HomeMy WebLinkAbout20192594.tiffRESOLUTION RE: APPROVE REGISTRATION AND PAYMENT FORMS FOR COURT -ORDERED MONITORED SOBRIETY TESTING SERVICES AND AUTHORIZE DIRECTOR OF DEPARTMENT OF HUMAN SERVICES TO SIGN NECESSARY DOCUMENTS - WPCI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Registration and Payment Forms for court -ordered monitored sobriety testing services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and WPCI, commencing upon full execution of signatures, with further terms and conditions being as stated in said registration and payment forms, and WHEREAS, after review, the Board deems it advisable to approve said registration and payment forms, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Registration and Payment Forms between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and WPCI be, and hereby are, approved. BE IT FURTHER RESOLVED by the Board that the Director of the Department of Human Services be, and hereby is, authorized to complete and sign said registration and payment forms. Griego, Director, Human Services RE: Urgent Court Ordered Drug Testing - WPCI The Department of Human Services is requesting placement on the Board's July 8'2019 agenda for an urgent Weld District Court -ordered monitored sobriety service to be in place for a parent near Minden, NE, to ensure the respondent parent be tested for drug and alcohol abuse three times a week for 90 days. This matter arises out of a dependency and neglect case, where the child resides in Colorado and the parent resides in Nebraska. Child Welfare has identified an entity, WPCI, who is requiring the attached forms to be completed. This provider is the only local provider in the rural area of Nebraska. Legal has had the opportunity to review the documents, which outline the services and payment terms; however, a "Dispute and Resolution Procedure" is included, which does present a potential risk. Robin Cochran has communicated the preference is to have WPCI strike the indemnification, choice of law, and forum clauses, but the entity has refused. Therefore, due to the urgency and the serious nature of the allegations involving this case, the low risk of being sued for billing and payment issues will unlikely result in significant damages, if any at all. She has further indicated that the contract is not exclusive and could be terminated at any time. Ms. Cochran has recommended that if the community does not have other testing sites, then the Department should balance the need of the child to reside in a protective environment against the small risk of liability arising from the County's actions, which have been court ordered. Due to the low risk associated with signing the document, Legal has directed the Department to arrange placement on Monday's agenda.
