AT&T proposes to install twelve antennas at an e levation of two hundred fifty-four feet. This proposed Tower will allow for thirty-six additional antennas, reasonably spaced to prevent interference. Additionally, this tower will introduce FirstNet to the area. FirstNet is an independent federal entity established by Congress to ensure the building and deployment of the first nationwide, interoperable wireless broadband n etwork for public safety. The network is intended to provide for mission critical data communications over a dedicated, reliable, and hardened connection with a robust ecosystem of devices and applications available to public safety entities that subscribe to the service. AT&T has been awarded the contract to deploy the FirstNet n etwork. In 2018, FirstNet began deployment of its network and needs to maximize coverage to ensure that the largest rural area is covered by first responder services. AT&T proposes construction of a 254' Telecommunication Antenna Tower to maximize coverage. If the Antenna is placed on an existing Tower, FirstNet's Antenna would be in a subordinate position and thus reduce FirstNet's coverage area. Suite 300 Frisco TX 75034 NEXIUS SOLUTIONS Question Number 2 The proposed Tower is consistent with Weld County Comprehensive Plan Chapter 22, specifically sections 22-2- 1.0(E), 22-2-20(F0, 22-2-20(G) and 22-2-20(H): Section 22-2-10(E) provides: "land division that are exempt from subdivision regulations and allows land use by small agricultural operations... These lots retain the agricultural zoning designation and support a high quality rural character, while maintaining freedom from cumbersome regulations." The proposed Tower will not hinder the rural character of the property and it will allow the owner to use the property to generate additional revenue. Also, since this is an B11 network deployment, it is improving public safety in the community. Section 22-2-20(F) A. Goal 6 (2) provides: "a mechanism for the division of land in agricultural areas that support opportunities for a family to supplement family income and reduce living expenses for farm families and others who prefer a rural lifestyle." The proposed Tower will generate additional revenue for the property owner and help them defray the cost of the farm. 22-2-20(G)A. Goal 7 provides: "county land use regulations should protect the individual property owner's right to request a land use change. 2. A Policy 7.s Conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development and should attempt to be compatible with the region.► The proposed Tower is in an area that can support such development and is compatible with the region. 22-2-20(H) A. Goal 8. "Ensure that adequate services and facilities are currently available or reasonably obtainable to accommodate the requested new land use". The proposed Tower will not impact the sanitary sewage and water system. The Tower is unmanned and un-inhabited. Question Number 3 The proposed Tower is consistent with the intent of the Weld County Code, Chapter 23 and the zone district where it is located. Federal Aviation Administration Notice Criteria Tool- provides under what circumstances the FAA needs to be notified. According to the Tool,we will be we will be required to notify the FAA under CFR Title 14 Part 77.9 within 45 days of construction. A copy of the Notice is attached. 2. See Letter from Joseph Oliver, Nexius Solutions dated September 25, 2018 regarding co -location. 3. The current propagation map and the propagation map after the installation of the Tower. Responses to Weld County Code section 23-4-830 (C) 1-13 1. AT&T proposes to construct a 254 -foot Telecommunications Tower that is capable of co -location with 3 additional providers. There is an existing Telecommunications Tower that is near AT&T's proposed site. However, the existing Tower is only 190 feet with an array of antennas in the first segment of the Tower. Since there are existing antennas on the tower, AT&T's antennas would be in a subordinate position. This would further reduce AT&T's and FirstNet's coverage. Additionally, since FirstNet is a new network for first responder in rural communities, AT&T is trying to ensure that the largest rural area is covered by first responder services. If FirstNet co -locates on the existing tower, FirstNet's antenna would be in a subordinate position and network coverage would be minimized. It is important that the network reaches as wide an area as possible. Therefore, the existing Tower would not provide the necessary network coverage for AT&T and FirstNet. 2. In accordance with to 14 CFR Part 77.9 AT&T, AT&T is required to notify the FAA within 45 days of construction of the Tower. A copy of FAA Notice is attached. 3. The proposed Tower site is a 162 -acre plot, zoned Agricultural and used for farming. There are no structures within the fall zone of the Tower. Any ice -fall and debris from a Tower failure will be contained to the site. 4. The proposed Tower will support AT&T's equipment and accommodate coloration of at least three additional wireless carriers. AT&T proposes to install twelve antennas at an elevation of two hundred fifty-four feet. This proposed Tower will allow for thirty-six additional antennas, reasonably spaced to prevent interference. The proposed fifty -by -fifty -foot leased area on the property will also accommodate three additional carriers. AT&T proposes to occupy a small portion of that space. 5. The proposed Tower is depicted on the Site Plan page ZD-4. The Tower minimizes the impact on the surrounding environment. 6. As part of AT&T's compliance process, the report will measure the amount of radiation emitted from the Tower. AT&T will ensure that the Tower is within the accepted levels. 7. As stated on Site Plans Page T-1, "All work shall be performed, and materials installed in accordance with current edition of the following applicable codes as adopted by the local governing authorities: 2017 IBC, 2017 NESC, 2017 NEC, TIA/EIA 222- G-2 or latest Edition, City and county ordinances and all local jurisdiction requirements. S. See Site Plans Pages T-1 and ZD-4 9. The proposed Tower was designed by Jack T. Phipps, P.E, a Colorado Professional, Engineer. See the Site Plan Pages T-1, ZD- 1, ZD-2, ZD-3 and ZD-4. 10. A chain linked fence will be placed around the proposed Tower, as well as other anti -climbing devices will be installed on the Tower. Site Plan page ZD-2. 11. In selecting the proposed site, Nexius attempted to contact property owners within the search ring. Three property owners who were willing to work with AT&T were chosen and their sites were evaluated for coverage. Based upon their willingness to work with AT&T and the location of their land, AT&T determined that the proposed site was the most feasible. 12. This land is used as farm land and there is minimal amount of wildlife on the site. 13. Removal of the proposed Tower has been addressed in Section 13, "Removal/Restoration" of the lease agreements between New Cingular Wireless PCS, LLC (AT&T) and DUANGCHAI WASHBURN. The Lease provides: 13.REMOVAL/RESTORATION. All portions of the Communication Facility brought onto the property by Tenant will be and remain Tenant's personal property and, at Tenant's option, may be removed by Tenant at any time during or after the Term. Construction Traffic During construction of the Tower, daily weekday traffic will be impacted for approximately 30-45 days, Heavy machinery, such as cranes and cement truck, will be on the site for about one-third of the time. We anticipate 3 big rigs will be used to deliver the Tower to the site. There will be cranes brought to the site and left until work is completed, Once the cranes are placed on the property, they will remain there during the construction and there will be minimal impact on the public roads. When construction is complete, the crane will be removed from the site. Daily there will be between 1-3 standard work pick-up trucks with trailers. Traffic will be primarily on Colorado Road 81 and Colorado Road 92. Access to the property will be from a 15' Access road on the site that connects to County Road 92. Maintenance Traffic There will not be regular traffic to the site.
