Attached is an updated water supply report including data for the 2017-2018 water year. The portion of the report that DNR received in 2012 titled {`System Analysis" has not been revised since that time but is scheduled to be revised later this year. It should be noted that the 2012 report indicated the District's share of the NISP project was 3,300 acre feet. Our current share of the project is 3,500 acre feet. The District has not yet received the necessary study fees or documents from the applicant to complete a study, but we have received communication that the necessary information is being gathered. As stated in our referral response dated May 7, 2018, "specific fire flow requirements from the servicing fire department must be submitted to the District along with appropriate fees" for a water study to be conducted. In this case the District has not dedicated water from our "District Availability" of CBT, which is currently estimated at 1941 acre feet and shown on the attachment, for use at this specific project as projected water demands are unclear. Once a study is completed the applicant can secure dedicated water through the purchase of a line extension and taps. Study results may also provide options for securing dedicated water through a transfer of CBT shares or a cash -in -lieu payment. Additional information can be provided as it becomes available. Frank, Our office manager, Roxanne Garcia, had some correspondence with Joanna Williams from CDWR in October about their stated concerns from their April 24, 2018 referral response for this project. At the conclusion of the correspondence Joanna indicated that their comments were "addressed for now". If Joanna has additional concerns we are unaware what they are but will be able to address them once they are made clear. Although the costs established in the December 19 water study are only good for 30 days, and CW's requirements must be met in order to receive service, a can serve letter was generated for this parcel on Mach 14, 2018 which was good for a year. I have attached a copy of it to this email for reference. The can serve letter should be considered an indication that service is available if requirements are met and an additional one can be obtained if the project is delayed past March 14, 2019. The District is not concerned about a lack of availability of service as long as the applicant meets our requirements and is willing to enhance the infrastructure necessary to serve the property. Some of that is because the water supply provided by CWCWD that is attached only goes through 2018. I'd say we'd all like to get a more finalized answer to the issue, and at the end of the day we are just trying to determine the sufficiency of the water supply. So far what I see is that we have 1) a letter from the state engineer saying that they don't have enough information from April of this year, 2) a water supply chart that doesn't have information for 2019 and the following years, and then 3) the letter stating that you can purchase the five taps. I think we are close to having all that we need to go back to the state engineer and get an updated letter. However, the sticking point to me seems to be that the water projections haven't been updated for 2019. Isn't that sort of what the state engineer was talking about? Specifically the language below. Until we get an answer to that question, aren't we just going to end up in the same position with another letter from the state engineer saying the same thing? Maybe I am missing something, and if so, I am certainly happy to discuss other alternatives. Thanks. My understanding of Central Weld's policy is that the rates expressed in a commitment letter or water study is valid for 30 -days, after which the rates are subject to change. We do not expect a waiver from their policy would be approved. We are aware that their board recently approved a tap fee increase that takes effect 2/1/2019. Please confirm whether the PUD Change of Zone application can be submitted with this information. I think that we need to get a copy of the water supply plan letter under CRS 29-20-304(3). Do you have a copy of that? My concern is that some of the referrals can't be done until the water is resolved, like the fire district referral, the division of water resources, etc. So if we send it out to some, that starts the 28 day clock. If the water district and fire district don't get back within the 28 days, or get back and say that they request denial because of the lack of water plan, then we are creating an issue. Aside from that, the highlighted language in the code appears to me to require that the submittal include the source of water, and that the planning staff not deem it complete until that issue is resolved. Again, maybe I am missing something or misinterpreting this, but I don't see how we can ask for some agency referrals, hold off on some, and deem it a complete application without the water matter being resolved. I just don't know how to reconcile the fact that sending it out for referral without the water matter locked down will be futile since that information is required for some of the referral agencies. Anyway, let me know if you have other thoughts on it or a different suggestion, thanks. We needed to provide CWCWD with fire flow requirements and the fee both of which have been submitted. The water study is likely to take 60 days to complete. We expect it by October 4th. We're requesting that the PUD Change of Zone application be allowed to be accepted by the Planning Department so it can be issued for the 28 -day referral process. We understand that we may not be able to be scheduled for the Hearings until the water study is complete. However, if we wait till the beginning of October to submit the PUD Change of Zone application, our estimated date for Public Hearings is December 2018 or January 2019. I am not seeing any updated information relating to whether the water is available and secured. From what I can gather, the water district has not received the fees or the information they need to perform the study to determine whether they can provide sufficient water for the project. For purposes of processing the application, I think we can get everything ready to go, but we will need some sort of solid determination that there is enough water available. My understanding of the process at this point is that once we have it all completed, we can send out referrals and schedule the planning commission hearing. However, until this water issue is resolved, I don't think we can move forward with a hearing. What suggestions do you have as to procedurally how we move this forward without the water part in place? What timing are you looking for in terms of getting that water issue resolved, or in the meantime, accomplishing while we wait for it to get resolved? Please see the attached Central Weld County Water District (CWCWD) Can Serve letter. Our understanding through discussions with CWCWD are as follows: • CWCWD will supply the required information to the Colorado Division of Water Resources (CDWR) regarding their water supply plan. See the attached referral letter from CDWR. • Our development will likely require a water study with CWCWD prior to issuance of any line extension agreements, tap service agreements, etc. This water study will be predicated on fire flow requirements and will take a minimum of 30-45 days to complete. • A waterline extension is likely required for our development. The above mentioned water study will provide guidance regarding this extension. It is our understanding that proof of adequate water supply will be required before the PUDF can be finalized and that this information can be supplied with the PUD Final Plat application. Please forward this information to the County Attorney to verify whether the attached Can Serve letter is adequate for the PUD Change of Zone application.
