RESOLUTION RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR13-0014 - UFI FEEDING, LLC, C/O REX BEALL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated June 26, 2013, the Board did approve the request of UFI Feeding, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0014, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (batting cages, gymnastics facility and baseball fields) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, on the following described real estate, to -wit: Subdivision Exemption, SE -609, and Lot C of Recorded Exemption, RECX12-00126; being part of the NE1/4 of Section 13, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current property owner, UFI Feeding LLC, c/o Rex Beall, represented by Shannon Toomey, AGPROfessionals, LLC 3050 69th Avenue, Greeley, Colorado 80634, to partially vacate Use by Special Review Permit, USR13-0014, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said partial vacation, conditional upon the following: 1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant shall submit a revised plat, titled "Partial Vacation of Use by Special Review Permit, USR13-0014", conforming to Section 23-2-260.D of the Weld County Code. There is currently a sports complex that includes batting cages, baseball fields and a gymnastics facility permitted by USR13-0014. The USR13-0014 currently encompasses all of Lot C of RECX12-0126 and SE -609. As detailed in the RECX18-0140 staff report, the applicant shall address condition of approval #1.A which states the following: 1.A "There is a Use by Special Review Permit USR13-0014 Reception #3974717 Rex Beall Sports Complex in the A (Agricultural) Zone District. This USR encompasses both proposed Lot A and Lot B of RECX18-0140. The applicant shall address the continued operation of USR13-0014 and which lot(s) it is to be associated with. If the applicant wants to remove any of the lots from USR13-0014 a partial vacation or complete vacation should be done prior to recording the Recorded Exemption plat. UFI Feeding, LLC submitted the Partial Vacation request letter and map (attached) for USR13-0014. The map shows the USR13-0014 boundary removed from Lot A of RECX18-0140. Lot B of RECX18-0140 and SE -609 will still be encumbered by USR13-0014. The Department of Planning Services staff has reviewed this request and recommends that this request be approved. If approved, the Partial Vacation will satisfy condition 1.A of RECX18-0140 staff report. The applicant shall submit a revised USR13-0014 partial vacation map to the Department of Planning Services for review per Section 23-2-260.D and Section 23-2-280 of the Weld County Code.
