RE: CR 71 RIGHT OF WAY DEDICATION
Please accept the attached Deed of Dedication for public road right of way for Weld County Road 71 between
Robert J. Burbach Trust and Weld County.
This Deed of Dedication is presented to satisfy a condition of approval required with the administrative
approval of I MUSR 18-12-0048 for A Site Specific Development Plan and a First Amended Special Review
Permit,USR12-0048 for Oil and Gas Support and Service, including oil and gas processing facilities for three
(3) compressors and related equipment, including the addition of four (4) compressors, produced water storage
tanks, dehydration system, condensate pumps, fuel conditioning system, custody measurement, instrument air,
electrical power, a facility flare, and a combustor, and up to six (6) construction office trailers and two (2)
Conex for use during the construction of the facility in the A (Agricultural) Zone District. (Summit Midstream
Niobrara, LLC Angus Compressor Station).
A Road Maintenance Agreement was required as the facility will generate additional vehicles and heavy traffic
associated with 1 MUSR 18-12-0048 for extended period of times. The site is generally accessed from the North
off of County maintained CR 130. The subject site is located south along CR 71, a non -maintained 30' public
right of way. There is an existing roadway that is being utilized to get to the site however, the road meanders
in and out of the public ROW. Summit Midstream Niobrara, LLC worked with the adjacent landowner,
Robert J. Burbach Trust to reach an agreement for the consideration of the dedication of ROW to eliminate
concerns of trespassing on private property and secured the adjacent 30' of ROW to meet the minimum 60'
local road right of way standard. The area being dedicated is approximately one-half mile south of CR 130
and is approximately 3.624 acres of public right of way.

DEED OF DEDICATION FOR PUBLIC ROAD RIGHT-OF-WAY
THIS DEED, made this II_ day of Apr. I , 2019, between PA. r .1 tit S.,
(referred to herein as "Grantor", whether one or more), and the County of Weld, a body corporate
and politic of the State of Colorado, through its Board of County Commissioners (referred to herein
as "Grantee"), whose legal address is 1150 "O" Street, Greeley, Colorado 80631:
WITNESSETH: That Grantor, for and in consideration of payment made by Grantee, the receipt
and sufficiency of which is hereby acknowledged, does, pursuant to Colorado Revised Statute §43-
2- 201(1)(a), hereby dedicate and convey forever unto Grantee for use as a Public Road Right -of
Way, that real property lying and being in the County of Weld, State of Colorado, to wit:
The real property described and depicted on the attached Exhibit.
EXCEPTING oil, gas, hydrocarbons, and mineral leases, liens, encumbrances, rights -of -way,
easements and utilities thereto existing or of record, and
RESERVING unto Grantor the mineral estate under said property, including oil, gas,
hydrocarbons and any and all water rights including non -tributary and not non -tributary water
currently attached to, upon, under, or associated with said property, except as required to sustain
the integrity of the Public Highway.

P.M., Weld County, Colorado, said parcel being the Westerly 30 feet of said
Section 13, being more particularly described as follows:
BEGINNING at the Northwest corner of said Section 13, running
