MINUTES WELD COUNTY HOME RULE CHARTER AMENDMENT STUDY COMMIll'J≤is April 19, 1978 The Weld County Home Rule Charter Amendment Study Committee met in regular session in • the Third Floor Conference Room of the Weld County Centennial Center, Greeley, Colorado, on Wednesday, April 19, 1978 at the hour of 7:00 P.M. ROLL CALL: The meeting was called to order by Chairman Gordon Jacy and on roll call, the following members were present, constituting a quorum of the members thereof: Gordon Lary, Chairman Dick Boettcher Bill Butler Blair Macy John Kunzman Wayne Brown Barbara Sloan Absent: Verdie Peddycord & Helen Norton ALSO PRESENT: County Commissioner Norman Carlson, County Council representatives Bob Martin and Nancy Clark, County Assessor Herb Hansen, County Attorney Thomas O. David, Assistant County Attorney P. Kay Norton, Charter Commission members Bud Johnson, Ralph Waldo, Peck Lesh, Members of the Press and Secretary Sandy Moorhonge. MINUTES APPROVED: A motion was made and seconded to approve the minutes of the March 15, 1978 meeting. There being `no additions or corrections to said minutes, the motion passed. Chairman lacy informed the Committee that Vice-Chairman Verdie Peddycord had contacted him to let him know she would be unable to attend tonight's meeting. The Chairman opened the meeting by calling for discussion on Article III, BOARD OF COUNTY COMMISSIONERS, Section 3-4, TERMS OF OFFICE. He began the discussion by stating that at the last meeting some of the members expressed the opinion that this section was discriminatory. It limits the terms of office for the County Commissioners, appointive boards and County Council, but imposes no restrictions on the other elective officers of the county. Blair Macy noted that he thought this section was included to prevent empire building by County Commissioners and stated he thought it should remain in the Charter. Bill Butler disagreed stating he thought by taking away from the citizens the right to vote on any candidate, it demonstrated a lack of confidence in them as voters. Wayne Brown said he saw the question as limiting all elected officials and appointive boards or none of them. Gordon Tory agreed with Wayne as to the issue involved. Dick Boettcher stated he had faith in the voters and made a motion to eliminate the two consecutive term limitation on all elected officials and appointive board members. Bill Butler seconded the motion. Chairman Lacy called for discussion on the motion. After considerable discussion, the motion passed on the following vote: Gordon Lacy Yes Blair Macy No Bill Butler Yes Wayne Brown No Dick Boettcher Yes Barbara Sloan Yes John Kunzman Yes Chairman lacy next asked for discussion on Article VIII, COUNTY COUNCIL, Section 13-8, POWERS AND DUTIES, which was tabled at the last meeting. A general discussion of the pros and cons of the issue was-had by the Committee members. Dick Boettcher asked County Attorney Tom David where the powers of the Council would revert should the office be abolished. Mr. David said that all powers not delegated by the county would revert to the state and are covered by state statute. Barbara Sloan suggested retaining (1), (2), (3) and eliminating (4), (5), (6), and (7) under Section 13-8. Wayne Brown said he thought the Council was necessary and filled a valuable function in county government. He did not think this section needed to be changed at all. 780513 NC) RECORD OF PROCEEDINGS 100 Leaves Page 2 April 19, 1978 Nancy Clark stated she thought the Committee had expressed well thought out feelings but they were not offering the people a solution to the problem. She said the Council was not the cause nor the solution to the problems of county government and if the Committee was going to recommend an amendment for a vote of confidence in the Council, they also had to offer an alternative for the voters consideration. Nancy also stated that the Council had made some mistakes but she thought they had done enough to justify its continued existence. Ralph Waldo said he knew the Council had been surrounded by controversy since it started but had saved the Weld County taxpayers money on the county budget. He suggested a 4-5 year time period was necessary to determine the value of the Council as a part of county government. Bud Johnson agreed, saying that mistakes had been made on both the Council and Commissioners' part,but the Council was necessary. After further discussion, Barbara Sloan made a motion and Wayne Brown seconded to make no change in this section of the Charter. The notion was defeated by a four to three vote with the members voting as follows: Gordon Lacy No Blair Macy Yes Bill Butler No Wayne Brown Yes Dick Boettcher No Barbara Sloan Yes John Kunanan No n Dick Boettcher then made a motion and Bill Butler seconded to putt he question of the County Council on the ballot, to retain or eliminate. The motion passed on the following vote: Gordon Jacy Yes Blair Macy No Bill Butler Yes Wayne Brown No- Dick Boettcher Yes Barbara Sloan No John Kunzman Yes Chairman Lacy asked the Committee members to remain for a discussion of the County Manager form of government and the appointment of the County Coroner and Sheriff. General discussion followed on the County Manager topic. Nancy Clark, stating she was speaking for herself and not the Council, expressed a favorable opinion on County Manager issue. She pointed out that cities had been using this system for many years with a streamlining affect. She thought it could have the same affect for county government. Dick Boettcher said one of the main issues will be whether the manager is appointive or elective. After some discussion, the Committee members directed the secretary to contact New County, USA and request information on this topic. Gordon Lacy asked Nancy Clark if she could recommend speakers, pro and con, that would attend one of the Committee's meeting to talk to those present.. It was recommended that the meeting be well publicized so citizens interested in the County Manager form could attend. • There being no further business to discuss, the meeting was adjourned. at 8:55 P.M. The next mooting will be held on Wednesday, May 17, in the Third Floor Conference Room of the Weld County Centennial Center at the hour of 7:00 P.M.
