A public hearing was conducted on May 15, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
2( I hereby certify that pursuant to a notice dated March 27, 2019, and duly published
April 3, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of
English Feedlot 2, LLC, c/o Expedition Water Solutions Colorado, LLC, for a Site Specific
Development Plan and Use by Special Review Permit, USR19-0002, for a Mineral Resource
Development Facility, Oil and Gas Support and Service Facility (Class II Oilfield Waste Disposal
Facility — Salt Water Injection Facility) in the A (Agricultural) Zone District. Bob Choate, Assistant
County Attorney, made this a matter of record.
' Angela Snyder, Department of Planning Services, presented a brief summary of the proposal
and mentioned the site is on Lot B of Recorded Exemption, RECX18-0167. She indicated 13
referrals were sent out, eight (8) agencies responded, and the site is within the three (3) mile
referral area of the Towns of Hudson and Lochbuie, and the City of Fort Lupton, and is located
within the Fort Lupton Cooperative Planning Agreement (CPA) boundary. She stated the site
would include a steel building to house an office and injection pumps, a concrete tank containment
area, and a pipeline to deliver water to the site. She noted there will be ten (10) full-time
employees over three (3) shifts, eight (8) parking stalls, and no screening or landscaping is
proposed. She described surrounding uses, displayed images of site, and entered the favorable
recommendation of the Planning Commission into the record as written.
Mike McRoberts, Department of Public Works, provided a brief overview of the transportation
plans and requirements, stated the access is on County Road (CR) 10, and provided traffic

counts, average speed, and daily roundtrip information. He noted the site will have gravel or
concrete on all drive surfaces, the Department of Public Works (PW) is requiring a Road
Maintenance Agreement (RMA), and presented the drainage and grading requirements.
2 Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions and reiterated there will be up to ten (10) full-time employees. He stated water would
be provided by a proposed commercial well, the applicant is proposing to install a commercial
septic system, and noted floor drains will drain into the offload pad sump. He stated the
Department of Public Health and Environment (EH) is requiring a Groundwater Monitoring Plan
and an Offload Plan Design, and Development Standards (DS) #17-39 address EH items. In
response to Commissioner Conway, Ms. Snyder reiterated the Town of Locubuie's concerns.
12 Eric Wernsman, with Wernsman Engineering and Land Development, represented the
applicant and stated the owner of Expedition Water Solutions Colorado, LLC, Jim Goddard,
responded to the Town of Lochbuie regarding their concerns. He described the noise mitigation
measures, explained the site layout, mentioned there will be restrooms for employees and truck
drivers, and stated the pipeline to the site should be completed around the same time as site
construction.

Chair Kirkmeyer suggested deleting Condition of Approval (COA) #1.F (Communication
Plan), adding "including the Dark Sky Policy' to COA #1.G (Lighting Plan), changing "be limited
to" to "no more than" in DS #4 (number of employees), deleting "and the Communication Plan"
from DS #6 (Decommissioning Plan), adding a new DS #7 that reads "The applicant shall maintain
compliance with the Lighting Plan", and changing the language in DS #22 (portable toilet
screening) from "public vies/' to "public rights -of -way", and the Board agreed.
El In response to Chair Kirkmeyer, Mr. Wernsman indicated he had reviewed, and agreed to
abide by, the Conditions of Approval and Development Standards, as amended.
la No public testimony was offered with regard to the changes to Conditions of Approval and
Development Standards.
IR Commissioner Moreno moved to approve the request of English Feedlot 2, LLC, c/o
Expedition Water Solutions Colorado, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR19-0002, for a Mineral Resource Development Facility, Oil and Gas
Support and Service Facility (Class II Oilfield Waste Disposal Facility — Salt Water Injection
Facility) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and
the Planning Commission, with the Conditions of Approval and Development Standards, as
amended. The motion was seconded by Commissioner Conway, and it carried unanimously.
There being no further discussion, the hearing was completed at 11:36 a.ni.
