RE: APPROVAL OF AMENDMENTS TO DEVELOPMENT STANDARDS FOR COM-
MERCIAL UNIT DEVELOPMNET PLAN FOR LAND LOCATED IN PART
OF SECTION 23, TOWNSHIP 1 NORTH, RANGE 68 WEST OF THE
6TH P.M. , WELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 24th day of October, 1979
at the hour of 9 : 00 o'clock a.m. for the purpose of hearing the
application of Craig Althen, et al. , for approval of amendments
to the development standards for a Commercial Unit Development
Plan on the following described property:
Part of the South Half of the Southwest
Quarter of Section 23, Township 1 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado.
WHEREAS, evidence was presented in support of the approval
of the amendments to the development standards for a Commercial
Unit Development Plan, and
WHEREAS, Section 6. 6 of the Weld County Zoning Resolution
authorizes the Board of County Commissioners to approve amend-
ments to the development standards for a Commercial Unit
Development Plan upon a showing by the Petitioner of compliance
with all of the requirements of Section 6 . 6 of the Weld County
Zoning Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those
present, has studied the request of the petitioners and the
recommendations of the Weld County Planning Commission and all
of the exhibits and evidence presented in this matter and having
been fully informed, is satisfied that the request for approval
of amendments to the development standards for a Commercial
Unit Development Plan upon a showing by the Petitioner of com-
pliance with all of the requirements of Section 6 . 6 of the
Weld County Zoning Resolution, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those
present, has studied the request of the petitioners and the
recommendations of the Weld County Planning Commission and all
of the exhibits and evidence presented in this matter and
having been fully informed, is satisfied that the request for
approval of amendments to the development standards for a
Commercial Unit Development Plan complies with all of the condi-
tions set forth in Section 6 . 6 of the Weld County Zoning Resolu-
tion.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Craig
Althen, et al. for approval of amendments to the development
standards for a Commercial Unit Development Plan on the tract
of land set forth above be, and hereby is, granted subject to
the following:
1. The development standards contained in the
Unit Development Plan.
2. The applicants submitting an amended unit
development plat with the new development
standards shown on the plat for the purpose
of recording it in the Clerk and Recorder's
Office. The plat shall be delivered to
the office of the Department of Planning
Services.
3. No additional building or electrical per-
mits shall be issued on the Unit Development
area until the development standards for
the Unit Development have been placed
on the amended Unit Development Plat and
said plat has been delivered to the office
of the Department of Planning Services and
until such time that a new letter of
credit is approved by the Board of County
Commissioners of Weld County, Colorado.

BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Planning Commis-
sion recommendations dated October 16 , 1979 be, and hereby are,
adopted as the findings of fact of the Board of County Commis-
sioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
October, A.D. , 1979 .

Amendments to Development Standards for Commercial Unit Development
Pt . SzSW* Section 23, T1N, R68W
To be recommended favorably to the Board of County Commissioners for
the following reasons :
1. It is the opinion of the Planning Commission that the requested
changes do not substantially differ from what was originally ap-
proved by the Board of County Commissioners.
2. This request is in compliance with Section 6.6, Unit Development
Standards of the Weld County Zoning Resolution.
3. This request will clarify the permitted uses on the site and how
the review of the permitted uses will take place.
The Planning Commission recommendation for approval is conditional
upon the following:
1. The attached Development Standards being adopted for the Unit
Development area.
2. The applicant submitting an amended unit development plat with
the new Development Standards shown on the plat for the purpose
of recording it in the Clerk and Recorder ' s Office. The plat
shall be delivered to the office of the Department of Planning
Services.
3. No additional building or electrical permits shall be issued on
the Unit Development area until the Development Standards for the
Unit Development have been placed on the amended Unit Development
Plat and said plat has been delivered to the office of the
Department of Planning Serviges

DEVELOPMENT STANDARDS
1 . The permitted uses on the hereon described property within the
Commercial Unit Development shall be those uses as listed in the
Commercial Zone District of the Weld County Zoning Resolution adopted
by the Weld County Board of County Commissioners.
2 . Agricultural production will be permitted. If agricultural production
is not pursued on all or any portion of the Commercial Unit
Development that portion not in agricultural production shall be
maintained in a manner so as to prevent fugitive dust, erosion,
growth of noxious weeds, and non-ornamental ground cover shall not
exceed 12 inches in height.
3 . Access to property to be limited to two (2) from Frontage Road
(County Road 9) and one (1) from County Road 6 as shown on the
drawings.
4. Maximum height of buildings shall be 40 feet.
5 . Minimum front setback shall be 50 feet. Side and rear setbacks shall
be in compliance with Weld County Requirements for commercial zoning.
6. Lighting shall be of the mercury vapor type. Lighting plan, when
developed, shall be submitted to the County, the State Highway
Department, and all affected power and utility companies for approval .
7. No fencing shall be permitted along the right-of-way of the Bull
Canal as requested by the Farmers Reservoir and Irrigation Company.
Fencing permitted along lot lines shall be chain link.
8. All interior roads to be private, maintained at owners expense and
constructed to Weld County Standards.
9. Signs shall be limited to two (2) for overall site and one (1) per
individual site. Signs shall conform with State Highway recommendations
regarding lighting size and be in compliance with the requirements
of the Weld County Zoning Resolution.
10. Acceptability of sewage systems in the Commercial Unit Development
area shall be subject to the approval of the Weld County Health
Department.
11 . The recommendations of the Subsurface Rock Stability Report by Fox
and Associates, Inc. dated January 4, 1974 and addendum report dated
January 22, 1974 , shall be part of the Development Standards.
12 . It is intended to use the water storage area both as a reservoir
for fire protection and a storage area for drainage. A detailed
drainage plan shall be submitted to the County Engineer for approval
at the time the site plan is reviewed by Weld County.
13 . All fire protection facilities, including hydrants , shall be located
in accordance with the recommendations of the Dacono Area Fire
Protection District as defined by letters from such District dated
April 20, 1976 and April 7 , 1974 and on file with the Weld County
Department of Planning Services . Compliance will be reviewed at the
time of the site plan review.
14. Information pertaining to "kip loadings" of piers shall be submitted
to the Director of the Building Inspection Division prior to the
issuance of any building permit for construction within the
Commercial Unit Development area.
15 . A final site plan for each lot within the Commercial Unit
Development shall be reviewed by the Board of County Commissioners
for their approval . Any changes of use on a lot which has been
approved in a final site plan review shall be subject to review
again for the new use. The final site plan review shall include the
following:
a. Identification in detail of the proposed use;
b. The number, type, and frequency of traffic generated;
c. A drainage study for the lot;
d. The number of employees;
e. Indication of the location of the proposed access ;
f. Indication of landscaping proposed;
g. Information on what provisions shall be made for fire
protection so it will be in compliance with #13 above.
h. Indication of the water requirements of the proposed use; and
i . Indication of the sewage requirements and details on the
proposed system.
This required information shall be submitted in a combination of
written and map form utilizing the Weld County PUD guidelines.
The final site plan map shall be recorded in the Weld County
Clerk and Recorder ' s office.

EXISTING DEVELOPMENT STANDARDS
1 . Permitted uses shall be Commercial Use as follows : (Permitted
uses shall be subject to review and approval by Weld County
Commissioners on each site prior to construction. )
A. Permitted - Cabinet making and carpenter shop; frozen food
locker; manufacture of handi-craft products;
printing and publishing establishment;
upholstery shop; veterinary hospital; plumbing
and tin shop (all storage enclosed) ; storage
warehouse (excluding oil, gasoline and petroleum) ;
machine shop.
B. Following subject to water requirements being met:
Bakeries; bottling works; cleaning and drying
establishments; dairy processing and distribution
plants; laundries
2. No interim land use is contemplated.
3. Access to property to be limited to two (2) from Frontage Road

Pursuant to your above referenced credit letter, the Board of County
Commissioners of Weld County must take formal action to reduce the
amount. The former Letter of Credit #146-A was for $13,100.00.
It would be appropriate for you or your client to forward a certified
statement of improvements made in the subdivision along with the
revised letter of credit so that the Board may make a determination
regarding acceptance of the new letter and the amount. As soon as
we have received such information, the matter will be scheduled
before the Board for appropriate action.
