Home My WebLink About780468.tiff RESOLUTION RE : APPROVAL OF EXTENSION OF CONTRACT FOR SERVICES BY AND BETWEEN MARIANNE LE CLAIR AS CONSULTANT AND COUNTY OF WELD REGARDING SERVICES PERFORMED TO COMPLETE ACQUISITION OF CERTAIN PROPERTIES IN BURGER AND FRY SUBDIVISION, WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , due to unforeseen circumstances, Marianne LeClair, Consultant, is unable to complete the required services by the termination date of December 31, 1977, and WHEREAS, the Board of County Commissioners of Weld County, Colorado deems it advisable to approve an extension of the original Contract for Services executed by and between the Consultant and the County of Weld. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Extension of Contract for Services by and between Marianne LeClair, Consultant and County of Weld, by and through its Board of County Commissioners, for services performed to complete acquisition of certain properties in Burger and Fry Subdivision, Weld County, Colorado, be, and hereby is, approved, and the Chairman of the Board of County Commissioners is hereby authorized to sign the same. ( 'C ^R, t !-y�l WELD COUNTY, COLORADO Weld County Clerk and Recorder and Clerk to the Bo rd' 7` ( y• Y \/,ti Deputy County -Clerk APJAI'Oy ED AS TO FORM:County Attorney /^ torney Date Presented: January 11 , 1978 780668 / ) EXTENSION OF CONTRACT FOR SERVICES THIS AGREEMENT, entered into as of this 11th day of January, 1978, nunc pro tunc January 1, 1978 , by and between MARIANNE LE CLAIR, hereinafter known as "Consultant" , and the COUNTY OF WELD, a body corporate and politic of the State of Colorado, hereinafter known as "County" , acting by and through its BOARD OF COUNTY COMMISSIONERS, WITNESSETH: WHEREAS, on November 1, 1977, the County contracted with the Consultant to perform certain services in order to complete the acquisition of certain properties in the Burger and Fry Subdivision, and WHEREAS, the termination date of said agreement, set forth in Section 4, was midnight, December 31, 1977, and WHEREAS, due to circumstances beyond her control , the Consultant has been unable to complete the required services by the termination date, and requires an extension of time in order to do so. NOW, THEREFORE, the parties hereby mutually agree as follows : Section 4 of the Contract for Services between Marianne LeClair and the County of Weld is amended to read: 4 . Term of Contract. All acquisitions of property covered by this contract, except those requiring condemnation proceedings, if any, shall be completed by the Consultant by midnight, February 28 , 1978. This Agreement shall expire by its own terms at that time, or at such later time as the acquisition of all subject properties is completed by eminent domain, unless extended by agreement of the parties .
