RE: CONSIDER CERTIFICATION TO THE WELD COUNTY TREASURER OF ZONING
VIOLATION PENALTIES AS SPECIAL ASSESSMENT - JOSE SANTOS LOPEZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, on behalf of the Weld County Department of Planning Services,
filed a complaint in the Weld County Court against Defendant Jose Santos Lopez, claiming that
Defendant's property is in violation of the Weld County Code, and
WHEREAS, the County Court found the Defendant's property to be in violation of the Weld
County Code, and
WHEREAS, Defendant failed to bring the property into compliance with the Weld County
Code, and upon Weld County's motion, the County Court ordered Defendant to pay $100.00 per
day that the property remained in violation of the Weld County Code, beginning on February 25,
2019, and
WHEREAS, C.R.S. §30-28-124.5(1) and Weld County Code Section 23-10-40.A allow
these costs to be assessed against the property and collected as a special assessment by the
Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, hereby approves the Certification of $9,600.00 to the Weld County Treasurer
to be collected as a special assessment for the daily violation penalties from February 25, 2019,
to May 31, 2019.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 19th day of June A.D., 2019.

To Whom it May Concern:
This letter is being sent as a courtesy to remind you that the Division C Magistrate ordered a daily penalty of
$100 on February 25, 2019, which is still accruing. As of the date of this letter, the penalty accrued has
reached and an additional $7500 (02/25/2019 - 5/10/2019 = 75 days x $100 daily).
To bring the property into compliance, the following actions shall occur:
1.) All commercial operations and associated storage shall be removed from the property or a
COMPLETE Use by Special Review (USR) application shall be submitted to the Department of
Planning Services for processing.
2.) The Noncommercial Junkyard consisting of Derelict Vehicles, automobile parts, iron/metal
and miscellaneous debris shall be restored, removed or completely Screened from all adjacent
properties and public rights -of -ways.
3.) You shall contact my office as soon as you feel you have brought the property into
compliance with items 1 & 2 above. Until such time the daily penalty shall continue to accrue
in accordance with the court order (17-C-37482).
