HomeMy WebLinkAbout20191691HEARING CERTIFICATION DOCKET NO. 2019-50 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0127, FOR A SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT- CLAIRE SCAVELLO A public hearing was conducted on May 8, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Maxwell Nader Public Works Department representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: IR I hereby certify that pursuant to a notice dated March 27, 2019, and duly published April 3, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Claire Scavello, for a Site Specific Development Plan and Use by Special Review Permit, USR18-0127, for a Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. t. Maxwell Nader,. Department of Planning Services, presented a brief summary of the proposal and stated the second dwelling will be used for a family caretaker, or possible rental purposes. He noted no correspondence had been received concerning the application, 14 referrals were sent out, and eight (8) agencies returned a response. He stated the site is adjacent to County Road (CR) 4 and CR 33.75, and is within the three (3) mile referral area of the Cities of Fort Lupton, Brighton and Lochbuie. He indicated the site is located within the Fort Lupton Coordinated Planning Agreement area, and they do not wish to annex at this time. He displayed images of the site including the current layout, described surrounding uses, and entered the favorable recommendation of the Planning Commission (PC) into the record as written. He referenced a letter from the PC and a memorandum written by the Department of Planning Staff. In response to Commissioner Conway, Mr. Nader clarified Condition of Approval (COA) #1.A (temporary zoning permit) has been met and can be removed. He also clarified COA #1.B, stating the applicant has agreed to cease to use the Recreational Vehicle (RV), and the need for the notarized document is not typical, but needed, because the living quarters is an RV. She mentioned CR 33.75 is a subdivision road and is not County maintained. :12I: Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, and stated the existing well is permitted for domestic and commercial use, and can be used for both homes. She explained the current septic system is only permitted for three (3) bedrooms, so a separate septic system would need to be installed for the second residence, and noted Development Standards (DS) #3-4 address Environmental Health (EH) items. la Claire Scavello, applicant, stated the second dwelling unit will be occupied by her sister and her partner, and in response to Chair Kirkmeyer, she stated it will be located approximately where the RV currently is, depending on the required setbacks. L'- No public testimony was offered concerning this matter. ` The Board agreed to delete COA #1.A (temporary zoning permit) as the condition has already been met. In response to Commissioner Conway questioning the need for COA #1.B, the Board changed the language to read, "Recreational Vehicles shall not be used as a dwelling unit." I There was no public testimony with regard to the changes of the Conditions of Approval and Development Standards. In response to Chair Kirkmeyer, Ms. Scavello indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Claire Scavello for a Site Specific Development Plan and Use by Special Review Permit, USR18-0127, for a Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously.
