ROLL CALL: The following members were present: Nancy Clark, President Bob E. White, Vice President Floyd Oliver, Councilman Robert Martin, Councilman Also present: Commissioner Ed Dunbar; Attorney Robert Ray; Commissioner Leonard Roe; Observer for the League of Women Voters, Bev Brown; 4 members of the press; and the secretary, Beverly Thomas. MINUTES: Bob Martin made a motion that the December 6, 1977 minutes be adopted. Floyd Oliver seconded the motion and it carried unanimously. Bob Martin made an addition as follows to the "Personnel Appeal Procedures" section on page 3 of the December 13, 1977 minutes: Bob White said to Mr. Barrett that if Mr. Barrett did not want to discuss the case of Mr. Richardson in public he would not have to do so. Bob White said that if he would prefer to discuss the matter in private that would be accept- able." Bob White made a motion that the minutes be adopted with the stated addition. Bob Martin seconded the motion and it carried unanimously. CORRESPONDENCE: Nancy Clark read a letter from Tom Dority. She mentioned memos regarding holidays, open house of Centennial Center, new Commissioner coordinators, requests for computer services, and two resolutions from the County Commissioners. REPORTS: HEALTH: Nancy Clark explained that Mr. Oakeson had contacted the Council regarding the Balcolm Chemical Plant. Mrs. Clark said that she would see that the Council 's specific request for him to present his complaint at the January 17, 1978 Council meeting be retracted as this was a city problem. FINANCES: Bob Martin noted that $1627.00 was paid to Cooke, Gilles, and Schaefer for special counsel. OLD BUSINESS : MAY 20TH AUCTION: A partial, written report prepared by Ron Richardson on the May 20, 1977 Auction was presented/ � to each 780945 /Jr , /977-6 //a-Og County Council Min' s ^ Page 2 January 5, 1978 Councilmember. No action was taken regarding the report, as it was partial and for only the Councilmembers' consideration at this time. HIRING OF A PERFORMANCE AUDITOR: A discussion was held regarding who should interview the applicants for performance auditor. Bob White appointed the entire Council to act as an interviewing committee. The time for the interviewing was set for 10 A.M. January 10, 1978 with the details to be arranged through the Personnel Department. EXECUTIVE SESSIONS AND TAPE RECORDINGS: Mr. Ray presented copies of state law regarding public meetings and public records. He point- ed out that state law said that executive session may be employed for " . . . consideration of documents or testimony given in confidence . . . " but no final decisions shall be made at any session which is closed to the general public. Mr. Ray said that a meeting that is first open to the public and then retires to an executive session would appear to best fit the law. Furthermore, testimony from one Councilmember to the rest of the Council would fit the definition of testimony in the law. Nancy Clark thought it would be advisable for each Council meeting to include an executive session to expedite the work of the Council. Bob White said that regular executive sessions were necessary so the Council could consider complaints and allegations brought to it without making every such allegation public before it had been researched. He said that to make eiery allegation public was unreasonable as damage could thereby be done to individuals and agencies. He pointed out that some items keep brewing indefinitely because of the lack of opportunity for them to be discussed amongst the Councilmembers. A member of the press asked Mr. Ray what could be made public before or after an executive session. Mr. Ray said that the Council could tell as much or as little as the Council members wished to tell about matters discussed in executive session. Floyd Oliver made a motion that starting with the next regular meeting, the Council meetings will be open at 9 A.M. for roll call and then the Council shall go into executive session for consideration of documents or testimony given in confidence but not for making policy decisions. At 9:30 A.M. the doors of the meeting will be open for the public meeting. Bob Martin seconded the motion and it passed unanimously. Tape recordings of Council meetings were discussed. Mr. Ray said that public meetings should be recorded in detail as would be done by a court reporter. While tape recordings are not required they are often the most expedient way to meet the standard of thoroughness required. These records are to be maintained on file for three years. It was pointed out that the Council 's budget did not allow for the cost involved in usino as many tape recordings as that would necessitate. The secretary was County Council Mir 3s Pane 3 January 5, 1978 instructed to research the cost of implementing such a procedure. Dub White asked if it would be proper to store the Council meeting tape recordings in the Clerk to the Board's office where they would be more accessible to the public. Mr. Ray said that if the Clerk would be willing to store the recordings that would be fine. They are to be available to the public at reasonable hours and forty hours a week is more reasonable than then the ten hours a week that the Council office is open. ELECTION OF OFFICERS: Nancy Clark opened the meeting for nominations for the 1978 Chairman of the Council. Floyd Oliver nominated Bob White. Bob White nominated Floyd Oliver. Floyd Oliver withdrew his name due to health reasons. Bob White was elected with three yeas and Bob White voting nay. Nancy Clark opened the meeting for nominations for vice- chairman. Floyd Oliver was nomireted by Bob Martin. Bob Martin was nominated by Bob White. Bob White asked that secret ballots be cast. There was a tie vote. Floyd Oliver made a motion that the election of the vice-chairman be delayed until the next meet- ing. Bob Martin seconded the motion and it carried unanimously. JANUARY 17, 1978 MEETING AGENDA: The meeting was turned over to the new chairman. Nancy Clark made a motion that the Council extend an invitation to particular persons and anyone interested in coming to the January 17, 1978 Council meeting at 10 A.M. to voice complaints regarding Weld County government. The announcement shall be made in a press release. Floyd Oliver seconded the motion and it passed unanimously. MISCELLANEOUS: Nancy Clark read a letter of objection from Tom Dority regarding the Council 's "intervention" in a personnel matter. There was discussion regarding the information Mr. Dority received regarding the matter of his objection. Floyd Oliver made a motion that the Council send a copy of the December 13, 1977 corrected minutes to Mr. Dority with a letter explaining what happened at the December 13, 1978 Council meeting regarding the incident. Bob Martin seconded the motion and it passed unanimously. In response to a request for informational persons to be in each county office for the Centennial Center open house on February 25, 1978, it was determined that each Council member would serve for one hour. The following schedule was arranged: Bob Martin 10 to 11 A.M. Nancy Clark 11 to 12 Noon Bob White 1 to 2 F.M. Floyd Oliver 2 to 3 P.M. John Martin 3 to 4 F.M. Nancy Clark announced that the oral arguments in the case of the District Attorney versus Victor Jacobucci would be heard Monday, January 16, 1978 at 3:30 P.M. in Judge Behrman's court.
