Pursuant to the Application filed by Dorrance, Applicant intends on constructing a 4,500 square foot shop on Lot D of RECX 18-0023 located in the NE 1/ of Section 4, Township 7 North, Range 67 West of the 6th P.M. ("Dorrance Property"), to be used to store equipment and vehicles for their concrete business. Because of the proximity of the Dorrance Property to both the Pierce Lateral Ditch and the inlet ditch for the Black Hollow Reservoir, the Companies want to ensure that any changes made to the Dorrance Property, including the construction of the proposed shop, will not impact the historical drainage from the property. Based on the Companies' review of the "Drainage Narrative" prepared by Agprofessionals, the Companies do 1 not expect that the proposed improvements on the Dorrance Property will have any measurable effects upon the Companies' structures or the historical drainage. It's a tough situation, because I am the one that has to live next to this commercial shop in my backyard. The most important issue to me is the buffer. I would rather push for the buffer zone and come to an agreeance with the applicant, than push my luck and have concrete trucks to look at out my back patio. The applicant has said several times that If I gave him $50,000 that he would move the shop. As stated earlier a 300ft REA pole is $2500, so you can see what I am dealing with. He also stated that if he could drill a well and have access off of 19, that he would put the shop on CR19. I am not against this business at all. I would just like to come to some sort of agreeance, that creates a little separation between my home and his business. This shop will house equipment, supplies and four (4) commercial pickup trucks. Up to four (4) other commercial vehicles. two (2) of which may be heavy commercial vehicles, will be stored outside The proposed location is within three hundred (300) feet of a neighboring residence. The applicants have been in communication with the neighbor and have proposed a landscaping buffer and facing the doors of the shop to the south, away frorr he neigloring property. to minimize negative impacts. , Three (3) phone calls were received from two Surrounding Property Owners with concerns of having a commercial business being located too close to his house. View contamination. The shop would contaminate the lake view for three neighbors to the west of the proposed USR. Bring this up at the hearing and have an acceptable solution to suggest to the BOCC. Setbacks. What is the required setback for a commercial building next to a single family home? Same as any building in the Ag zone 1 foot for every three feet of building height. We require industrially zoned properties to be buffered (at least 15' landscaping) from residentially zoned properties, but this doesn't apply to mutually A -zoned properties. The Policy of Weld County shall be to pursue a jurisdictionally unified drainage effort to assure an integrated drainage system and to cooperate with other regional and local planning agencies on drainage matters. B. For new development, the Policy of Weld County is to prohibit un-detained discharges to roadside ditches located in the County right-of-way unless granted by a variance. C. Except as set forth below, the Policy of Weld County shall be to require regional and/or on - site detention for all future developments. Temporary or interim detention/retention may be required if the downstream regional facilities have not yet been constructed per the applicable master plan for that location. Stormwater retention facilities are normally not allowed in Weld County, but will be considered for special circumstances. D. The Policy of Weld County is to require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas and the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON - URBANIZING areas. Historic is defined as an undeveloped site with a 2.0% imperviousness. If the urbanizing jurisdiction has adopted a different historic runoff rate than that stated in this subsection, then the urbanizing jurisdiction runoff rate shall apply. E. Weld County will not accept any detention or retention pond that does not drain in less than 72 hours, causes injury to water rights, or is in violation of state or federal law. Upon evaluation, improvements may be necessary to downstream capacity. F. Exceptions. 1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property. Exceptions shall be supported with an approved drainage narrative which must describe, at a minimum: • List which exception shown below is being requested for consideration. • Where the water originates if it flows onto the property from an offsite source. • Where it flows as it leaves the property. • The direction of flow across the property. • If there have been previous drainage problems with the property. Exceptions to the stormwater detention shall be limited to the following: a. No stormwater detention will be required for sites that meet any of the following conditions. Individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. 13) A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is allowed a onetime exception for a new 1,000 sq. ft. building or equivalent imperviousness. 14) A parcel greater than 5 gross acres in size is allowed a onetime exception for a new 2,000 sq. ft. building or equivalent imperviousness. 15) Concentrated Animal Feeding Operation (CAFO), Animal Feeding Operations (AFO) and Housed Commercial Swine Feeding Operation (HCSFO) which are covered and approved by the Colorado Discharge Permit System (CDPS) regulations.
