VRAIN COMPRESSOR STATION AND TERMINATING AT THE LATHAM PROCESSING PLANT, AND A 16 -INCH HIGH PRESSURE NATURAL GAS PIPELINE APPROXIMATELY 2.36 MILES IN LENGTH ORIGINATING AT THE HAMBERT COMPRESSOR STATION AND TERMINATING AT THE LATHAM CRYOGENIC PROCESSING PLANT) IN THE A (AGRICULTURAL) ZONE DISTRICT — KERR-MCGEE GATHERING, LLC A public hearing was conducted on February 20, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro -Tern Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Michael Hall Public Works Engineer representative, Mike McRoberts Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated January 11, 2019, and duly published January 16, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0094, for two (2) greater than 12 -inch High Pressure Natural Gas Pipelines (24 -inch high pressure natural gas pipeline approximately 9.86 miles in length originating at the St. Vrain Compressor Station and terminating at the Latham Processing Plant, and a 16 -inch high pressure natural gas pipeline approximately 2.36 miles in length originating at the Hambert Compressor Station and terminating at the Latham Cryogenic Processing Plant) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. tR Michael Hall, Department of Planning Services, presented a brief summary of the proposal and noted the application was processed under Weld County Code Section 23-2-490. He explained the project is for two (2) natural gas pipelines, provided the construction timeline, and mentioned the pipelines will be inspected during construction. He stated the pipeline crosses several County roads (CR) as well as the South Platte River and U.S. Highway 85. He indicated the pipeline is in the St. Vrain Creek and South Platte River floodplains, therefore, requiring a floodplain permit from the Department of Planning Services, as well as Right -of -Way (ROW) GG'• PL. Mr. Hall stated the pipeline is within the three (3) mile referral areas of the Towns of Gilcrest, Johnstown, Mead, Milliken, and Platteville, and no municipality returned a referral response. He displayed images of the pipeline, provided easement information, and described one (1) internal revision to the route. He stated Colorado Parks and Wildlife (CPAW) detailed potential biological concerns and recommended strategies to manage the construction schedule. He noted a Cultural Resource Inventory for a specific site assessment of the biological aquatic and cultural resources adjacent to the proposed pipeline route was submitted, and History Colorado did not return a referral response. He indicated 28 referrals were sent out, 11 responded without concern, and no correspondence were received from surrounding property owners (SPO). He indicated one (1) letter of opposition was received after the Planning Commission (PC) Hearing, and entered the favorable recommendation of the Planning Commission into the record as written. In response to Commissioner Conway, Mr. Hall clarified the letter of opposition is listed as Exhibit D. • Mike McRoberts, Public Works Engineer representative, provided a brief overview of the transportation plans and requirements, and stated the pipeline will be crossing 12 CRs and U.S. Highway 85, described the road classifications, and indicated access and ROW permits, as well as temporary tracking control and a Road Maintenance Agreement are required. He noted pipelines are excepted from the requirement of a drainage report and detention pond design, and described grading requirements. Mr. McRoberts indicated an oversight that will need to be addressed during discussion of the Conditions of Approval (COA). • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and indicated portable toilets can be used along the construction route. She stated Environmental Health (EH) has included their typical dust and waste items, described the requirements for an Air Emissions Permit, and noted Development Standards (DS) #15-21 address EH items. Samantha Petite, Anadarko Petroleum, represented the applicant and in response to Commissioner Conway, stated 100% of easements for the pipeline are in place. IR No public testimony was offered concerning this matter. • Ms. Petite stated she did not have any concerns or questions for the Board. Mr. McRoberts stated "CR 27' needs to be added in COA #1.K.9, and the Board agreed. Chair Kirkmeyer clarified for Commissioner Moreno the language in DS #9, and Mr. McRoberts stated COA #1.K.12 needs to include the words "either" and "or CR 21", and the Board agreed. In response to Chair Kirkmeyer, Ms. Petite clarified that there are no concerns regarding the crossing agreements and other conditions that would prevent them from completing the requirements in a timely fashion. • In response to Chair Kirkmeyer, Ms. Petite indicated they reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. 2019-0676 PL2636 HEARING CERTIFICATION - KERR-MCGEE GATHERING, LLC (USR18-0094) PAGE 3 Commissioner Moreno moved to approve the request of Kerr-McGee Gathering, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0094, for two (2) greater than 12 -inch High Pressure Natural Gas Pipelines (24 -inch high pressure natural gas pipeline approximately 9.86 miles in length originating at the St. Vrain Compressor Station and terminating at the Latham Processing Plant, and a 16 -inch high pressure natural gas pipeline approximately 2.36 miles in length originating at the Hambert Compressor Station and terminating at the Latham Cryogenic Processing Plant) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended. The motion was seconded by Commissioner Conway, and it carried unanimously. Commissioner Conway commented he was pleased the applicant came into the hearing with all easements acquired. The hearing was completed at 10:37 a.m. This Certification was approved on the 25th day of February, 2019.
