Home My WebLink About730544 //IA RESOLUTION WHEREAS, a public hearing was held on May 29, 1973, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of James E. Miller, LaSalle, Colorado, requesting permission to locate a cattle feeding operation on the following described property, to-wit: The Southeast Quarter (SE-'-) and that part of the Southwest Quarter (SW-1) East of the Gil- more Canal in Section 13, Township 4 North, Range 65 West of the 6th P. M. , Weld County, Colorado, and WHEREAS, the petitioner was present, and WHEREAS, there was some opposition to the request of petitioner for the location of said cattle feeding operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (3)(c) of the Zoning Resolution of Weld County, said cattle feeding operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- money and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of James E. Miller, LaSalle, Colorado, for location of a cattle feed lot operation on the premises in- dicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said cattle feed lot operation and shall have up to one year from date hereof to begin construction . 3. That petitioner shall construct three (3) settling ponds as pro- posed and that each be of a capacity of not less than 6. 8 acre feet; additionally, that petitioner shall construct a sealed retention pond as proposed having a capacity of not less than 12. 4 acre feet. 4. Subject to a green belt being established along the east and south perimeters of subject property, thus screening off the county roads, number .1/4/ and 9 respectively with a suitable type of vegetation. A number of people who apply not only for zone changes , but also for land use permits begin construction on their projects before their actions are approved. The Board of Weld County Commissioners does not condone this and in cases where their application have been denied at the hearing, the applicants have had to remove their construction from the land. My decision regarding the Miller feedlot was based on facts presented at the hearing and a personal inspection of the site; I could find no grounds for a denial o£ the application. I am sure that if you were--in- my position you would hopefully • make your decisions based on facts and not on politics . My decisions are based on £act, Mr. Burke . It is unfortunate that your grandfather was not notified for we do require the Planning Commission_: to notify all property owners in the immediate area of hearings concerning land near them. Maybe he was not notified because of a technicality as to whose name the property is under and how it is shown in the files of our Clerk. and Recorders office. In reference to another statement in your letter, I would have no objection to the Grand Jury investigating the Board of Weld County Commissioners . That is the decision of the Grand Jury and they will' undoubtedly investigate all County departments . • I respect your feelings about my re-election also . Dear Mr. Billings , As you will recall from our appearance before the Board, last Tuesday , May 29 , in this matter, I represent Mr. Charles W. Easton, owner and operator of Easton-Valley View Airport, located north of the pro- posed feedlot in Section 12 . I hope the Board in its deliberations on this matter will bear in mind the following facts : 1. As Mr. Adolph Bohlender'testified, at least one superior alternate site is available, so that denial of this permit will not hamper the agricultural growth of Weld County. 2 . The "show of hands" vote taken among those present at your meeting was invalid because the vote of those opposed to the granting of the permit was limited by the Chairman to property owners in the immediate vicinity of the proposed feedlot, whereas no such restriction was placed on those voting in favor of the permit. In fact those voting in favor were almost entirely businessmen not living anywhere close to the proposed feedlot, and at least one did not even reside in Weld County. 3. The means by which the particular site was chosen calls into question the legality and validity of the Weld County Planning Commission's recommendation on the proposal. The land was offered for sale to applicant Miller by Planning Commission member Bill Elli tt at a STATE OF COLORADO , ss. This smacks of insider dealings and a breach of the public trust on the part of member Elliott and complicity on the part of his fellows on the Planning Commission. Surely a recommendation born and bred under such squalid circumstances is not one to which the Board of County Commissioners would wish to lend its seal of approval and so implicate itself in such shady dealings. 4. If the application for permit is approved, a conflict is inevitable between the feedlot operation and the agricultural aviation operations based at Easton-Valley View Airport, which is a pre-existing use having some 8 .years seniority. If the permit is granted, we plan'to undertake immediate litigation to enjoin construction of the feedlot and to obtain a judicial interpretation of the propriety of the Planning Commissioner's actions. COMMERCIAL CATTLE FEEDERS PHONE (303) 284-6443 LA SALLE, COLO. 80645 Reasons for a New Feed Lot We now operate a 20,000 head capacity lot West of LaSalle which is designed for finishing cattle for slau ghter. We would like to expend our operation in the near future so that we can further take advantage of our native cattle and also more fully utilize a crop that is grown in this irrigated area, corn silage. Also, we feel in order to stay competitive in the future, we are going to have to purchase lighter cattle and grow them and finish them in 7 or 8 months to stay economical. We can no longer compete economically for the yearling steer. Our plans, at the new oper- ation, are to strictly grow calves and as they reach the weight to start finishing they will be moved to the present location for the duration o£ the feeding period, What Kind Of Lot? This lot is going to be strictly a growing lot, therefor the facilities will be different than the average lot in a number of ways. Some of the major differences are: 1. There will be no milling facilities, just a small loading area for feed, 2. Cattle pens will be built with a lot of square footage per animal to prevent crowding of the calves. 3. Facilities must be kept extremely clean to prevent the spreading of diseases among the highly susceptible calves. 4. All facilities will be designed to handle roughage instead of grain. The lot itself will be on dryland ground which at the present time is not in high production. We feel that if we would have gone further south it would mean a greater expense, both for us and the feed producers in the area. As most people realize in hauling a feed commodity, such as corn ensilage, distance is a big factor in the cost of production. We also picked this location with reference to an adequate water supply. We will be adjacent to the Central Weld County Water District's soft water line which will be a big advantage for us and also for the District itself, The main reason we propose this site is that its location is in an outstanding farm community with a number of excellent farmers who are well established and are able to produce the kind of feed which a growing lot of this kind must have to survive. We are sure that we can be a big enough asset in the community that we can work with the farmers and help develop a better feed market. COMMERCIAL CATTLE FEEDERS PHONE (303) 284-6443 LA SAL,LE, COLO. 80645 Advantages For Community We realize there will be some people who feel that an operation of this nature will be a nuisance to the community and we do realize that there are certain times of the year when the odor problem may be a little uncomfortable but we feel one must take into consideration all the advantages it gives to a community. Namely: 1. A Feed Market. Its becoming a bigger problem all the time-- to cross Highway 85 and we feel this will give some of the people on the East side of 85 a closer, more accessible market, We will need approximately 30,000 Ton o£ corn ensilage per year, which is equivalent to approximately 1,500 acres, just for the new operation. This amount o£ silage represents $300,000 in roughage alone. We will also use a considerable amount of whole grain of which about 25% will come from the immediate community. 2. Taxes, At the present rate of $1.10 per head it would mean approximately $22,000 more in cattle taxes alone not counting the property taxes on the farm and facilities, which will be considerable. 3. Employment. We will employ approximately 10 more people full time and create some summer jobs for students who are looking for part time employment. 4. The dollar volume per year which this operation will turn over will be approximately $6,000,000 much of which is spent right here in our community and will stay here. 5. Land Values. You must take into consideration that this land in this 7 area is good land but the values are not as high as in some other areas. Therefore, with anincreased feed market, it is foreseeable that values could improve in the future, Environmental Control We are going to have what we like to calla "controlled environment" when it comes to pollution control in both water and air, As you can see by these drawings, we have planned for the largest rainfall that we have had in the last 50 years, We feel that there is no way that any runoff water could ever escape from the place. The retention ponds will be sealed to i control seep so that nothing can ever seep below our ponds after the water is trapped, It will be recycled through the sprinkling system in the corrals or cycled onto the farmland for irrigation purposes. All the corrals are designed to be built so that all runoff water will run into the retention P ponds. We are going to install a complete sprinkling system throught the corrals to hold airborne dust to a very minimum. The system will use either retention pond water or irrigation water. This system will sprinkle the entire feedlot in about 24 hours with at least one inch of water. We would like to say that the only reason we are putting this in is—to be a good neighbor, but the truth of the matter is, we stand to benefit from the sprinkling system as much as the neighbors. We will have everything painted and well kept and we will also have what is commonly called a "green belt" with lawn and trees to protect and beautify the environment along the roadways. We feel that we have the ability to run a good clean operation based on our past experience within the neighbor- hood. We ask anyone to inspect what we have done in our lot at its present location. We have spent over $100,000 to control pollution and we had met all the standards the state has asked the industry to meet even before we were ever asked to do it. We had one of the first sprinkling systems in the area. We control runoff into retention ponds and we have installed an underground pipe system over a mile in length to use the runoff water for irrigation purposes.
