EQUIPMENT) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR
RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO
ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE
A (AGRICULTURAL) ZONE DISTRICT — UNA AND LOUIE MARTINEZ
A public hearing was conducted on May 22, 2019, at 10:00 a.m., with the following present:

Commissioner Steve Moreno
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 4, 2019, and duly published
April 10, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of
Una and Louie Martinez, to withdraw the application for a Site Specific Development Plan and
Use by Special Review Permit, USR19-0003, for a Use permitted as Use by Right, Accessory
Use, or Use by Special Review in the Commercial or Industrial Zone Districts (construction sign
business including two (2) commercial pickup trucks, five (5) message boards, seven (7) arrow
boards, two (2) flatbed trailers, two (2) cushion trailers, flagging equipment and other small
equipment) provided that the property is not a lot in an approved or recorded subdivision plat or
part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
B. Angela Snyder, Department of Planning Services, presented a letter from the applicants,
dated April 12, 2019, requesting to withdraw the application. She stated the site was visited by
the Department of Planning Services staff on April 25, 2019, and all equipment except for an office
trailer had been removed from the property. She explained a letter had been sent to the applicants
notifying them the everything needs to be removed from the property within 30 days of the notice,
or the Department of Planning Services will re -open the zoning violation.

Commissioner Conway moved to accept the request of Una and Louie Martinez, to withdraw the
application for a Site Specific Development Plan and Use by Special Review Permit,
USR19-0003, for a Use permitted as Use by Right, Accessory Use, or Use by Special Review in
the Commercial or Industrial Zone Districts (construction sign business including two (2)
commercial pickup trucks, five (5) message boards, seven (7) arrow boards, two (2) flatbed
trailers, two (2) cushion trailers, flagging equipment and other small equipment) provided that the
property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior
to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. The
motion was seconded by Commissioner James, and it carried unanimously. There being no
further discussion, the hearing was completed at 11:01 a.m.
This Certification was approved on the 29th day of May, 2019.
