This letter is in response to a request for water service to serve the following property described as follows:
PT NE4 5-4-65 LOT B REC EXEMPT RE -3703 (2.04R)
Parcel 105505100035
Water service can be made available to the above described property provided all requirements of Central
Weld County Water District, Northern Colorado Water Conservancy District and the U. S. Bureau of
Reclamation are satisfied. Central Weld County Water District will require that a Tap Agreement be
consummated prior to the setting of a tap or this letter shall become null and void unless extended in writing
by the District. Subdivisions requiring 9 or more taps will be required to purchase and transfer raw water
prior to District approval. Please note that it is your responsibility to contact Northern Colorado Water
Conservancy District at 800-369-7246 for petitioning; confirmation into the Northern Colorado Water
Conservancy District. Central Weld cannot issue a tap until all requirements are satisfied. This is in
accordance with the Rules and Regulations of Northern Colorado Water Conservancy District.
Due to the rapid cost increase of rat Water. existing tap fees may not apply for water service to this property.
The District will not notify, by separate letter. any prospective landowners or land purchasers of tap fee or
line extension cost increases. The cost of a tap fee and/or line extension will have to he paid in advance to the
District by the prospective customer in accordance with District policy within one (3) year from the date of
this letter,
It is your responsibility to confirm with your local Fire Protection Authority if fire flow water capacity is
required for your project.

Chris,
See the attached memo regarding CWCWD's water supply plan, as well as CWCWD's "can serve" letter for PUDK17-0002.
Because this is a PUD for nine lots, per the letter, raw water (likely CBT) will need to be dedicated to CWCWD. Dedication
can be delayed until PUD Final Plan, but must occur prior to recording the final plat. So this is fine to move forward
currently with Change of Zone. Let me know if you have any questions.

Good afternoon,
On June 15th I sent you an email regarding a nine lot subdivision being developed by Harry Strohauer and Dave Keiser. We have completed
all the items required to submit to Weld County with the exception of addressing your concerns. We would appreciate your help in determining
if there are any outstanding issues that we still need to address.
The original email read as follows:
We are attempting to address the Division of Water Resources concerns for the Union Estates Subdivision (file/121732, case #PUDK17-0002).
Ms. Williams, you asked that all correspondence be directed through Mr. Gathman so we are sending this email to you both.
An updated letter from Central Weld County Water District is attached. We hope that this letter will satisfy your concerns with the source of the
water supply.
Well permit 247906A indicates a well was drilled on the property in 2003. Although the well permit indicates the location of this well, there is no
well at this location. WCL Partnership owns the property and home directly to the south. We believe that the well was used by the home on the
WCL Partnership property and that the location on the records should have been further to the south. Please note that the abandonment report
dated 6/4/2003 was signed by Mike Lehan, General Partner for WCL Partership.
Well permit 384 -RR is an irrigation well that is UWAG approved. The quota for this well will be traded to another UWAG well owned by
Strohauer Farms. This well will not be used in any way o the Union Estates Property. This well will not be plugged and abandoned.

We have reviewed the materials received June 15, 2018 concerning the above referenced proposal to
subdivide 53.88 acres known as Lot B of the Recorded Exemption RE -3703 into 9 residential lots ranging
in size from 3.6 acres to 10.12 acres along with 2.22 acres of open space. We have previously provided
comments to this proposal by our letters dated June 11, 2008 and August 30, 2017.
Water Supply Demand
No information regarding the water supply demands for this PUD were provided to this office.
Source of Water Supply
The proposed water source is the Central Weld County Water District ("District"). An updated letter
from the District dated December 7, 2018 was included in the referral material. That letter notes that
water service can be made available provided all requirements of the District, Northern Colorado Water
Conservancy District and the Bureau of Reclamation are satisfied. We do not know if the applicant has
met these requirements.
The District provided information about their water supplies in June of 2012. They primarily rely on
Colorado -Big Thompson (C -BT) water to supply retail water customers. As of June 2012 the District
owned 5,370 C -BT units. The yield of C -BT units varies from year to year based on conditions and
storage. The dry year quota applied for District firm yield planning is 0.6, resulting in a water yield of
3,222 acre-feet per year. In most years, the District's water yield greatly exceeds the firm yield. In
addition, the District continues to develop additional water supplies, including participating in the
Northern Integrated Supply Project (NISP).
Water demands for the District's retail consumers have been around 3,900 acre-feet per year for the
last few years. Although, average water demand exceeds the firm yield water supply of the District, the
District has adopted a Water Shortage Contingency Plan (Plan) to reduce demand in dry years or under
system emergency conditions. For instance, the District initiates Stage 1 of the Plan under various
circumstances, including when the C -BT quota is less than 0.7. When Stage 1 is triggered, voluntary

reductions in water usage are expected to reduce demand by 10 percent. The Plan goes on to greater
stages of conservation including mandatory water use restrictions intended to reduce demand by 30
percent or more. Based on this information the District supply is expected to be adequate given the
District's adopted approach to maintain demand levels below the level of water supply available from
year to year.
In our previous letter dated August 30, 2017 we noted the existence of two wells operating under permit
nos. 247906-A and 384 -RR located on the property and requested clarification whether the wells wilt be
used in the subdivision or will be plugged and abandoned. According to the information provided,
although the permitted location of welt permit no. 247906-A places the well on the 53.88 acres, the well
is not located on the property, but on the property to the south. Therefore this well is not part of the
proposed development. Further, well permit no. 384 -RR is an irrigation well that is included in the Union
Ditch Well Users augmentation plan approved by the Division 1 Water Court in case no. 2003CW404 and
will not be used in any way in the subdivision.
State Engineer's Office Opinion
Based upon the above and pursuant to Section 30-28-136(1)(h)(I) and Section 30-28-136(1)(h)(II),
C.R.S., it is our opinion that the proposed water supply is adequate and can be provided without
causing injury to decreed water rights as long as the Central Weld County Water District commits to
provide water taps to the proposed lots. Our previous comments regarding any storm water
detention structure proposed for this planned development still apply.
