Dear Planning and Zoning Department:
Please accept this letter as part of our Use by special Review Application for evidence of adequate water
supply and sewage disposal.
The water will be supplies by North Weld Water District as they have a main lure running East and West
in Highway 14 to the North side of our property. At this time, North Weld Water District will not provide
us with a letter of intent to connect.
The sewage disposal will be supplied by a septic system. At this time, we have not applied for a septic
permit. Once we receive approval of our USR we will submit for the septic permit,
please contact us with any questions you may have.

WHEREAS, the District is a legally formed water district in. Weld and Latimer C ounlies, Colorado a r5}LVAS,the
Second Party is desirous of purchasing a water tap from said District, assigned meter/account rumbelocated

Colorado; NOW, THEREFORE, in consideration of the premises and the terms of this Agreement, it is mutually agreed as
follows:
1. Second Party. agrees to purchase one water tap, with a Class of I _ from the District at the base rate of 1,500,00 per

The District shall furnish 70% of anacre foot 2 r ,.Thousand gallons) of water per tap per annual water year, if the allotment
for Colorado -Big Thompson (CB project water,, which is determined by the Northern Colorado Water Conservancy District, is
50% or greater. North Weld county Water District will restrict the delivery as necessary- when the CBT allotment is less than 50%.
3. Further, in the event the Second Party desires to sell any water rights, including but not limited to Colorado — Big Thompson.
Project. Water, attached to their property for irrigation;they hereby agree to give the District, the first option to purchase said water,
at the then market price, and to execute all necessary documents in connection therewith, including documents for the transfer of
any such water.
4. Further, Second Party agrees to pay all costs and charges as set by the District.
S. The District shall use reasonable diligence to provide a constant and uninterrupted supply of water, except for interruptions due
to: (1) Uncontrollable forces; () Operations or devices installed for water system protection; (3) Maintenances repair, replacement,
installation of equipment, or investigation and inspection of the water system, which ora

The District strongly recommends that a preventative plumbing device .is installed to restrict and/or release the pressure
within the customer's system ifmaximum operating pressure is greater than 80 psi.
If damage results from excessive pressures, North Weld County Water District clait.rns no liability..
7. It is further mutually agreed that this Agreement shall extend to and be binding upon the heirs, executors, administrators and
assigns of the parties hereto.
