The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for any use
permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial
Zone Districts, (outdoor storage of RVs, ATVs, boats, campers, trailers, and vehicles) provided that the
property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District.
This project is north of and adjacent to CR 74 and is west of and adjacent to CR 45.
Parcel number 070934400042.
Access is from CR 74.
ACCESS
Weld County Public Works has reviewed the application materials related to access, and accesses for the
residential use, and the outdoor storage facility shall be shared.
Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County
maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying
out your site plan to ensure the approved accesses are compatible with your layout. Per Chapter 12, Article
V, Section 12-5-30. F, when feasible, there shall be no net increase in the number of accesses to a public
road. Minimum access spacing widths are shown in Weld County Code Appendix Table 12A-2. Please refer
to Chapter 12 of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 74 is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified
it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23, Article III,
Section 23-3-50, the required setback is measured from the future right-of-way line. Be aware that physical
roadways may not be centered in the right-of-way. This road is maintained by Weld County.
County Road 45 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated. Pursuant to the definition of setback in the Weld County Code, Chapter 23, Article III, Section
23-3-50, the required setback is measured from the future right-of-way line. Be aware that physical
roadways may not be centered in the right-of-way. This road is maintained by Weld County.
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 74 counted 2063 vpd with 23% trucks. The 85th percentile speed is 61 mph.
ITE manual for mini warehouse is .25 trips per storage space, so Public Works is estimating 25 round trips
per day for this site.
The traffic narrative is as follows:
1. It is hard to estimate the amount of traffic in and out of the storage facility. It will vary based on the number
of spots that are rented. There would be very few round trips in one day, however, because most people
will use their RV/Boat etc. for more than one day.
2. The expected travel routes would be one of only two ways; coming from the East on CR 74 or coming
from the West on CR 74.
3. I estimate that 85% or more of the traffic to the storage site will come from the West, as it is more
populated with less places to store their "toys". That leaves an estimated 15% of traffic coming from the
East.
4. I expect Friday afternoon/ night and Sunday afternoon/ night to be the busiest because common sense
would say that most people will use what they are storing at the beginning of the weekend and bring it back
at the end. I expect holiday weekends to be busier than a normal weekend as well.
5. Access for the proposed storage will be a shared access to the West of lot C that already exists. The
plan when purchasing lot C from Groves Farm will be that they will retain approx. 50' along the border for
access to Lot D.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly maintained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Public Works for review and consideration.
This site requires double cattle guards and 100 ft. of asphalt or 300 ft. of asphalt.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Public Works may require an Improvements Agreement for one or all the following reasons:
• Off -Site Public Improvements
• Road Maintenance Agreement
• Construction Maintenance Agreement
• Access Improvements Agreement
An Improvements Agreement is required for sites with required off -site improvements per Chapter 12,
Article 5, Section 12-5-60. Collateral is required to ensure the improvements are completed, and
maintained.
Improvements/Road Maintenance Agreement: An example agreement is available at:

haul route(s), outline when off -site improvements will be triggered, and include a maintenance agreement
for the haul routes. Possible mitigations included in the road maintenance agreement may include but are
not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
Detention pond waived and a simple drainage narrative:
The applicant has submitted a drainage narrative stating that the site meets drainage exception 23-12-
30.F.1.a.10 for NON -URBANIZING areas where the total project stormwater runoff does not exceed 10
cubic feet per second (cfs) for the 1 -hour, 100 -year storm event.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
MS4
This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized
area with state mandated, higher water quality requirements
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. An Improvements and Road Maintenance Agreement is required for off -site improvements at this
location. Road maintenance includes, but is not limited to, dust control and damage repair to specified
haul routes. The Agreement shall include provisions addressing engineering requirements, submission
of collateral, and testing and approval of completed improvements. (Department of Public Works)
B. The plan shall be amended to delineate the following:
1. County Road 74 is a paved road and is designated on the Weld County Functional Classification

3. Show and label the approved access locations, approved access width and the appropriate turning
radii (60') on the site plan. The applicant must obtain an access permit in the approved location(s)

4. Show and label the approved tracking control on the site plan. (Department of Public Works)
5. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled

7. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for any Use Permitted as
a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or
Industrial Zone Districts, (outdoor storage of RVs, ATVs, boats, campers, trailers, and
vehicles) provided that the property is not a lot in an approved or recorded subdivision
plat or lots parts of a map or plan filed prior to adoption of any regulations controlling
subdivisions in the A (Agricultural) Zone District.
A well permitted for ordinary household purposes and watering of domestic animals
(permit ) and a septic system sized for three bedrooms (SP -0600325) serve the existing
residence. The residence will not be used for the business.
Portable toilets and bottled water can be utilized for the business in accordance with EH
policy. If the number of personnel on site exceeds 10 customers per day and 2 full-time
employees, permanent water and sewer facilities are required.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential

nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
5. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Onsite Waste Water Treatment Systems.
6. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times. For 10 or less customers or visitors per day,
and 2 or less full-time employees on site, portable toilets are acceptable. Records
of maintenance and proper disposal for portable toilets shall be retained on a
quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed
in Weld County, contain hand sanitizers and be screened from existing adjacent
residential properties and public rights -of -way.
8. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Dear Mr. Hall:
We have reviewed the above referenced proposal for a site -specific development plan and use
by special review. The submitted material does not appear to qualify as a "subdivision" as defined in
Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March
11, 2011 memorandums to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments will not address the adequacy of the
water supply plan for this property or the ability of the water supply plan to satisfy any County
regulations or requirements.
The subject property contains a single family residence, a chicken coop, two equipment sheds,
a barn, and an out building on the SE -1128 parcel. Lots C Et D of Recorded Exemption RE -4777 are
pastureland. The application proposes to develop the pastureland into an outdoor storage area for
boats, RVs, ATVs, etc. The ground surface would be covered with a road base/gravel mixture.
Lot SE -1128 contains an existing well with permit no. 314251-A. Well permit no. 314251-A was
issued pursuant to Section 37-92-602(3)(c), C.R.S. for the replacement of an existing well historically
serving one single family dwelling, fire protection, the watering of domestic animals and poultry, and
the irrigation of not more than one acre of home gardens and lawns. The water supply for the outdoor
storage business would be bottled water and a portable toilet.
A Water Quality Capture Volume pond for treating and controlling storm water runoff is
proposed to be located on the western edge of Lot C RE -4777. A drainage narrative submitted by Mark
Taylor, P.E. was included as part of the application, and was prepared in accordance with the
provisions of the Weld County Storm Drainage Criteria. The applicant should be aware that, unless the
structure can meet the requirements of a "storm water detention and infiltration facility" as defined
in Section 37-92-602(8), C.R.S., the structure may be subject to administration by this office. The
applicant should review the Division of Water Resources Administrative Statement Regarding the
Management of Storm Water Detention Facilities and Post-Wildland Fire Facilities in Colorado,
available on our website, to ensure that the notification, construction and operation of the proposed
structure meets statutory and administrative requirements. The detention pond must be operated
solely for storm water management and be subject to oversight by a governmental entity (i.e., required
as part of a permitting process). Further, it must release or infiltrate at least 97 percent of all of the
water from a rainfall event that is equal to or less than a five-year storm within 72 hours of the end

as quickly as practicable, not to exceed the release or infiltration of 99 percent of all water within 120
hours of the end of the rainfall event. The detention pond must operate passively, not expose ground
water, and not subject the storm water runoff to any active treatment process. In addition, for
detention facilities constructed after August 5, 2015, the operator must submit notice of the proposed
detention facility to the Substitute Water Supply Plan Notification List. The applicant is encouraged
to use the Colorado Stormwater Detention and Infiltration Facility Notification Portal, located at
https://maperture.digitaldataservices.com/gvh/?viewer=cswdif, to meet the notification
requirements.
This office has no objection to the proposed site specific development plan so long as the
existing well is operated in accordance with the terms and conditions of permit no. 314251-A and is
not used in support of the commercial business (including by any employees not living onsite). Should

7 Pursuant to Construction Rule 6.2..2.1 (2 CCR 402-2), licensed or private drillers and pump installers must provide advanced

NOTE: This permit will expire on the expiration date unless the well is constructed IN that date. A Well Construction and Yield
Estimate Report (GWS-31) must be submitted to the Division of Water Resources to verify the well has been constructed. An
extension of the expiration date may be available. Contact the DWR for additional information or refer to the extension request

This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not
ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking
relief in a civil court action.
