DIVISION OF LAND N0. 1055-16-3-RE-34
DETERMINED TO BE EXEMPT FROM DEFINITION OF SUBDIVISION
RANGE 65, TOWNSHIP 4 NORTH, SECTION 16
WEST HALF OF THE SOUTHWEST QUARTER (WISW4):
WHEREAS, on May 5, 1972, the General Assembly of the State of Colorado,
enacted Senate Bill #35 as relates to Chapter 106 of the Colorado Revised Statutes,
and
WHEREAS, on August 30, 1972, the Board of County Commissioners of Weld
County, Colorado, adopted Subdivision Regulations for Weld County, Colorado to
comply with the prescribed Senate Bill #35, and
WHEREAS, the Weld County Planning Commission has recommended to the
Board of County Commissioners for recording of plat number 1055-16-3-RE-34 as
provided in Section 9 of the Subdivision Regulations (exemption rules and regulations)
for Weld County, Colorado.
Said division of land determined to be exempt for the definition of
subdivision is more particularly described as follows:
A tract of land being the WiSWi- Section 16, Township 4 North, Range
65 West of the 6th P.M. , Weld County, Colorado and being more particularly
described as: Considering the West Line of said Section 16 to bear North
00°00'00" West, all other bearings relative thereto: Beginning at the
Southwest Corner of said Section 16, thence; North 00°00'00" West,
2 il. ffeet; thence, South 89°58'50" East, 1317.00 feet; thence, South
00°00'44" West, 2651.26 feet; thence, North 89°59'27' West, 1316.44
feet to the point of beginning.
The above described tract contains 69.962 acres, more or less, excluding
2.637 acres, county road purposes recorded in Book 296, Page 149, Weld
County Records.
4.787 Acres, Platte Valley Irrigation Company, recorded in Book 251,
Page 70, Weld County Records.
2.759 Acres, The Farmers Reservoir and Irrigation Company, State Board
of Land Commissioners, Row No. 1380.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of
Weld County, Colorado, that the Chairman be and he is hereby authorized to sign
the plat of a division of land determined to be exempt from the definition of
Subdivision No. 1055-16-3-RE-34, for recording.

PROCEDURAL GUIDE FOR RECORDED EXEMPTION
APPLICATION
Meld County Planning Commission

Effective Date : August 15 , 1972
Any person , firm , group , legal entity, or duly authorized legal agent
filing application for a recorded exemption for any parcel of land with-
in the unincorporated area of Weld County , State of Colorado , shall be
required to comply with the following procedures and conditions :
I . The applicant shall fii with office o ; the Planning Department
the following items :
(A) An application form as prescribed and furnished by the Plan-
ning Department .
(B ) A complete and accurate legal description of the property.
The legal description must be acceptable to the County Attorney,
and no application can be considered by the Board until such
legal description is provided. The legal description shall in-
clude all contiguous land owned by the applicant.
(C) A plat of the proposed land division conforming to and contain-
ing the fallowing items :
(1 ) The plat' shall be prepared by a registered land surveyor
in the State of Colorado .
(2) The plat shall be prepared on 1 or more consecutively num-
bered sheets measuring 8a" x 14" . It shall be drawn on
waterproof linen or mylar .in ink.
(3) The plat shall be titled , "Recorded Exemption No . ' "
(The appropriate number to be filled in by the Planning
Department. )
• (4) The plat and legal description shall include all contigu-
ous land owned by .the applicant.
(5) Tne plat shall include a complete anti accurate legal des-
cription of the parcel of land and its acreage .
(6) The plat shall include a vicinity sketch locating the
tract with respect to roads and other major land features .
(7) The prat shall include an accurate drawing of the tract
and the proposed division into 2 lots . This drawing shall
include bearings , lengths and curve data of all perimeter
and lot lines . The lots shall be designated as "Lot A"
and "Lot 8 " and the acreage of each given . Existing pub-
lic rights-of-way which provide access to the tract shall
be shown . The scale of the drawing shall be adequate to
clearly show the above required items . A scale and North
arrow shall be included .
(8) The plat shall bear the following certifications :

(C) The number of acres in said application has been determined .
(D) The application has been properly completed .
( E) The required number and manner of information or drawings have
been submitted .
( F) All required fees have been paid .
( III ) When a complete application has been received by the Planning Depart-
ment , the applicant will be issued an application receipt , and the
application will be sent to the Board of County Commissioners for
their review.
( IV) If the Board approves the application , it will approve the plat for
filing and the plat will be filed with the County Clerk and Recorder .
(V ) NOTE : All legal descriptions and the survey plat must include the
entire original property , Not just one of the pieces being divided
from the original property .
