CODE, WITH AMENDMENTS, WITHIN CERTAIN AREAS OF UNINCORPORATED
WELD COUNTY LYING WITHIN THE SOUTHEAST WELD FIRE PROTECTION
DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, C.R.S. §32-1-1002 (1)(d), provides that a fire code promulgated by a fire
district may not be enforced in unincorporated portions of Weld County without the consent of the
Weld County Board of Commissioners, and
WHEREAS, the Southeast Weld Fire Protection District Board of Directors has presented
a resolution adopting the 2018 International Fire Code, with certain amendments, and
WHEREAS, after review, the Board deems it advisable to consent to the enforcement of
the 2018 International Fire Code, with certain amendments detailed in the attached Resolution
#2019-03 of the Board of Directors of the Southeast Weld Fire Protection District, within the
unincorporated areas of Weld County that are also within the geographic boundaries of the
Southeast Weld Fire Protection District.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board hereby consents to enforcement of the 2018 International Fire
Code, with certain amendments detailed in the attached Resolution #2019-03 of the Board of
Directors of the Southeast Weld Fire Protection District, within the unincorporated areas of Weld
County that are also within the geographic boundaries of the Southeast Weld Fire Protection
District.
BE IT FURTHER RESOLVED that any further amendments to the 2018 International Fire
Code by the Southeast Weld Fire Protection District shall not be effective within unincorporated
Weld County without the presentation to, and consent of, the Weld County Board of County
Commissioners.

District currently enforces 2012 IFC, adopted in May 2017 (attached).
The proposed adoption of 2018 IFC addresses the Commissioners concerns as noted and outlined in
template (attached).

RESOLUTION 2019-03
SOUTHEAST WELD FIRE PROTECTION DISTRICT
A RESOLUTION, ADOPTING THE INTERNATIONAL FIRE CODE, PRESCRIBING
REGULATIONS GOVERNING CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM
FIRE OR EXPLOSION, AND PROVIDING FOR THE ISSUANCE OF PERMITS FOR
HAZARDOUS USES OR OPERATION.
WHEREAS, The Board of Directors of the Southeast Weld Fire Protection District deems it
necessary to adopt the following code for the purpose of establishing rules of conduct and
standards for the protection of life, health, property, security, and welfare of the inhabitants of the
District; and
WHEREAS, The Board of Directors has considered the effect of the fire code enforcement within
the boundaries of the District and has determined that enforcement of the proposed codes would
not cause undue hardship or suppression of economic growth within the District; and
WHEREAS, The Board of Directors has studied the necessity for realistic and reasonable level of
fire protection to be provided by a fire protection district; and
WHEREAS, The Board of Directors will pursue adoption by municipalities within the limits of the
District to adopt the same codes for the purpose of ensuring equitable protection of all of the
inhabitants of the District;
NOW, THEREFORE, BE IT RESOLVED:
SECTION I: Adoption of the 2018 International Fire Code and International Fire Code Standards.
There is hereby adopted by the Southeast Weld Fire Protection District for the purpose of
prescribing regulations governing conditions hazardous to life and property from fire, hazardous
materials, or explosion, that certain Codes and Standards known as the International Fire Code,
including all Appendix Chapters. Published by the International Code Council, being particularly
the 2018 editions thereof and the whole thereof, save and except such portions as are hereinafter
deleted, modified, or amended by the Resolution of which said Code and Standards are now filed
in the offices of the Southeast Weld Fire Protection District, and the same are hereby adopted and
incorporated as fully as if set out at length herein. The date on which this Resolution shall take
effect within the incorporated municipalities within this District shall be the date of approval by the
governing board of said municipality and the date on which it shall take effect within the
unincorporated portions of Weld County shall be on the date of approval by the Boards of County
Commissioners in and for the County of Weld State of Colorado. This Code shall be in effect within
the territorial limits of the Southeast Weld Fire Protection District.
SECTION II: Establishment and Duties of Fire Prevention.
Organizational structure and duties of the Fire Prevention Division, if any, shall be as provided by
the District's policies and or directives.
SECTION III: Definitions.
Wherever the word "District" is used, it shall mean the Southeast Weld Fire Protection District.

Wherever the word "jurisdiction" is used in the adopted Code and Standards, it is meant to be
inclusive of the boundaries of the Southeast Weld Fire Protection District as they now or may
hereafter exist.
Where the term "Chief" or "Chief of the Bureau of Fire Prevention" is used, it shall be held to mean
the Chief of the Southeast Weld Fire Protection District, or a designated member of the
District.
Where the term "Bureau of Fire Prevention" is used, it shall be held to mean either the entire Fire
Prevention Division or those employees (paid or volunteer) designated by the Chief to carry out
enforcement duties relating to the prevention of fires and suppression of arson.
Where the term "Board" is used, it shall be held to mean the Board of Directors of the Southeast
Weld Fire Protection District.
Wherever the term "International Building Code" is used, it shall be held to mean the International
Building Code as adopted, amended and incorporated into the Weld County Building Code, Town
of Keenesburg Building Code.
SECTION IV: Amendments made in and to the 2018 International Fire Code. The 2018
International Fire Code is amended and changed in the following respects:
1) Section 503.1.2 Additional Access.
Additional Access permit(s) for fire safety may be requested from Weld County through
the access permit process set forth in the Weld County Code, in the unincorporated
portions of the Fire District.
2) Section 503.2 Specifications.
Fire apparatus access roads shall be installed and arranged in accordance with Sections
503.2.1 through 503.2.8. Single and double family residences will not require unduly
burdensome road construction or driveway maintenance.
3) Section 507.5.1 Where required.
Where a portion of the facility or building hereafter constructed or moved into or within the
jurisdiction is more than 400 feet (122 m) from a hydrant on a fire apparatus access road,
as measured by an approved route around the exterior of the facility or building, on -site fire
hydrants and mains shall be provided where required by the fire code official.
Exceptions:
1. Requirement does not apply to Group R-3 (single and double family) and Group U
occupancies.
4) Section 903 Automatic Fire Sprinkler Systems.
Automatic sprinkler systems shall not be required in one and two-family dwellings that are
less than 3600 square feet of habitable space above grade.

Subsection -1- Open Burning:
The following section is to be added to Chapter 1, and to be known as Section 105.6.32 "This
Article shall be interpreted to be consistent with the provisions of § 32-1-1002(3), C.R.S." or where
there is a separate ordinance that addresses this section. Chapter 1, Section 105.6.32 shall be
amended by the addition of a sentence reading as follows: "No such permit shall be required
where burning is regulated pursuant to regulations promulgated under §25-7-123, C.R.S. and
regulated by the Weld County Health Department or municipal authorities.
Subsection -2- Appendix A
The following section A101.2 of Appendix A shall be repealed and replaced, and to be known as
Section A101.2:
A101.2 Membership The membership of the board shall consist of three voting members having
qualifications established by this section. Members of the board shall be the Fire Chief, Chief
Building Official, and a Fire Protection Engineering Professional.
A101.2.1 Fire Protection Engineering Professional One member shall be a qualified engineer,
technologist, technician, or safety professional trained in fire protection engineering, fire science,
or fire technology.
Section V: Validity and Conflict:
The Board of Directors of the Southeast Weld Fire Protection District hereby declare that should
any section, paragraph, sentence, or word of this resolution; or of the code or standards hereby
adopted; be declared for any reason to be invalid, it is the intent of the Southeast Weld Fire
Protection District Board of Directors that it would have passed all other portions of this resolution
independent of elimination here from any such portion as may be declared invalid. It is further the
declaration of the Southeast Weld Fire Protection District Board of Directors, that no provision of
this resolution or the code or standards adopted herein, be interpreted in conflict with existing
State law, in the event there is a conflict between State law and this code, State law shall take
precedent.
Section VI: Date of Effect:
This resolution shall take effect and be enforced within incorporated municipalities and
unincorporated portions of Weld County from and after its approval as set forth in §32-1-
1002(1)(d) C.R.S.

President Casey Neill called the meeting to order June 26, 2019 at 7:00 p.m.

Agenda
A. Approval of the Board Agenda — President Casey Neill called for a motion to approve the meeting
agenda. Vice -President Corey Huwa made the motion to approve, Director Jared Brnak seconded,
and the motion passed with all in favor.
B. Approval of the Meeting Minutes - President Casey Neill called for a motion to dispense with
reading of the minutes per prior review and approve the May 8, 2019 minutes; Director Jared Brnak
made the motion to approve and Vice -President Corey Huwa seconded. The motion passed with all
in favor.
C. Approval of the financial Report (May 2019 financial statements/Payment of Bills) — President Casey
Neill called for a motion to approve the year to date financial statement report. Vice -President
Corey Huwa made the motion to approve, Director Jared Brnak seconded, the motion passed with
all in favor.

Presentations:
A. Southeast Weld Fire District Local 5161 —
a. Ian Scott President of Local 5161 introduction and listing of the members of the local
516. The local will be holding a fundraiser event to raise funds to donate to We Care.
They are also working on setting up a scholarship fund for local community members.
Current membership is 20 of 24 -line staff. They are looking to continue to build a
relationship with the SE Weld District. They will be partnering with the district to
support the MDA fundraiser. They also assisted during the mill levy by canvassing the
district. The goal of the Local 5161 is to give back to the community and the district.
B. 2018 AUDIT, Chad Chavies, CPA District Auditor
a. Audit was reviewed in detail to include investments, and the pension fund. The audit
wrap up and depreciation schedule was reviewed. President Casey Neill called for a
motion to approve the 2018 Audit. Vice -President Corey Huwa made the motion to
approve and Director Jared Brank seconded and the motion passed with all in favor.
Regular Meeting Action Items
A. Resolution 2019-03, 2018 International Fire Code
a. This was reviewed in May, there have been no changes. We are currently on the 2012
code and we are required to be within 5 years, nothing is changing due to the exemptions
that have been added by Weld County. Vice -President Corey Huwa made the Motion to
Approve Resolution 2019-03 Director Jared Brnak Seconded and the motion passed with
all in favor.
B. Incumbency Certificate
a. Vice -President Corey Huwa made the motion to accept the Certificate of Incumbency,
Director Jared Brnak seconded, and the motion passed with all in favor.

C. Platte Valley Medical Center Contract
a. The Current Contract is scheduled to end in 2020, discussion was held in regard to
ending the contract on December 31, 2019 as well as change the billing schedule to end
on December 31, 2019. This will move the contract to an annual billing, December 2019
will be paid in January 2020. The new contract will be dated January 1, 2020 to
December 31, 2024. Vice -President Corey Huwa made the motion to designate Chief
Tom Beach to handle all dealing with Platte Valley Medical Center as discussed, to
include ending the current contract and signing the new contract. Director Jared Brnak
seconded, and the motion passed with all in favor.
D. Ambulance Purchasing
a. Discussion was held in regard to re -chassis or purchasing of new ambulances based on the
recommendations of the district mechanic. Vice -President Corey Huwa made the motion
to approve the order of 1 Chassis and 1 new ambulance for payment in 2020. Director
Jared Brnak seconded, and the motion passed with all in favor.
b. Discussion was held in regard to replacing the Tenders. Vice -President Corey Huwa
made the motion to approve the order of 1 chassis and 3 new tenders for payment in
2020. Director Jared Brnak seconded, and the motion passed with all in favor.
E. Amendment to IGA with Keenesburg
a. The current IGA between he Town of Keenesburg and the Southeast Weld Fire
Protection District new annexation is not required to include/exclude into the Southeast
Weld Fire Protection District. Legal council has reviewed the a new IGA. The new
changes for lands that are annexed into Keenesburg even if outside of the fire District
boundaries would be required to include their lands into the Southeast Weld Fire
Protection District. Vice -President Corey Huwa made the motion to accept the
amendment to the IGA, Director Corey Huwa seconded, and the motion passed with all
in favor.

a. Will Be reviewed again in August after we have received the assessed values for 2020.

a. Discussed the formats for annual review, this will be discussed again in August.
1. FIRE CHIEF'S REPORT
A. Budget Year -to -Date Report/Revenue Report
a. Looked at a broad view of the 2020 Budget. The district is budget is on track for the year.
The pipeline and fence are still outstanding on Station 2.
B. Personnel Report
a. There are 2 -line members leaving the district. There will be hiring board on Monday July
1, 2019. Driver Operator Pumper and Driver Operator Class will be held in August.
Firefighter II training has been completed, this was done in house. Training hours for the
month are: medical — 127 hrs., Live Fire — 120 hrs., On Duty training 109 a Total of 557
hours for May training.
C. Apparatus Report
a. Reviewed under Ambulance Discussion
D. Facilities Report
a. County exemptions have been approved by the county and the sewer is in process at
Station 2.
E. Additional District Reports
a. A Greeley Green Energy LLC new waste water treatment facility going in by Al organics.
This is a Water treatment and oil recovery process and a power plant substation.
b. Anadarko is putting in new pads on Cervi ranch beginning 2020.
c. Evans place has broken ground
