Yes everything has been inactivated. It was effective Dec. 29th. I submitted the pics and form the Laura. I think all I need
to do now is send you the affidavit for surrender form. I can email that now. You'll just need to write my Lic. no on the

Hi Kim,
I know that you are planning to finish the changes you need to make to Borderline this weekend so that Borderline is no
longer considered a public water system. I just wanted to be sure that you were aware that I recently accepted a new
position with CDPHE, and will no longer be handling drinking water systems as of December 31, 2018.

For now, Laura Cymansky (copied on this email) will be handling all of my systems. Please communicate with her
directly if you have any questions regarding the forms and pictures you need to submit in order for us to inactivate
the system. Also, note that my email regarding potential violations for failing to post public notice and to collect a fourth
quarter total coliform sample still applies; if we are not able to inactivate the system before our deadlines to issue these
violations (January 4 for public notice and February 11 for total coliform), you will likely receive violation letters.

As long as you still have a food license until December 29th, you can also serve alcohol until December 29th.
However, once I have received both your affidavit of surrender and your state and county liquor licenses, you
will no longer be permitted to operate.

Kim,
Thanks so much for sending this! I've made a note to check in with you at the end of the year / beginning of next year if
we haven't received anything from you yet.
I just want to point out again that until you've disconnected the sinks and submitted the inactivation form, we will
continue to regulate Borderline as a public water system, meaning that the December 24 deadline for posting public
notice for not having a certified operator and the fourth quarter total coliform sampling requirement still apply for
now. These are the only requirements for your system that have not yet been completed that are supposed to be done
before the end of the year.
If you do get the sinks disconnected and the form/photos submitted by the end of the year, these items won't be
important, since the system will be inactive before we would issue violations for either one. If there is a delay into next
year, however, you may receive violations for these items. These violations won't be important once the system is
inactivated, but I just wanted to be sure you were aware in case you do end up receiving violation letters.

I have final clarification from my supervisors regarding the next steps you need to take to report to us
that Borderline is no longer a public water system. I have listed them below:
1. You must physically disconnect your water system from the bathroom sinks. That means
severing the lines that provide water to these sinks in some way; a valve that prevents water
from flowing to these sinks when closed, but that can be easily opened, will not be enough for
us to consider the sinks physically disconnected from the water system.
2. At this time, we will not require that you physically disconnect the water system from the bar
and kitchen sinks. You can leave these sinks as they are; however, please note that you are
not allowed to use these sinks to serve water to your customers in any way. That includes
using the sinks to wash dishes, prepare food, make coffee, serve water or other drinks, or make
ice. That also includes offering the sinks to your customers for hand -washing or other hygiene
maintenance.
3. Once you have physically disconnected your water system from the bathroom sinks,
complete and submit the attached inactivation form. Please include photographs that show
how you physically disconnected the water system from the bathroom sinks. When you
complete this form, fill out Section I completely. Under Section II, check the circle next to
"Closure", and list the date you disconnected the sinks from the water system in the box under
"Date Inactivated". Under "Reason and Additional Information:", just explain that your
bathroom sinks can no longer provide water, and that you no longer hold retail food or liquor
licenses. You can ignore Section III.
Please respond to this email by Tuesday, December 11 with an estimate of when you will be able to
complete this. That way, I'll have an idea of when to check back. If you have any questions, please
don't hesitate to contact me.

that we regulate (to get out of our regulations) and then disallowed patrons from using the bathroom (which is ok since
they aren't regulated by us).
So looking at the Borderline situation. We would be fine with closing out their license provided that the bathrooms are
no longer made available to the general public.

Chloe and Cassie,
I was hoping to clarify a couple of things with you regarding Weld County's regulations in this case.
1.Borderline will not be renewing its liquor or food service licenses, so I assume they will not be required to have
hand -washing sinks in their building (restrooms or otherwise). Is that correct?
2.If that is the case, will Weld County impose any requirements regarding the existing access points for water from
Borderline's well? In other words, will Borderline need to remove or cut off water service to its restroom, bar,
and kitchen sinks in order to comply with county regulations as a business that does not serve food or drink?
On our end, we may allow them to simply shut off water service to their restroom sinks and to leave their
kitchen/bar sinks as -is (since the public does not have access to those sinks), but we will defer to your
requirements if they are more strict.

all points at which your customers might have access to the water. That means removing or cutting the water
supply to the sinks in your restrooms and, possibly, to the bar sink and the sinks in the kitchen that was being used. I
would guess that no sinks can be connected to the water supply in order for us to consider the system inactive, but I
will double check and get back to you.

Once there is no longer a water supply that is accessible to the public, I will ask you to complete and submit the
attached inactivation form, including pictures that prove that water is no longer accessible at the sinks. Please note
that until you cut the water supply and submit this form, we will continue to regulate Borderline as a public water
system; so, you may continue to receive notices, letters, and/or violations from us while you are making these
changes.
I will confirm all of this with my supervisors, and I will let you know if there is anything else that we need.

Surrender" Form and return it along with both your State and County Liquor Licenses. You can either mail the
form and licenses to the below address, or you can drop them off in office. Please be sure to complete the
affidavit in full and sign the bottom.
Please note: you are still required to adhere to all of the rules and regulations of your liquor licenses, including

Hi Kim,
Thanks for your note. In terms of avoiding further regulation as a public water system, you will still need to eliminate all
points at which your customers might have access to the water. That means removing or cutting the water supply to
the sinks in your restrooms and, possibly, to the bar sink and the sinks in the kitchen that was being used. I would guess
that no sinks can be connected to the water supply in order for us to consider the system inactive, but I will double
check and get back to you.
Once there is no longer a water supply that is accessible to the public, I will ask you to complete and submit the
attached inactivation form, including pictures that prove that water is no longer accessible at the sinks. Please note
that until you cut the water supply and submit this form, we will continue to regulate Borderline as a public water
system; so, you may continue to receive notices, letters, and/or violations from us while you are making these changes.
I will confirm all of this with my supervisors, and I will let you know if there is anything else that we need.

Maybe. Two things to consider- for us- are we talking bottled beer or dispensed from tap (ie. Bar). If bottled then I
think we could eliminate the retail food license.
However, that said, I don't believe that will get them out of the requirements for a public water system as then they still
meet the #'s threshold and they would need bathrooms for the public if drinking is occurring onsite.
If it is just a liquor store (buy bottled beer and leave) then maybe they could be out of the requirements.

They do have a license currently, but they are out of compliance with the state for not having a certified operator for
water treatment, so they are looking at all of their options for severing the well water lines if they cannot find an
operator. If they sever the lines, they will lose the food license which will affect their liquor license. We will certainly

As a Tavern (County) Liquor License holder, you are required to have "sandwiches and light snacks available
for consumption on the premises", C.R.S. Section 44-3-414. Sandwiches are defined as "single serving items
such as hamburgers, hot dogs, frozen pizzas, burritos, chicken wings, or items of a similar nature", and light
snacks are defined as "popcorn, pretzels, nuts, chips, or items of a similar nature," C.C.R. 47-100(J).
Please keep in mind that if you substantially change, alter, or modify your premises, you must submit the

After doing some research and discussing the situation with Dan, it will not be possible to continue the
use of the kitchen as a commissary without a certified operator for the water. Although the commissary
is not required to be licensed, it is required to be in compliance with the rules and regulations if used by
a licensed entity. This requires the water to meet the drinking water standards, and to also provide
restrooms for anyone utilizing the kitchen.
If you decide to sever the lines and discontinue the use of the kitchen as a commissary please let me
know. Make sure to also consider the requirements of your liquor license, which may require food to be
