USR19-0055, FOR A 280 -FOOT TALL TELECOMMUNICATION ANTENNA TOWER IN
THE A (AGRICULTURAL) ZONE DISTRICT — WELD COUNTY
A public hearing was conducted on November 27, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated October 14, 2019, and duly published
October 18, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request
of Weld County, for a Site Specific Development Plan and Use by Special Review Permit,
USR19-0055, for a 280 -foot tall Telecommunication Antenna Tower in the A (Agricultural) Zone
District. Karin McDougal, Assistant County Attorney, made this a matter of record.
El Michael Hall, Department of Planning Services, presented a brief summary of the proposal,
stated the new tower will replace an old tower, it will provide infrastructure for enhanced public
radio systems, and will be owned and operated by Weld County. He described the landscape
below the tower and fence surrounding the compound, and explained the Fall -Zone Easement
agreement had been drafted. He indicated there will be no outdoor storage and stated Tom Parko,
Director of the Department of Planning Services, had agreed to the early release of the Building
Permit, which has been issued. He mentioned no correspondence had been received regarding
the application, nine (9) referrals were sent out, and five (5) agencies responded. He indicated a
partial vacation map may be needed, described surrounding uses, and entered the favorable
recommendation of the Planning Commission into the record as written. He displayed images of
the site and surrounding views, and in response to Commissioner Moreno, Mr. Hall clarified the
proposed height of the new tower.
El Evan Pinkham, Department of Public Works, provided a brief overview of the transportation
plans and requirements, stated the access is on County Road (CR) 105, indicated there are no
traffic counts in the area, and stated the site meets a drainage exception.

Lauren Light, Department of Public Health and Environment, stated the use of a portable
toilet is acceptable during construction and indicated Development Standards (DS) #14-19
address Environmental Health items.
• Mike Wallace, Director of the Department of Public Safety Communications, described the
importance of the tower and indicated the Fall -Zone Easement agreement is currently being
negotiated with the property owner.
No public testimony was offered concerning this matter.
• Per Mr. Hall, the current Condition of Approval (COA) #1.A should be split into two (2)
separate Conditions with COA #1.A reading, "The applicant shall submit a copy of the recorded
fall -zone easement agreement, if applicable", the a new COA #1.B should start with "There is a
Use by Special Review Permit...", and suggested deleting the old COA #1.B (submittal of access
agreement), as the USR15-0063 boundary map excludes the parcel the tower is on. Chair
Kirkmeyer suggested adding "if applicable" to COA #1.C.6 (show and label the location of the
recorded fall -zone easement), deleting DS #13 (maintenance of on -site drainage related
features), as Weld County is responsible for the maintenance, adding "and shall be screened' to
DS #17 (portable toilets), and adding "attempted to be" to DS #18 (fugitive dust). The Board
agreed to all of the aforementioned changes.
▪ In response to Chair Kirkmeyer, Mr. Wallace indicated he had reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as amended.
No public testimony was offered with regard to changes made to the Conditions of Approval
and Development Standards.
se Commissioner Moreno moved to approve the request of Weld County for a Site Specific
Development Plan and Use by Special Review Permit, USR19-0055, for a 280 -foot tall
Telecommunication Antenna Tower in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner
Freeman, and it carried unanimously. There being no further discussion, the hearing was
completed at 10:25 a.m.
