RE: APPROVAL OF RECORDED EXEMPTION NO. 321 - JACOB AND NATALIE
FOOS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 15th day of May, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 321 , being the property of
Jacob and Natalie Foos, described as the SIISE' of Section 28,
Township 8 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows:
A tract of land being the South Half of the Southeast
Quarter of Section 28, Township 8 North, Range 65 West
of the Sixth Principal Meridian, Weld County, Colorado
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Jacob and Natalie Foos , be and hereby is,
exempt from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended.

Dear Commissioners :
The attached application, plat and related materials are in reference
to a request by Jacob & Natalie Foos for a recorded exemption. The
parcel of land on which this request has been made is described as
the S'SE4 Section 28, T8N, R65W of the 6th P.M. , Weld County, Colorado.
The property contains 80 acres of Class I and II irrigated soils. The
request is to split the property into parcels of 70 . 00 acres and 9 . 193
acres . The property is located 5 miles southeast of Pierce.
As indicated in a letter dated April 12 , 1978, submitted by Mr. Foos,
he can no longer operate the farm. Mr. & Mrs . Foos wish to retain
possession of the existing residence and improvements and continue
to live in the country.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The proposed split conforms with the intent clause of the Recorded
Exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the use will be compatible
with the surrounding agricultural uses . The request will allow
agricultural and related uses to be the predominant land use.
2. The request complies with the provisions of Section 9-4 (A) of the
Weld County Subdivision Regulations .

The enclosed application is submitted for your evaluation
with reference to its compliance with County and State
Health Department Regulations . If additional information
is required for such evaluation , please notify our office
as soon as possible . In addition , we would request that
your office notify the Department of Planning Services of
any permits required by County and/or State Health Depart-
ment Regulations with reference to the proposed use , so
that the applicant can be made aware of such requirements.
