A public hearing was conducted on August 21, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
F I hereby certify that pursuant to a notice dated June 25, 2019, and duly published
June 28, 2019, in the Greeley Tribune, a public hearing was conducted on July 31, 2019, to
consider the request of Crestone Peak Resource Holdings, LLC, for a Site Specific Development
Plan and Use by Special Review Permit, USR19-0019, for Oil and Gas Support and Service
(storage and staging yard for oil and gas equipment along with an existing office/shop building,
existing welding shop, existing equipment storage building, existing field measurement and
calibration building and up to twenty five (25) cargo containers for storage of valves, fittings and
electrical items) in the A (Agricultural) Zone District, at which time the matter was continued to
August 21, 2019, to allow the applicant adequate time to develop a Landscape and Screening
Plan. Karin McDougal, Assistant County Attorney, made this a matter of record.
la Chair Kirkmeyer reviewed for the applicant and the public, the procedures to follow should
this case result in a tie vote due to four (4) Commissioners being present and Commissioner
Moreno excused.
F Chris Gathman, Department of Planning Services, presented a brief summary of the proposal
and history of the site, and mentioned USR-589 will be vacated as a Condition of Approval. He
displayed a map of the site and pointed out the Regional Urbanization Area (RUA) boundaries
surrounding it. He provided the distance to the nearest residence and indicated the Department

of Planning Services had received no correspondence regarding the application. He stated the
applicants recently submitted a Landscape and Screening Plan (Exhibit E) and an updated
PowerPoint presentation (Exhibit F) to reflect the landscaping and screening. In response to
Commissioner Conway, Mr. Gathman confirmed the approval date of the associated injection
well, permitted under USR18-0053.
F Evan Pinkham, Department of Public Works, provided a brief overview of the transportation
plans and requirements, stated the accesses are on County Road (CR) 19 and CR 4, and
provided the traffic counts and average speeds in the area. He indicated the Department of Public
Works (PW) is requiring a new Improvements and Road Maintenance Agreement, and presented
the drainage and grading requirements. In response to Commissioner Conway, Mr. Pinkham
stated he would research the Average Daily Trip (ADT) differential, and in response to
Chair Kirkmeyer, confirmed the traffic count he cited was taken February 15, 2017.
ID Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions, and stated there will be one (1) full-time employee at the site, along with contractors
and drivers who will be visiting the site. He explained bottled water and portable toilets are
acceptable; however, there is an existing office with an On -site Wastewater Treatment System
(OWTS), sized for five (5) employees, and the office is served by an industrial well. He indicated
they will store waste and chemical items, the wash bay water will be contained and removed for
proper disposal, and Development Standards (DS) #9-26 address Environmental Health items.
Meghan Campbell, Crestone Peak Resource Holdings, LLC, represented the applicant and
provided a PowerPoint presentation (Exhibit F), which covered an overview of the proposal and
the updated Landscape and Screening Plan, which she described in detail. She stated the
applicant is willing to remove the request for portable toilets from the application as there are
bathrooms onsite. She requested they be able to phase the landscaping, explained why they
believe the use is compatible with surrounding uses, and in response to Commissioner James,
confirmed the fencing would be metal panel, not chain link.
F No public testimony was offered concerning this matter.
El At Chair Kirkmeyer's request, Ms. Campbell shared a picture of the proposed metal panel
fencing, mentioned they use it at a site in Frederick, and confirmed there are sites near the
proposed site that use it currently. In response to Chair Kirkmeyer, Ms. Campbell confirmed they
had eliminated portable toilets from their proposal and explained the plan for phasing the
landscaping. In response to Chair Kirkmeyer, Mr. Pinkham described the details of the
Improvements and Road Maintenance Agreement, there was discussion about haul routes, and
Ms. Campbell confirmed the requirements of the Brighton Fire District had been met. In response
to Commissioner Conway, Mr. Pinkham confirmed the ADT differential on CR 19 and CR 4.
Ms. Campbell questioned why the noise standard was changed from commercial to residential,
at the hearing on July 31, 2019, and Chair Kirkmeyer clarified it was due to the surrounding, future
residential development.
F Jamie Jost, Jost Energy Law, requested a commercial or light industrial noise standard due
to the application purpose. Chair Kirkmeyer expressed her support of the commercial noise

standard due to the proposed use of the site. In response to Commissioner James, Mr. Gathman
clarified the noise standard for USR-589 is agricultural, and in response to Commissioner
Freeman, he stated the noise standard for USR18-0053 is commercial. After discussion, the
Board agreed to the commercial noise standard.
IE With regard to phasing the landscaping, Chair Kirkmeyer reiterated she was agreeable to
phasing Landscape Area Three, but feels Areas One and Two need to be completed immediately,
and Ms. Campbell agreed. Chair Kirkmeyer suggested deleting DS #22 (portable toilets), as the
applicant took the request for portable toilets out of the application.
e In response to Chair Kirkmeyer, Ms. Campbell indicated she had reviewed, and agreed to
abide by, the Conditions of Approval and Development Standards, as amended.
e No public testimony was offered regarding the changes made to the Conditions of Approval
and Development Standards.
e Commissioner Conway moved to approve the request of Crestone Peak Resource
Holdings, LLC, for a Site Specific Development Plan and Use by Special Review Permit,
USR19-0019, for Oil and Gas Support and Service (storage and staging yard for oil and gas
equipment along with an existing office/shop building, existing welding shop, existing equipment
storage building, existing field measurement and calibration building and up to twenty five (25)
cargo containers for storage of valves, fittings and electrical items) in the A (Agricultural) Zone
District, based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as amended. The motion was seconded by
Commissioner James, and it carried unanimously. Chair Kirkmeyer thanked the applicant for
presenting an acceptable plan for landscaping and screening, and for removing the portable
toilets from the application. There being no further discussion, the hearing was completed at
10:53 a.m.
