HomeMy WebLinkAbout20190002.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 2, 2019 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 2, 2019, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Scott K. James Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • Commissioner Moreno stated it has been a great honor to serve as the Chair of the Board of County Commissioners for 2018 and believes the Board accomplished much for the County and thanked all Weld County staff. • ELECTION OF CHAIR: Commissioner Freeman moved to elect Barbara Kirkmeyer as Chair of the Board of County Commissioners for the year 2019, which was seconded by Commissioner Moreno. Commissioner Conway moved to elect Steve Moreno as Chair of the Board for the year 2019, which was seconded by Commissioner James. Commissioner Moreno declined the nomination, because he held the position of Chair for 2018. Bruce Barker, County Attorney, explained since Commissioner Moreno declined the nomination, there didn't need to be a motion on that vote. Upon a roll call vote, the motion to elect Barbara Kirkmeyer as Chair of the Board passed four to one, with Commissioner Conway opposed. • Commissioner Conway read his handout marked as Exhibit "A," for the record for backup documentation as to the reason he is opposed to the election of Commissioner Kirkmeyer as Chair of the Board of County Commissioners for the year 2019. • ELECTION OF CHAIR PRO-TEM: Commissioner Moreno nominated Commissioner Freeman as Chair Pro -Tern of the Board of County Commissioners for the year 2019, which was seconded by Commissioner James. Upon a roll call vote, the motion passed, unanimously. Minutes, Wednesday, January 2, 2019 Page 1 2019-0002 BC0016 ASSIGNMENTS: Commissioner Conway stated based on the previous two motions and direction of the Board, he will decline being a Commissioner Coordinator for any Weld County Departments for the year 2019. Commissioner Moreno moved to approve the Commissioner Coordinator assignments for the various departments in 2019, which was seconded by Commissioner Freeman. Upon a roll call vote, the motion passed unanimously. IR MINUTES: Commissioner Freeman moved to approve the minutes of the Board of County Commissioners meeting of December 26, 2018, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of Hearings conducted on December 26, 2018, as follows: 1) USR18-0059 — Dian and Travis Shockley, c/o Shocker Trucking, Inc., and 2) USR18-0086 — Jose Carbajal Castillo and Carolina Salinas Corona. Commissioner Freeman seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. El PUBLIC INPUT: Bill Gillard, resident of Greeley, congratulated Commissioner Moreno for being reelected for another term as a Weld County Commissioner and welcomed Commissioner James as a newly elected Weld County Commissioner. He expressed the need to have more transparency from the Commissioners to the tax payers. Mr. Gillard requested the Board video tape all their public meetings. Commissioner Kirkmeyer advised Mr. Gillard his three (3) minutes had expired. IR Gary Oplinger, resident of Johnstown, welcomed Commissioner James, and stated he looks forward to his leadership as a County Commissioner. BIDS: • 1) APPROVE BID #B1800137, CHILD WELFARE SOUTH - QUALIFIED HOME STUDY PROVIDERS - DEPARTMENT OF HUMAN SERVICES: Rob Turf, Department of Purchasing, stated staff would like to continue this matter, so the Department can have adequate time to review. Commissioner Conway moved to continue said bid to January 9, 2019. Seconded by Commissioner Moreno, the motion carried unanimously. IR 2) APPROVE BID #61800157, LEGAL NEWSPAPER SERVICES (01/01/2019, THROUGH 12/31/2019) — CLERK TO THE BOARD: Mr. Turf presented the two (2) bids received and stated staff recommends awarding to the Greeley Tribune stemming from concerns regarding the Tributary's transparency, availability, and reliability, and compliance with statutory requirements. In response to Commissioner Conway, Mr. Barker explained the Tributary missed the deadline of October 1, 2018 to file a PS form 3526 with the Post Master, and then publish its Statement of Ownership in the paper on or before October 31, 2018. He stated the Greeley Tribune was able to meet the deadline for both items, but the Tributary missed both deadlines. He checked with the Post Master and found the Tributary isn't suspended, although they submitted the paperwork late. Mr. Barker explained the reasons why he and Don Warden, Director of Administration and Finance, are concerned with Bob Grand, representative of the Tributary, having the availability and transparency. He stated he believes Mr. Grand may need the Clerk to the Board to remind him to get the publications done in a timely manner and meet the requirements for various legal notices. Mr. Barker stated the Greeley Tribune has more access to the public; even on their website there is a link for people to read the legal notices. In response to Minutes, Wednesday, January 2, 2019 Page 2 2019-0002 BC0016 Commissioner James, Chair Kirkmeyer stated the Board can consider the reliability, availability and transparency of the vendors when awarding the bid and has a responsibility to make sure the vendor is reliable. Mr. Barker referenced Section 14-9, sub paragraph 4, in the Home Rule Charter which states the process the Commissioners undergo in accepting or not accepting the low bid. In response to Commissioner Conway, Mr. Barker confirmed both vendors meet the statutory requirements. Commissioner Freeman moved to approve said bid awarding it to the Greeley Tribune. The motion was seconded by Commissioner Moreno, who stated he appreciated Mr. Barker and Mr. Warden's research and work on this bid. Commissioner James stated he believes publishing legal notices is a waste of taxpayers' money. Commissioner Conway stated both vendors can publish the legal notices, but the Tributary would be a substantial savings to the taxpayers and was the low bidder and he doesn't support the subjectivity of the award. eChair Kirkmeyer expressed her belief that the process is being followed and both publications meet the statutes. Upon a roll call vote, the motion carried four to one with Commissioner Conway opposed. • 3) PRESENT BID #61900030, FLASHING STOP SIGNS - DEPARTMENT OF PUBLIC WORKS: Mr. Turf reviewed the ten (10) bids received and stated staff will bring back a recommendation on January 16, 2019. NEW BUSINESS: eg 1) CONSIDER RESOLUTION RE: SCHEDULING OF REGULAR MEETINGS OF THE BOARD FOR 2019: Commissioner Freeman moved to approve said Resolution scheduling the regular meetings of the Board. The motion was seconded by Commissioner Conway, and it carried unanimously. • 2) CONSIDER RESOLUTION RE: AUTHORIZE PUBLICATION OF PROCEEDINGS FOR 2019: Commissioner James moved to approve said Resolution authorizing the publication of proceedings for 2019. The motion was seconded by Commissioner Moreno, and it carried unanimously. El 3) CONSIDER RESOLUTION RE: DESIGNATION OF PARTICULAR PUBLIC PLACE FOR POSTING OF PUBLIC NOTICES: Commissioner Moreno moved to approve said Resolution designating the place for posting of public notices. Seconded by Commissioner Freeman, the motion carried unanimously. • 4) CONSIDER RESOLUTION RE: DESIGNATION OF PARTICULAR PUBLIC PLACE FOR POSTING OF NOTICES OF TAX LIEN SALES AND NOTICES OF PROPERTIES GOING TO DEED: Commissioner Moreno moved to approve said Resolution designating the place for posting of Treasurer notices. El 10) CONSIDER APPOINTMENTS TO NORTH FRONT RANGE METROPOLITAN PLANNING ORGANIZATION - REGULAR AND ALTERNATE MEMBERS: Commissioner Freeman moved to appoint Commissioner Kirkmeyer as a regular member and appoint Commissioner Moreno as an alternate member, which was seconded by Commissioner Kirkmeyer. Commissioner Conway stated he has been serving as the alternate member for several years and if he is no longer serving as an alternate member, the Board may forfeit their seat on the Statewide Transportation Advisory Committee (STAC) committee. Upon a roll call vote, the motion passed three to two, with Commissioners Conway and James being opposed. 11) CONSIDER APPOINTMENT TO HUMAN SERVICES ADVISORY COMMISSION: Commissioner Freeman moved to approve the appointment of Commissioner James. Seconded by Commissioner Conway, the motion carried unanimously. . 12) CONSIDER APPOINTMENT TO LOCAL EMERGENCY PLANNING COMMITTEE: Commissioner Freeman moved to approve the appointment of Commissioner James. The motion was seconded by Commissioner Moreno, and it carried unanimously. El 13) CONSIDER AMENDMENT #1 TO AGREEMENT FOR INTERNET EQUIPMENT SITE (822 8TH STREET, GREELEY) AND AUTHORIZE CHAIR TO SIGN - RISE BROADBAND, INC.: Toby Taylor, Director of the Department of Buildings and Grounds, stated Rise Broadband, Inc., is a current tenant of this Weld County property and has requested the permission to install additional equipment. As a result, the rate of their lease will increase. Commissioner Freeman moved to approve said lease amendment and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously. • 14) CONSIDER 2017 STATE CRIMINAL ALIEN ASSISTANCE PROGRAM (SCAAP) AWARD AND AUTHORIZE ELECTRONIC SUBMITTAL: Jennifer Oftelie, Sheriff's Office, presented the SCAPP program award which is intended to help offset medical care costs for jail inmates. Commissioner Conway moved to approve said award and authorize electronic submittal. The motion was seconded by Commissioner Moreno, and it carried unanimously. El 15) CONSIDER CONTRACT ID #2341 PERFORMANCE WARRANTY FOR AMENDED MINING PERMIT OF PETERS 313 PIT AND AUTHORIZE CHAIR TO SIGN: Clay Kimmi, Department of Public Works, reviewed the terms for the performance warranty stating the Department will reclaim the property to its former condition following completion of the mining activities. Commissioner Conway moved to approve said performance warranty and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. • 16) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR CONTRIBUTION FOR ROADWAY IMPROVEMENTS TO CR 90 BETWEEN CR 29 AND U.S. HIGHWAY 85 AND AUTHORIZE CHAIR TO Minutes, Wednesday, January 2, 2019 Page 4 2019-0002 BC0016 SIGN — TOWN OF PIERCE: Mr. Barker presented the details of the intergovernmental agreement with the Town of Pierce. Commissioner Moreno moved to approve said intergovernmental agreement and authorize the Chair to sign, which was seconded by Commissioner Freeman. Commissioner Freeman stated this is regarding the Town of Pierce annexing property and roadway improvements to CR 90 which needed to be addressed. There being no further discussion, the motion passed unanimously. Chair Kirkmeyer thanked Commissioner Moreno for his accomplishments during his time as the Chair for the Board of County Commissioners executing his duties with integrity, upstanding ethics, and leadership. Each Commissioner also welcomed Commissioner James to the Board. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board. C.R.S. § 24-18-109(2)(a). This statute is designed to avoid conflicts of interest by government officials and employees. How well does it work? So far, not so much with regard to Weld County Commissioner Kirkmeyer. According to Facebook posts and confidential communications with persons working for Anadarko who spoke to our group on condition of anonymity, Commissioner Kirkmeyer negotiated with Anadarko regarding natural gas being provided to property she owns at 2365 WCR 23 near Fort Lupton. The negotiations occurred between November, 2017 and May, 2018. Our sources claim that Kirkmeyer used her position to demand favorable terms, from Anadarko mentioning that she had influence over land use decisions. At the conclusion of the negotiations, Kirkmeyer's daughter, Kathrine Pevler, crowed on Facebook about the successful completion of those negotiations so there is independent verification that Kirkmeyer was indeed involved in a financial transaction with Anadarko. So far, Commissioner Kirkmeyer has not notified anyone that she had a conflict of interest because of this transaction. Kirkmeyer recently voted on an Anadarko request for a land use approval on December 5 2018. And she has consistently voted on Anadarko matters over the years doing so at least twice in 2018, never declaring her conflicts. It's not the first time Anadarko has been in negotiations with Kirkmeyer. In February, 2012, Kirkmeyer negotiated to give Anadarko an easement across her property at 6100 WCR 4 as part of a pipeline project that had to be approved by the Weld County Board of County Commissioners. Kirkmeyer was not present for the actual vote but was present for all the preliminary hearings and never disclosed her conflict. And in an inexplicable transaction, in 2013 Kirkmeyer with her brothers sold to a shell corporation that transferred the property to Anadarko on the same day for the sum of $3.65 million dollars. Part of that property was sold for $2.65 million that Kirkmeyer had purchased for $244,000 in 2010. No disclosure then. It's not like the votes are close, so why not just disclose and recuse? Rosalie Everson, the former treasurer, and Jim Barrington, the former vice president, both left in April after they said they'd had enough of President Barbara Kirkmeyer's nepotism, abuse of volunteers and violation of the board's conflict of interest policies, which Kirkmeyer signed in 2O13 according to documents obtained by Complete Colorado. The SPVHS is a 5O1 (c)3 nonprofit. Its purpose, according to its website, is for the preservation and maintenance of sites, structures and objects of historical significance in the South Platte Valley area. It represents Lancaster Lupton's original fort and settlement in the area. They said Kirkmeyer has been the president of the board for as long as they can remember. She always had the final word when anyone disagreed with her. Page 3 of 7 Kirkmeyer accepted multiple donations from several individuals and corporations, most notably Anadarko Petroleum, which they said created an even larger appearance of impropriety in her role as a Weld County Board of Commissioner, as Anadarko comes before the BOCC on a regular basis in land use issues. After the first year of Market in the Fort, Everson said, the board refused to give Kirkmeyer a commission, so instead she continued to solicit the donations but diverted all commissions to her daughter. Kirkmeyer and her daughter also received several thousands in reimbursements for such things as "swag," "Facebook," and "miscellaneous," among others, but did not turn in receipts. The SPVHS discontinued the Market at The Fort after the second year because it proved unsuccessful, with most of the profits being reimbursed back to Kirkmeyer and her daughter. In fact, in 201.5, the net profit was $2.10 and in 2016 it was $1,957. "They would have been better off if they would have just let Anadarko donate the $ io,000," Everson said. Everson said Kirkmeyer also negotiated with Anadarko concerning infrastructure between the SPVHS and an adjacent landowner and solicited tens of thousands in donations from the company for other uses by the SPVHS. This is not the first time Kirkmeyer has been in the middle of unethical behavior concerning her fiduciary duties as a commissioner. In 2008, then Weld District Attorney Ken Buck said Kirkmeyer's roll in helping some communities with their grant writing was against state law, but there was no penalty to pursue. In that case, according to the Greeley Tribune: "Kirkmeyer entered into a number of contracts with cities and towns for grant -writing services, as soon as four months after leaving (her role as executive director of the state Department of Local Affairs). In all, she earned $35,500 for her services with the three towns." The situation with PVHS is similar in that Kirkmeyer's solicitations were from companies known to her because of her role as a commissioner. Kirkmeyer has never disclosed she or any member of her family has received money from Anadarko in any capacity during her terms as a commissioner, which is required under state law. She also has never recused herself from any votes pertaining to Anadarko. Everson and Barrington said the troubles with Kirkmeyer started several years ago over proposed construction projects. "There was a bit of a power struggle going on," Everson said, "because although Barbara wanted to have a lot of the glory, she wanted not so much to be doing a lot of the hard work." Barrington agreed, saying she's very rarely around except for board meetings.
