SUBSTATION (WAPA AULT SUBSTATION) IN THE A (AGRICULTURAL) ZONE
DISTRICT - PUBLIC SERVICE COMPANY OF COLORADO
A public hearing was conducted on January 23, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
ID I hereby certify that pursuant to a notice dated December 27, 2018, and duly published
January 2, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request
of Public Service Company of Colorado, for a Site Specific Development Plan and Use by Special
Review Permit, USR18-0100, for a 1041 Permit for a Major Facility of a Public Utility one (1)
230KV transmission line extending approximately 21 miles, one (1) new substation (Graham
Creek) and upgrades to an existing substation (Wapa Ault Substation) in the A (Agricultural) Zone
District. Frank Haug, Assistant County Attorney, made this a matter of record.
El Commissioner Freeman recused himself for a conflict of interest.
Mr. Haug stated the application is a 1041 application, which have statutory requirements
including hearing the case within a time constraint. He indicated the applicant signed a waiver
agreement for an extension of time to hear the case. He further explained there is an additional
statutory requirement to notify all mineral owners of any surface development, which had not been
done and should be done 30 days prior to the hearing. He stated the Planning Commission did
continue the case to allow additional time for the statutory requirements to be met.
Chris Gathman, Department of Planning Services, reiterated the applicant's request for a
continuance, to allow additional time to work through concerns of agencies as mentioned in
referrals. He stated there were two (2) representatives of the applicant prepared to speak to a
continuance.

Larry Claxton, Agent with Xcel Energy, reiterated the request for a continuance to work with
landowners to address concerns. He indicated, pursuant to the terms of the Amended Waiver
Agreement, approved January 21, 2019, the Planning Commission was continued to March 19,
2019, and he requested the Commissioners continue this hearing to May 22, 2019.
No public testimony was offered concerning this matter.
El Commissioner Moreno moved to continue the request of Public Service Company of
Colorado for a Site Specific Development Plan and Use by Special Review Permit, USR18-0100,
for a 1041 Permit for a Major Facility of a Public Utility one (1) 230KV transmission line extending
approximately 21 miles, one (1) new substation (Graham Creek) and upgrades to an existing
substation (Wapa Ault Substation) in the A (Agricultural) Zone District, to May 22, 2019, at
10:00 a.m., to allow the applicant adequate time to meet statutory requirements, work to address
concerns and have a Planning Commission hearing. The motion was seconded by Commissioner
Conway, and it carried unanimously. There being no further discussion, the hearing was
completed at 10:07 a.m.
This Certification was approved on the 28th day of January, 2019.
