a lot size variance and a recorded exemption. The
parcel of land is described as part of the NE4 of Sec. 12, T4N, R65W
of the 6th P.M. , Weld County, Colorado. Said property is located five
miles east and one mile south of LaSalle. The subject property contains 20
acres of Class IV soils. These soils are classified as prime agricultural
soils by the Soil Conservation Service. The request is to split the pro-
perty into parcels of 3.5 acres and 16.5 acres. Currently there is one
existing set of improvements on the proposed 3.5 acre parcel ; there are no
improvements on the proposed 16.5 acre parcel . The stated intent is to
get approval for splitting the property and then sell both parcels as sep-
arate lots. Within a five mile radius of the subject property there have
been 26 recorded exemptions approved since the adoption of the Recorded
Exemption proceedure by the Board of County Commissioners. A copy of a
map showing the locations of these recorded exemptions is included in the
attached packet. Based upon the information submitted, the above data,
and the adopted policies in the County, the Planning Commission staff re-
commends denial for the following reasons:
1 . The proposed split does not comply with the Weld County Comprehensive
Plan because it would promote non-agricultural use of agricultural land
and it would encourage urban encroachment on rural land use.
2. The recorded exemption request is not in conformance with the intent
clause of the agricultural zone district (Sec. 3.3(a) of the Weld County
Zoning Resolution) which states:

"Intent - The intent in establishing the A-I agricultural zone
district is to allow all agricultural and related uses in those
areas in which agriculture is and should continue to be the
predominant land use. This district is intended to discourage
encroachment of incompatible uses upon the agricultural land in
the district, to encourage agricultural uses as the highest and
best use of the land in the district as compared with other uses
in conflict therewith, and to provide for the orderly expansion
of urban growth in conformance with the Weld County Comprehensive
Plan."
The request would not be encouraging agricultural uses as the highest
and best uses, it would not be providing for the orderly expansion of
urban growth, and it would be promoting the division of agricultural
lands into smaller, less economic parcel sizes.
3. The recorded exemption request is not in compliance with the intent
clause of the recorded exemption proceedure (Sec. 9-2 of the Weld
County Subdivision Regulations). Said clause states:
"The intent in establishing the recorded exemption proceedure is
to provide, in accordance with the Weld County Comprehensive Plan,
a means whereby non-productive agricultural lands may be developed
for higher or more productive uses, insofar as such uses are com-
patible with surrounding agricultural uses in areas where such land
divisions are proposed. (Rev. 4/17/74)"
The existing 20 acre parcel contains only one set of improvements and is
currently irrigated for the most part. The split would allow for an
extra set of improvements on the 16.5 acre parcel and therefore creates
an urban encroachment which would be non-compatible with the agricultural
district.
4. The minimum lot size in the irrigated agricultural district is 80 acres.
The intent is to maintain large enough tracts for farm purposes, and to
assist in the encouragement of agricultural uses as the highest and best
use of the land. The proposed split is in violation of that intent.

Dear Ken :
Enclosed you will find an application for a recorded exemption
on a piece of property which is a part of the Section 12 , Town-
ship 4 North, Range 65 West. My client , Mr. Roger Verquer, has
been able to sell the full twenty (20) acres along with the im-
provements and receive a fair market value. He consequently has
found a purchaser for a parcel of ground that you will see as
being Lot A on the recorded exemption.
More specifically, his purchasers are desirous of purchasing 32
acres from the total 20 that was sold to Mr. Verquer; and they
are financially able to only purchase those 32 acres.
The remaining 16Z acres will be used primarily for pasture at
this time. However , it is intended by my client that some date ,
the time of which is not presently known, to build another house
on the premises. The house that is presently on the premises
which is on the legal description designated as Lot A on the re-
corded exemption does have a water tap and does have a septic
tank on that legal description. When and if the new house is
built on Lot B there would be supplied both a septic tank and a
water tap.
Enclosed with this letter you will find a letter from the appro-
priate water district indicating that there is presently a water
tap on Lot A and also they will provide, contingent upon the sup-
ply of appropriate funds , a water tap for Lot B. I understand by
my conversation with you that these are the only additional re-
quirements that you would make with regard to my application on
behalf of my client for the recorded exemption.
If there is a misunderstanding or you have already required
additional requirements, please contact me at the letter-
head set out above.

RE: Requests for a variance, a lot size variance, and a recorded exemption
on a parcel of land described as part of the NE 4 of Section 12, T4N,
R65W of the 6th P.M. , Weld County, Colorado.
Dear Mr. Verquer:
Your applications and related materials for the above described requests
are complete with the following exceptions:
1 . Submission of the $15.00 application fee for the variance,
2. Submission of a letter from Central Weld Water District
indicating there is an existing water tap on Lot A of
the proposed recorded exemption.
I have tentatively scheduled the hearing by the Board of Adjustment on the
variance application for September 23, 1976. Provided all goes well , the
hearing by the Board of County Commissioners on the Lot Size Variance and
the Recorded Exemption will be on September 27, 1976.
