HomeMy WebLinkAbout20190952.tiffHEARING CERTIFICATION DOCKET NO. 2019-25 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0121, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT — KEVIN AND KATHRYN BEILAND A public hearing was conducted on March 13, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Selena Baltierra Assistant County Attorney, Bruce Barker Planning Services Department representative, Maxwell Nader Public Works Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated January 28, 2019, and duly published February 1, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Kevin and Kathryn Beiland, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0121, for one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. El Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal and indicated the second dwelling will be used for family, a caretaker, or possibly a rental home. He stated the approximate 3.57 -acre site is located in the A (Agricultural) Zone District, mentioned the site had an active zoning violation, ZCV18-00184, and indicated the access is used by three (3) other properties. Mr. Nader stated no correspondence has been received from surrounding property owners (SPO) and mentioned 11 referrals were sent out and nine (9) agencies responded without concern. He indicated the site is located within the three (3) mile referral areas of the Towns of Firestone and Frederick, both of which had no concerns. He displayed a map of the site and described the city limits, zoning, and uses in the surrounding area. He stated there is a barn with an apartment inside, which is being used as the primary residence, and entered the favorable recommendation of the Planning Commission into the record as written. Hayley Balzano, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, and stated access for the site is in the Town of Firestone's GG Pt-CM()TP), P JCHt3N,c,(-ICLL) oci/0D/19 2019-0952 PL2673 HEARING CERTIFICATION - KEVIN AND KATHRYN BEILAND (USR18-0121) PAGE 2 jurisdiction. She indicated no tracking control will be required and the site meets an exception from Stormwater Detention. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and stated water will be provided by a domestic well and is permitted for two (2) single-family homes. She mentioned the existing residence is served by a septic system permitted for three (3) bedrooms, stated the septic system will need to be brought into compliance, and indicated there are two (2) Development Standards (DS) to address water and sewer. Kevin and Kathryn Beiland, applicants, explained their current living situation and stated the existing residence on the property is uninhabitable. In response to Chair Kirkmeyer, Ms. Beiland indicated they have lived on the property for two (2) years. • No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Ms. Beiland indicated they had reviewed the Conditions of Approval and Development Standards, as presented. In response to Chair Kirkmeyer, the applicants indicated they understood the USR approval does not create a separate lot for the two (2) homes and would not constitute a lot split in the future. • Commissioner Freeman recommended deleting DS #8, and the Board agreed. • In response to Chair Kirkmeyer, Mr. and Ms. Beiland agreed to abide by the Conditions of Approval and Development Standards, as amended. • Commissioner Conway moved to approve the request of Kevin and Kathryn Beiland for a Site Specific Development Plan and Use by Special Review Permit, USR18-0121, for one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously.
