O. BOX 216 , FORT COLLINS, COLORADO 80521. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 14th day of February, 1979 at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Deryl Heimann, P. O. Box 216, Fort Collins, Colorado 80521, for the granting of a Special Use Permit for a hog farrowing and finishing operation on the following described real estate, to-wit: A tract of land situated in the Southeast Quarter of Section 18, Township 8 North, Range 66 West of the 6th P.M. , Weld County, Colorado, considering the South line of the said Southeast Quarter of Section 18 as tearing West and with all bearings contained herein relative thereto: Commencing at the Southeast Corner of said Section 18, thence West 860.00 feet; thence North 299.00 feet to the true point of beginning; thence West 538.00 feet; thence North 801.00 feet; thence East 538.00 feet; thence South 801.00 feet to the point of beginning, containing 9.8930 acres, more or less. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a hog farrowing and finishing operation on the above described real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and WHEREAS , the Board of County Commissioners of Weld County, Colorado heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully in- formed, is satisfied that the request for a Special Use Permit 790462 �L12OZ for a hog farrowing and finishing operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the application of the petitioner for a Special Use Permit for a hog farrowing and finishing operation on the hereinabove described tract of land be, and hereby is, granted subject to the Development Standards contained in the Special Use Permit and provided that a storage pit for manure be installed and further that said pit shall be adequately covered. It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Sections 3. 3 . .2 . and 6 . 1(4) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, and the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following : A. The hog operation and management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing any potential adverse impacts . B. The request is to establish an agricultural enterprise in the Agricultural Zone District with existing land uses being predominantly agricultural . C. The following referral entities have reviewed this request and have set forth no objections to it : 1. Weld County Engineering Department 2. Colorado Division of Water Resources 3 . West Greeley Soil Conservation District 4. Colorado Geological Survey 5 . Nunn Fire Protection District 6 . Weld County Health Department provided the applicant complies with the Health Department ' s comments in its letter dated December 15 , 1978 . The Health Department ' s comments are incorporated in the attached Development Standards. 7. The Weld County Extension Service has indicated there is ample space proposed for all phases of this operation for the proposed numbers . The County Extension Agent indicated this appears to be a well designed unit for a complete swine operation. He did not observe any problems with this operation. 8. The Pierce Town Board reviewed this request on December 11, 1978, and set forth no objections to the request . They recommended that the applicant remove the solid waste whenever necessary to mitigate potential odor problems. V Deryl Heimann SUP-377: 78 : 29 PLANNING COMMISSION RECOMMENDATION January 2, 1979 The Planning Commission recommendation for approval is conditional upon the following: 1. The attached Development Standards being recommended and adopted for the Special Use Permit . 2. No building or electrical permits shall be issued for the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the Department of Planning Services office . 3 . The attached Development Standards being amended to incorporate the West Greeley Soil Conservation District ' s recommendation as contained in its letter dated December 29, 1978 . This shall be accomplished by changing Development Standard #7 to #8 and adding the following as the new #7 Development Standard: "The applicant shall design the catch basin as shown hereon to hold surface storm waters for the Special Use Permit site and the surrounding drainage area. " I v i Comments : 1. The applicant has submitted a petition in favor of the request containing the signature of the adjacent property owner to the east. 2. To date, our office has received 3 letters of opposition to this request . from adjacent property owners. Their major concern is potential odors and devaluation of property surrounding the pro- posed hog operation. Copies of those letters are included in the attached materials. Deryl Heimann - SUP DEVELOPMENT STANDARDS 1. The permitted use on the hereon described parcel shall he a hog farrowing and finishing operation and all other uses permitted under Section 3 . 3B of the Weld County Zoning Resolution. The facilities shall be limited as shown hereon which are designed to handle a total of 4 ,000 head of swine . 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion , fugitve dust , and the growth of noxious weeds. 3 . All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality , water quality , noise emission, and sanitary disposal systems . Odors shall not exceed the 15 : 1 dilution ratio (15 parts odor-free air to 1 part odiferous air) at the property boundary as specified in the Colorado Air Pollution Control Commission Regulation No . 2 . 4 . Lagoons for wastewater retention shall be installed as per Pules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May , 1968 . The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division . 5 . All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6 . There shall be no discharge of wastes into any streams , other bodies of water , or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 7 . The applicant shall design the catch basin as shown hereon to hold surface storm waters for the Special Use Permit site and the surrounding drainage area. 8 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Pegulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioenrs before such changes from the plans and/or Development Standards shall be permitted. Marty Meyer , representating Cargill Nutrena Feed Division who designed the proposed operation , pass 1d out pictures of a reseach farm to the members of the Plan it Cconstru� ed which shows basically how the operation will appear when He also stated that the system utilizes natural sun light as bas the in caenergy source . There will be drainage on the property , of heavy rainfall , there will be a natural catch basin for liquid waste. Solid waste will be stockpiled and spread on fields in the summer months,. I There will be one well to furnish water for this operation plus one ck-u well for an emergency supply . Due to the high evaporation from �,I i to p the sun and low rainfall , waste products will dry out creating very little odor. Chuck Cunliffe then read the staff ' s recommendation for Standards . Mr . Cunliffe also commented that approval and the Development the West Greeley the applicant should consider the recommendation by Soil Conservation Service as a part of the design of the operation. Mr . I Heimann stated that this was in regard to the concrete structure of the j operation. Discussion then followed regarding air pollution and the soils on the property . Mr . Kiefer then asked if anyone in the audience / 1I had any comments to make regarding the request . VIOLATOR : Frank Waterkotte CASE NUMBER: VI-89 : 78 : 20 LEGAL DESCRIPTION: Pt . SWs, Section 19 , T3N, R66W LOCATION: West of Division Boulevard opposite Byers Street adjacent to the Town of Platteville VIOLATION: Junkyard and Dog Kennel in the Agricultural Zone District DISCUSSION: Cathy Carter , Zoning Violation Inspector, read the history of the violation to date to members of the Planning Commission. Mr. Lloyd Camp , owner of the property, stated that he can get no cooperation from Mr. Waterkotte and hoped the County would take care of the matter for him. He has asked him to either clean up the property or move , but Mr . Waterkotte fails to do either. Discussion followed regarding what constitutes a dog kennel . Mr. Nix commented that he does not think any one has any business with three or four dogs . Discussion again followed. Mr. Hiatt said that based upon the material submitted and because this violation is adjacent to the Town of Platteville, he is aware of the situation and is concerned with the sanity of-Mr. Waterkotte . He feels the Camp ' s should be given ample time to resolve the situation. It was the general feeling of the Planning Commission members that the Camp ' s should be given 60 days to initiate legal action against the tenant to clean up the property or move. Cathy Carter also requested that all correspondence from Mr. Camp ' s attorney be sent to the Department of Planning Services office so that they will know action has started. Gary Fortner also suggested that it would be appropriate to have the matter brought back before the Planning Commission after the 60 day period to report any progress that has been made . MOTION: Be it therefore resolved to initiate legal action within 60 days by and between the property owner and the tenant . At the end of the 60 day period, it will be brought before the Planning Commission again to report any progress that has been made . Motion by Percy Hiatt , seconded by Ben Nix. Planning Commission T utes Page 3 January 2, 1979 DISCUSSION AND WORK SESSION ON PROPOSED SECTION PERTAINING TO "AMENDMENTS TO THE ZONING RESOLUTION" Thom Rounds presented an overview of accomplishments in the Zoning Resolution re-write with the use of a slide presentation . Mr. Rounds stated that the staff ' s objectives are to improve the application process so that it is more easily understood, can be administered to more efficiently, and so that people can prepare them more easily . Standards will be set governing the applications and what is necessary for approval . Applications will be developed for change of zones, site plan approval , Special Use Permits, and variances. Mr. Rounds briefly explained each proposed zoning category. They include industrial , commercial , residential and agricultural zone districts. There was some discussion in the industrial section regarding screening operations in this particular district and in the commercial section regarding the aesthetics of such operations such as neatness, orderly appearance , etc. There being no further business, the meeting was adjourned. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion , fugitve dust , and the growth of noxious weeds . 3 . All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . Odors shall not exceed the 15 : 1 dilution ratio (15 parts odor-free air to 1 part odiferous air) at the property boundary as specified in the Colorado Air Pollution Control Commission Regulation No . 2 . 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May , 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division . 5 . All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6 . There shall be no discharge of wastes into any streams , other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 7. The applicant shall design the catch basin as shown hereon to hold surface storm waters for the Special Use Permit site and the surrounding drainage area. 8 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioenrs before such changes from the plans and/or Development Standards shall be permitted. There will be four people working 2 shifts a day from 6:00 A.M. to 10:00 P.M. - 2- 8 hour shifts daily. This operation will be located 3 miles west and one mile of Pierre , Colorado on 320 acres. Legal land aescription per attached blue prints. The engineering '3nd theory of this operation h-.s been designed, develo ,ed and tested by Cargill Nutren Feed Division, P. O. Box 9300, kinnecolis , Minnesota. This theory has been in operation by Cargill for 20 years. Due to the engineering theory by C'xrgi11 there will be .uinialal air and water pollution, odor, noise , glare , fire nor any hazards. Due to the design of this , the climate in Colorado and small amount of rainfall, the air and water pollution is minimal. Open air design as per blueprints. Odor -- due to the high evaporation from sun and low rainfall, waste products will dry out creating very little odor. Noise-- will only be noise that hogs naturally create , as machin- ery will be minimal, including a frontend loader and 2 trucks. Glare-- There will be no glare because the nature of Cargill' s system will include 2 Mercury yard lights per 120 hogs unit. This system is very energy efficient because the use of the sun is the number one energy source. Other energy used will be L.P. infra heaters in the farrowing isolettes for piglets. Fire & other Safety Hazards-- Due to structural separation of buildings - 8 feet apart in isolettes, if one would burn it would be Linimal chance of next one catching on fire. Any elec- trical to buildings will be on outside of building with conduit around all wiring. Hutches will be fireproof because structure is basically petal - no electric.,l nor L. P. Gas will run into hutch area. We intend to keep a 30 foot firebreak around complete hog operation to keep fire from coming in from other areas. Traffic Congestion -- other than our only 3 personal vehicles, there will be one truck going out once a week with butcher hogs, and one truck a day five days a week bringing in feed. The feed 4 SPECIAL USE PERMIT :PLIC4TION - PAGE 2 is a special mix purchased from Cargill. Feed program is also based on Cargill' s theory for last 20 years. Feed will be stored in self-feeders. (f ) Sewage and other wastes: There will be natural drainage on property , but in case of heavy rainfall, there will be natural catch basin for liquid waste. Solid waste will be collected approximately every 45 days at end of every production cycle. Solid will be stock-piled until fer- mented and then spread on fields. (g) Water Supply: As of this time , extensive test holes have been run and have been assured by Ed Lesh Well Drilling 0o. in Ault That adequate quantity, quality and dependability of water is there. There will be one well to furnish water for this operation plus one back-up well for emergency supply. Further information and data enclosed from Ed Lesh. It will take approximately 1.6 gallon per hog per day accodding to Cargill theory. This operation will include approx- imately 4,000 hogs at one time due to turnover in marketing. On said described property of 320 acres, there will be two built for each brother' s family - one on each 1/4 ( uarter) which con- sists of 160 acres; each home will h= ve i: ' s own yomsvt7 c well. A OPERATION OF HOG FARM A simplified and easy way of how this operation will be ruri: When permit is issued , we intend to buy 120 York & Hampshire crossed sows plus 6 Durock boars to service the sows. These 120 Sows will be bought 33 at a time and bred - so they will litter in 6 week intervals to keep the 33 farrowing isolettes full at all times. These Weiner pigs will be graduated through weiner and finishing pens due to type of feed and weight gain, which is approzimately 120 days from day of farrowing. Using this method of buying, breeding and building, full capacity will reach 500 sows, 25 boars; approximately 4,000 head at any one time on this property. According to Cargill, the sows farrowing need 128 s^uare feet which is the size of isolette and pen area in front of isolettes. Finishing hos need 14. 6 s-uare feet per hog which blueprint plans allot. This s-uare footage per hog is based on Cargill Spec , but could be changed to County spec. In constructing this operation, all cement poured will have rat walls around exterior pads and floors. All 2ens will h ve self-feeders of quantity that will only h':ve to be filled twice weekly and self-waterers. All brood stock and boars will be purchased from Royal Lean, Ft. 2dorgln. Colorado, due to their disease free and genetic reasoning. Soil information for the proposed site was provided to Mr. Heimann on November 28, 1978. This information indicated a low strength characteristic for construction of concrete slab on grade or foundations for dwellings or buildings. Concern was also expressed for special consideration to be made for diverting surface storm runoff around the site to prevent washing of accumulated animal wastes into surface waters. The plan indicates surface drainage will be to the east through the site to a swale that will then divert surface water and affluent to a catch basin. The plan indicates no sizing or capacity for the swale channel or catch basin. We suggest the applicant at least consider sizing the catch basin to hold surface storm waters for the site and the surrounding drainage area. The abandoned canal will be the main recipient of storm waters and will prevent storm flows from transporting materials further east below the site. However, a properly sized catch basin would provide a central collection site that could be easily cleaned and maintained. The soil at the site, Ascalon fine sandy loam, 0 to 6 percent slopes, is very susceptable to wind erosion. Planning for the site should include measures to insure wind erosion is not a hazard. No other comments are needed. This property is located in the SE4 of Section 18, Township 8N, Range 66w, of the 6th PM. Based on our experience in the area and the test log information oftained by us, we are certain that we can drill a well that will pro- duce a minimum of 10 GPM. If for some unexplainable reason our test log information does not bear out and we cannot obtain adequate water from the alluvial aquifer, we can continue drilling to approximately 250 ft. into the Fox Hill Sandstone Member. If this doesn't prove out, we can drill to 650 ft. and reach into the Upper Pierre Shale Zone. Ultimately, what we are saying is that all of these zones are good water producing stratas and we can assure you that adequate water will be produced. SN, Range 66W, Weld County, Colorado. The site is made up of the soil type Ascalon fine sandy loam, 0 to 6 percent slopes. This is a deep, well drained soil with moderate permeability, high available water capacity, slow surface runoff and low erosion hazard. The principle erosion hazard is wind. Care should be taken to maintain surface soil protection. This soil does exhibit a low strength characteristic for construc- tion of concrete slab on grade or foundation for dwellings or buildings. Soil engineering tests may be needed to determine proper foundation design. Your request indicated that your intended operation gill be farrow to finish type and will utilize the Cargill Slab type facility. The only concern for this type of system is to insure storm runoff water can be safely diverted around the facility to avoid contamination and washing of accumulated animal, wastes into surface waters.. Attached are copies of the soil description and a soil map which will further explain the soil characteristics.
