RESOLUTION RE: APPROVE 2019 PAUL COVERDELL FORENSIC SCIENCE IMPROVEMENT GRANT APPLICATION FOR NORTHERN COLORADO REGIONAL FORENSIC LABORATORY AND AUTHORIZE ELECTRONIC SUBMITTAL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with the 2019 Paul Coverdell Forensic Science Improvement Grant Application for the Northern Colorado Regional Forensic Laboratory from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, to the Colorado Division of Criminal Justice, Office of Adult and Juvenile Justice Assistance, commencing January 1, 2020, and ending December 31, 2020, with further terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. James 2019-0713 SO0040 BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW/ WORK SESSION REQUEST RE: FY 19 Coverdell Formula grant DEPARTMENT: Sheriff's Office: Crime Lab PERSON REQUESTING: Daren Ford Brief description of the problem/issue: DATE: 2/4/2019 The Regional Crime has the opportunity to obtain at least $17,614 in training funds from a Coverdell formula grant. These federal funds are provided each state in the form of a formula grant based upon the number of type I crimes in the regions. As these funds are designated for laboratory services, I have looked at the number of type I crimes for the northern Colorado regions to come up with the figures that translate to the $17,614 we would receive. I have been working with Meg Williams with the Colorado Department of Criminal Justice who manages this grant from the states perspective and provided the 2017 federal figures that I used to calculate the amount we would be awarded. Having examined the needs of the regional lab and areas where training is needed most I have identified 7 training opportunities that I am requesting funds for. Two mobile forensic classes for our newest DME analysts to be further training in Mobile Forensic devices. One is for our shoe and tire examiner to attend a class he needs to maintain his certification. A fourth is for training needed for our most recent fingerprint examiner to attend training to help her attain certification. The fifth class is for a latent print examiner to attend a conference with training classes to support her fingerprint and shoe and tire track certification. The sixth is for our A/V examiner to attend training to aid her in the download and processing of audio and video data for analysis. The final class is for our newest firearms examiner to attend a conference with training that will aid in obtaining her certification. All of the training is critical for the lab to continue maintaining our accreditation and also to address the recent challenges we are seeing regarding analyst certification as a qualification for testifying in court. This request is to ask for the opportunity to submit a request for grant funding that will help our lab to maintain the quality of service it has attained and continue to provide essential services to the region. There is never a guarantee that funds will be given, but it is a formula grant so if the grant is approved at the Federal level as part of the budget for 2019/20 these funds are certain. In that case a separate request will be made to accept the SOGA offered. Training: There is no future cost impact for the training and there is no supplanting of funds with this request. The grant must be submitted to the state by February 15th What options exist for the Board? (Include consequences, impacts, costs, etc. of options) Approve the request for training funds ($17,614) for the lab. This provides additional funds for the lab to keep its analysts current on issues that affect their work product on the bench and in the courtroom. Project Abstract: Summarize your project in the space provided The Northern Colorado Regional Forensic Laboratory (NCRFL) is a consortium of 5 law enforcement agencies that have combined lab staff, along with CBI staff housed in Greeley, to provide forensic services to the Northern Colorado region, primarily to the participating agencies. The lab, in conjunction with CBI was accredited in May 2015 in chemistry, forensic biology -serology, firearms, latent prints. The disciplines of Forensic biology -DNA and Digital Multimedia evidence (DME) were accredited in 2016. The lab in keeping with the need to have all staff certified is seeking training opportunities to help members obtain or maintain current certifications within their chosen disciplines. The training received will also keep them current in the latest technologies including those needed to address the Opioid concerns within the forensic science community. 15. Coverdell Purpose Area To improve the quality and timeliness of forensic services and to reduce the number of backlogged cases in forensic laboratories ✓ To implement recommendations as adopted by the National Commission on Forensic Sciences (NCFS) to strengthen the forensic science communities 16. We are seeking training funds to expand the knowledge, skills and abilities of the forensic analysts in the NCRFL. We have several new employees that have been added to our lab and so we are seeking the expanding their skills. We also are addressing the concerns of the NAS and P -CAST reports regarding accreditation and certification. The training we are seeking for our staff will expand their current knowledge and skills within their discipline. This will help them in maintaining their certification and for a few it willl aid in their certification process. Additionally, the opioid issues are not solely a drug analysis process. The other areas of the lab are vital in the identification and characterization of both users and distributors, so expanding the skills and knowledge of the analysts in their disciplines will also pay dividends in cases related to opioid use and distribution. 17. The NCRFL is fully accredited in all 5 (Drug chemistry, forensic biology, Firearms, (firearms, tool marks, serial number restoration), Latent prints (fingerprints, shoe and tire tracks) and digital multimedia) disciplines since 2016. Our next ISO:IEC 17025 assessment is in April 2019. 26. We have identified 7 individuals in our laboratory and an associated training for each of these individuals. Once funds have been released we will contact the agencies or organization hosting the training to determine available times and locations in 2020 for the staff to attend training. Once we match a time and location with a staff member's availability to attend we will register the member and work out the details for them to attend the training. The staff members responsibility is to attend the training, fulfill all training requirements including a final exam if required. Upon return back the laboratory, they are required to implement their knowledge and skills in the work they perform. We also expect them to bring back to the other lab staff any information that will benefit the unit or the lab. For those needing hours for continuing education the staff member will notify and fulfill obligations to their certifying body. For those pursuing certifications we expect that as soon as they are qualified they will make application and complete all other requirements necessary for certification. 27. PROJECT OUTCOMES (EXPECTED RESULTS) Describe how this proposed project will positively impact: a) Improvement in quality and timeliness. The training classes chosen were chosen to provide the examiner with the latest technology and ideas in the performance of their work. As they implement any changes we anticipate that such changes will include those that will make the lab more efficient. One goal of any training class is to provide information and increase awareness of a specific discipline so that an examiner can be better prepared to process evidence. Such as in the case of DME, where the training in mobile forensics will provide our newest examiners a great grasp of the tools and their usefulness in the examination of phones. Our expectation of analysts is to learn and apply what the learn to become more effective, while applying the knowledge to obtain the most they can from the testing they perform. 28. The NCRFL is is an ISO:IEC 17025 accredited lab as of 2015. 32. IMPLEMENTATION APPROACH - Explain the implementation approach to be used to accomplish the goals and objectives being proposed. 1. (Provide the signed certification on the Documents tab) The Northern Region Lab Group (NRLG) and CBI signed a MOU in 2013. this group of 6 agencies have determined to use the CBI quality system and its related laboratory policies and procedures to operate as a forensic laboratory. 34. GENERALLY ACCEPTED LABORATORY PRACTICES AND PROCEDURES - Describe how the applicant agency complies with the certification. Provide the name of the certifying accreditation organization being used. See instructions for further information. (Provide the signed certification on the Documents tab) ANAB is the current accrediting body. The NCRFL works with the CBI in providing forensic laboratory services to the region It has placed itself under the CBI's quality system and therefore operates under all the CBI Forensic Science Services policies and procedures as set up by the Colorado Bureau of Investigation. The policies and procedures have been reviewed by the accrediting body and the laboratory undergoes an annual review to assure compliance. We perform monthly and annual audits, review all work and reports for technical competence and accuracy. All analysts undergo proficiency testing annual as required by policy. 35. EXTERNAL INVESTIGATIONS - Provide a detailed explanation of the process for ensuring an independent external investigation would be conducted in the event that an allegation of serious negligence or misconduct substantially affecting integrity. See instructions for further information. (Provide the signed certification on the Documents tab) If an allegation of serious negligence or misconduct were brought to the attention of the lab director, the lab director would do the following: 1. The CBI quality system has in place a system to review instances of that may affect the quality o the laboratory system. It is defined in the Quality Manual of the CBI laboratory system Anyone in the system can report on a incident of quality concern in the form of a quality incident review (OR). 2. All QIRs are eventually provided to the lab director for review before being given to the Quality Manager. Many of these QIRs are resolved at the level of the technical leader or lab manager. All others continue though the review process and in some instances the lab director determines the corrective actions that may need to be taken. That recommendation is then reviewed by the Quality Manager. 3. If on review the lab director determines that the QIR indicates an allegation of serious neglect or misconduct then, in addition. to the paper trail of the QIR a call to the Quality Manager would occur. 4. The lab director would contact the Quality Manager of the CBI to determine the level of concern. 5. If is was of a serious nature and required an independent investigation then the lab director would contact the Weld County Sheriffs Office, Internal Affairs Unit to make them aware of the allegation and request their services to provide an independent review of the allegation. 6. Due to the unique nature of the regional lab (6 agencies provided staff in the lab) the agency whose employee was involved in the alleged action would be notified. They would be appraised of the situation and informed that an independent review would be done. 7. The lab director would review the results of the independent review and in concert with the CBI quality manager create a plan to follow through with the recommendation of the Weld County Sheriff's Office Internal Affairs Unit.
