Re: Resolution Including Agricultural Lands Within the I-25 Urban Renewal Area

Dear Mayor Carroll:
The Board of County Commissioners of Weld County ("the Board") understands that tonight the
Town of Erie Urban Renewal Authority ("TOEURA") will consider adopting a proposed
resolution ("the Resolution") approving the conditions survey for the I-25 Urban Renewal Area
("the Area"), finding "blight" exists within the Area, and approving and adopting the I-25 Urban
Renewal Plan. The Area is shown on the map attached to the Plan as Figure No. 2. All of the
properties included within the Area are classified in 2019 as "agriculture" by the Weld County
Assessor pursuant to C.R.S. §§39-1-102(1.6)(a) and 39-1-103(5)(a).
The Board objects to the Resolution for the following reasons:
1. Section 7 of the Resolution says that "each public body that levies ad valorem property
tax on the agricultural land has agreed in writing to the inclusion of the agricultural land
within the Area." This information is incorrect. Weld County levies ad valorem property
tax on all agricultural land within the Area; however, the Board has not agreed to its
inclusion within the Area.
2. C.R.S. § 31-25-107(1)(a) requires the "governing body" of the of the municipality to
determine if the Area is "a slum, blighted area, or a combination thereof and designated
such area as appropriate for an urban renewal project." The Resolution is for TOEURA;
not for the Town of Erie Board of Trustees. Thus, the Resolution does not comply with
C.R.S. § 31-25-107(1)(a).

3. The Resolution does not make the detailed fining of facts required by C.R.S. § 31-25-
107(1)(c)(II) and (III). Such a finding of facts is necessary for the agricultural lands to be
included in the Area. The Board does not believe that these statutory requirements can be
satisfied and, therefore, it is inappropriate to include the agricultural lands within the
Area.
